ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 20TH DAY OF APRIL, 2009 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 20TH DAY OF APRIL, 2009 1 RESOLUTION NO. R- -Dci A RESOLUTION APPROVING A CERTIFICATE OF APPROPRIATENESS FOR THE DEMOLITION OF A BUILDING LOCATED AT 322 MAIN STREET. WHEREAS, George Kurian and Rita Shah (hereinafter referred to at "the Petitioner ") are the owners of the subject property partially located on lots 9 and 10 in block 34 in Village of Keepotaw, in the West 1/2 of the Southeast 1/4 of Section 20, Township 37 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, commonly known at 322 Main Street, Lemont, Illinois; and WHEREAS, the subject property is located within Lemont Historic District No. 1; and WHEREAS, the Petitioner made application under the provisions of the Lemont Unified Development Ordinance for a certificate of appropriateness to demolish the existing two -story building; and WHEREAS, the Lemont Historic Preservation Commission conducted a public hearing on the Petitioner's request, in accordance with Lemont Unified Development Ordinance, and voted to deny the certificate of appropriateness at a public meeting on March, 12, 2009; and WHEREAS, the Petitioner appealed the decision of the Historic Preservation Commission to the President and the Village Board of Trustees; and WHEREAS, the President and the Village Board of Trustees find it in the best interests of the Village of Lemont to allow the demolition of the building, NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that said appeal is granted and a Certificate of Appropriateness for the demolition of the building located at 322 Main Street is hereby granted, subject to the following conditions: 1. Prior to the issuance of a demolition permit, the Petitioner shall apply for and receive a site development permit. As a condition of the site development permit approval, the applicant shall provide a letter of credit or other financial guarantee to cover the estimated engineering costs of grading, erosion control, sodding, and landscaping along Main Street. 2. Within three months of the issuance of the site development permit, the Petitioner shall install the following landscaping along the north property line of the subject property: one canopy tree; one evergreen tree; two ornamental /understory trees; and three large shrubs, 5 small shrubs, or equivalent ornamental grasses. If the Petitioner submits a complete building permit application or Type II Downtown District development application within three months of the issuance of the site 2 development permit, the landscaping requirement shall be waived. However, if the building permit application expires, if the Type II Downtown District development application is denied, or if the redevelopment of the site does not progress for any reason, the Petitioner shall then be required to install the landscaping. 3. As part of the application for a site development permit, the Petitioner shall include a plan to preserve the existing trees on the west side of the property during the demolition of the existing building and the regrading of the site.
