(Old Quarry) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 14TH DAY OF DECEMBER, 2009 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, DUPAGE, AND WILL COUNTIES, ILLINOIS, THIS 14T11 DAY OF DECEMBER, 2009 1 RESOLUTION NO. R ( 7- A RESOLUTION GRANTING A 120 -DAY EXTENSION TO THE EXPIRATION DATE OF A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND ZONING MAP AMENDMENT FOR A 3.73 -ACRE PARCEL AT 15884 W. 127TH STREET, LEMONT. (Old Quarry) WHEREAS, Robert Wagner, hereinafter referred to as "the Petitioner," acting on behalf of the owner of the subject property covering approximately 3.73 acres located at 15884 W. 127th Street (PIN# 22 -32- 100 -006) and legally described in Exhibit "A" attached, made application under the provisions of the Lemont Unified Development Ordinance for preliminary planned unit development (PUD) approval and zoning map amendment from Cook County R -4 Single - Family Residence District to Lemont B -1 Office Retail Transitional District; and WHEREAS, the Village Board of Trustees approved Ordinance 0- 85 -07, granting approval of said requests, in October 8, 2007; and WHEREAS, Section Three of Ordinance 0 -85 -07 mandates the expiration of the zoning map amendment and special use/PUD aprpoval if, upon failing to obtain Final Plat and engieering plan approval, the Petitioner does not request an extension of said approval within two years, and WHEREAS, the Village Board of Trustees approved Resolution R -63 -09 on October 26, 2009, extending the expiration of the zoning map amendment and special use/PUD approval for 60 days; and WHEREAS, the Petitioner, who remains in negotiations with a lending insitution and potential buyers of poportions of the proposed development, has again requested an extension of the zoning map amendment and special use/PUD approval. NOW, THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. That the preliminary PUD approval and zoning map amendment for Old Quarry shall hereby be extended for an additional period totaling 120 days from the date of the extension granted in Resolution R -63 -09 (Dec 26, 2009). Section 2. That this extension shall have no effect on any other terms or conditions of Ordinance 0- 85 -07. Section 3. Any request for an additional extension of zoning or special use/PUD approval shall be submitted by the Petioner prior to April 1, 2010.
