RESOLUTION APPROVING FINAL PLAT OF SUBDIVISION
FOR BOGUN RESUBDIVISION
WHEREAS, the petitioner is the owner of certain property consisting of
approximately 1.5 acres located at 12965 Silver Fox Drive in Lemont, Illinois and legally
described as follows:
LOT 111 IN FOX HILLS UNIT ONE -A, BEING A SUBDIVISION OF PART
OF THE SOUTH 1/2 OF THE NORTHEAST 1/4 OF SECTION 34, AND
THE SOUTHWEST 1/4 OF THE NORTHWEST 1/4 OF SECTION 35, BOTH
IN TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL
MERIDIAN, IN COOK COUNTY, ILLINOIS.
WHEREAS, the petitioner has submitted the Final Plat of Subdivision for the subject
property, which is known as Bogun Resubdivision, attached hereto as Exhibit "A"; and
WHEREAS the Lemont Planning & Zoning Commission has reviewed and
recommended approval of the Final Plat of Subdivision on November 5, 1996; and
WHEREAS, the Final Plat of Subdivision is in substantial conformance with the
physical development policies and standards of the Village of Lemont.
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont that the Final Plat for Bogun Resubdivision, which is attached hereto
and made part hereof, is hereby approved with a waiver of all public improvements not
required by the Cook County Board.

This parcel is located in the Fox Hills Estates Unit 1 -A
subdivision, located at the intersection of 131st Street and Parker
Road in unincorporated Lemont Township. The property is owned by
Boleslaw (Bill) and Marie Bogun. The area is characterized by a
mix of low density residential and agricultural uses. Lot sizes
generally are generally 1/2 to 1 acre in size, but are serviced by
the Citizen's Utility Company for water & sewer service.
DEVELOPMENT PROPOSAL
The subject property consists of approximately 1 1/2 acres of land.
The owner would like to subdivide the land into two (2) parcels.
Lot 1 would be where the existing single family residence is
located. This lot would be slightly over 1/2 acre in size. Lot 2
would be a vacant parcel approximately one (1) acre in size. This
lot would be sold for development purposes. Lot 2 would contain an
existing detention basin. This detention basin would be
reconfigured to accommodate the required detention pond as well as
a future single family residence.
EVALUATION
The subdivision review is required by the Planning and Zoning
Commission and the Village Board because the property is within 1.5
miles of the Village limits. By State law, the Village of Lemont
has jurisdiction over any subdivision of land within 1.5 miles of
the corporate limits. This subdivision meets the minimum standards
for subdivision approval by the Village.
Under normal circumstances, all public improvements would be
required as part of the subdivision process. However, since this
parcel is more rural in nature and this area of Lemont Township
generally has fewer public improvements than areas located in the
Village, staff feels that any additional public improvements are
not necessary. The entire subdivision has public water, sewer and
paved streets. However, curb & gutter, sidewalks and parkway trees
have not been installed as part of the subdivision.
PUBLIC RESPONSE
No public comments have been received to date regarding this
proposal. The hearing in front of the Cook County Board will be
scheduled upon review and approval of the Plat by the Planning and
Zoning Commission and the Village Board. Public testimony may be
given in that forum as well.
STAFF RECOMMENDATION
Staff recommends approval of the proposed 2 -lot Bogun
Resubdivision, with a waiver of all required public improvements

not already completed. The subdivision meets the minimum required
standards as written in the Lemont Subdivision Ordinance. However,
this recommendation is based on the following conditions:
1. The Plat shall generally conform to the plat of Bogun
Subdivision, last revised January 11, 1995 by Area Survey
Company. Minor revisions to the plat shall be permitted to
correct easements, language and surveying errors upon review
and approval by the Village Administration.
2. All public improvements so waived by the Village of Lemont
shall nonetheless be required if deemed necessary by the Cook
County Board.
3. Land /cash contributions, in the amount of $2,346.81 (3 bedroom
single family detached residence) are required prior to
signing of the plat by the Village Board.

MINUTES
November 5, 1996
The meeting of the Lemont Planning & Zoning commission of the Village of
Lemont was held on Tuesday, November 5, 1996 at the Village Hall. The
meeting was called to order at 7:30 p.m. by the Chairman Pro -tem, Terry Duffy.
The following commissioners were present: Terry Duffy, Gary Gray (late), Kathy
Murphy, Tom Metzger and Ellen Pearson. Absent: Rick Sniegowski.
A motion was made by Mr. Stapleton and seconded by Ms. Murphy to approve
the minutes of the October 15, 1996 meeting. Motion carried 5 -0.
NEW BUSINESS
A. Bogun Resubdivision - Review and approval of proposed 2 -lot resubdivision
plat - 12965 Silver Fox Drive.
Mr. Buening stated that this is a public review and not a Public Hearing. The
parcel is located in Fox Hills Estates and is approximately 1.5 acres in size. It is
located in Cook County, south of Ruffled Feathers.
The petitioner is proposing to divide the parcel into two lots. One lot is for the
existing home and the other lot would be to create a buildable lot for another
structure. The Village is required to review and sign off on any plats that are
within 1 -1/2 miles of their boundaries. They will be reconfiguring the detention
pond on lot 2. They have received approval from the Army Corps of Engineers
and the Homeowner's Association. It is not anticipated that this will be annexed
into the Village in the near future.
Mr. Donald Eddy, the engineer representing the petitioners, stated that the
property is served by sewer and water. The original stormwater detention was to
be 61,000 cubic feet but only has 35,000 cubic feet of stormwater storage at
present. He stated that with reconfigurating and realignment, the 61,000 cubic
feet will be restored. He stated that they meet all the R -3 Cook County
requirements.
Mr. Metzger asked if a proposed home on the 2 "d lot would need a variance. Mr.
Eddy stated that it would not.
Mr. Buening read the staff recommendation into the record as follows:

Bogun Resubdivision, located at 12965 Silver Fox Drive. Motion carried 5 -0.
(Mr. Gray did not vote.)
PUBLIC HEARING
A. Terken Builders Townhomes - Variance to waive front sidewalk requirements
along Brown Drive - 11861, 11863 and 11865 Brown Drive.
A motion was made by Ms. Murphy and seconded by Ms. Pearson to open the
Public Hearing.
Mr. Buening stated that the petitioner is requesting a waiver of the front sidewalk
requirements along Brown Drive. The petitioner would like a waiver of the
sidewalk requirements because of the site constraints on the property. They feel
that they cannot install a sidewalk within the right -of -way due to the fact that
