ORDINANCE NO. AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE ANNEXATION AGREEMENT FOR BIRCH PATH WHEREAS, on June 9, 2014, the Village of Lemont approved and passed Ordinance No. 0-36-14, an Ordinance Authorizing the Annexation Agreement for 6.5 Acres Located South of 127th Street and West of Interstate 355 in Lemont, IL (Birch Path) ("Agreement"); and WHEREAS, the Village, Developer and Legal Owners of record entered into an Annexation Agreement; and WHEREAS, the Village, Developer and Legal Owners of record desire to amend the Annexation Agreement by executing an Amendment to the Annexation Agreement for Birch Path, a copy of which is attached hereto as Exhibit A; and WHEREAS, pursuant to Section 11-15.1-3 of the Illinois Municipal Code 65 ILCS 5/11-15.1-3) the corporate authority of the Village held a public hearing on March 18, 2015 and reviewed the Birch Path PUD Final Plan/Plat and found the documents to be in substantial compliance with the approved PUD Preliminary Plan/Plat which include, in its entirety, the proposed amendments to the Agreement; and NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, State of Illinois, as follows: SECTION 1: The above recitals are hereby incorporated into this Ordinance as if set forth verbatim. SECTION 2: That the President be and is hereby authorized and directed, and the Village Clerk is directed to attest to a document known as Annexation Agreement Birch Path, where is hereby approved retroactively to June 9, 2014, to further enter into the Amendment to the Annexation Agreement for Birch Path substantially in the form attached as Exhibit A. SECTION 3: Prior to executing it, the Village President is authorized to make modifications to the form of the Amendment to the Annexation Agreement for Birch Path. SMOLLEN Village Clerk 2 EXHIBIT A ANNEXATION AGREEMENT AMENDMENT BIRCH PATH 3 ANNEXATION AGREEMENT A MENDMENT BIRCH PATH THIS AMENDMENT TO THE BIRCH PATH ANNEXATION AGREEMENT, is made and entered into this 11`h day of May, 2015, between the Village of Lemont, a municipal corporation of the Counties of Cook, DuPage and Will, in the State of Illinois (hereinafter referred to as "the VILLAGE"), and Lemont 19, LLC (hereinafter referred to as "OWNER") and Tempo Development Inc., an Illinois Corporation, the contract purchaser, (hereinafter referred to as "DEVELOPER"). The VILLAGE, OWNER and DEVELOPER are hereinafter sometimes referred to individually as a"PARTY"and collectively as the "PARTIES"; and WHEREAS, Lemont 19, LLC is the successor to the OWNER of the TERRITORY WHEREAS, OWNER are the owners of record of the real estate (hereinafter referred to as the "TERRITORY"), depicted and attached hereto as Exhibit A and by this reference made a part hereof; and WHEREAS, the TERRITORY was previously annexed and identified as the TERRITORY pursuant to a certain Annexation Agreement dated June 9, 2014, as Ordinance No. 0-36-14 (hereinafter referred to as "the AGREEMENT");and, WHEREAS, the OWNER AND DEVELOPER are desirous of amending said AGREEMENT regarding platting and design of the territory; and WHEREAS, pursuant to Section 11-15.1-3 of the Illinois Municipal Code 65 ILCS 5/11-15.1-3) the corporate authority of the Village held a public hearing on March 18, 2015 and reviewed the Birch Path PUD Final Plan/Plat and found the documents to be in substantial compliance with the approved PUD Preliminary Plan/Plat which include, in its entirety,the proposed amendments to the AGREEMENT; and NOW, THEREFORE, in consideration of the foregoing and of the mutual covenants hereinafter contained,the Parties agree as follows: SECTION 1: Incorporation of Recitals. The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION 2: Amendments. The AGREEMENT is hereby amended as follows: 1. The paragraph titled UDO Exceptions, on page 4, beginning on line 10 and ending on line 23 shall be replaced in its entirety with the following text: UDO Exceptions. Chapter 17.08 (Planned Unit Developments) of the Unified Development Ordinance makes provision for exceptions to the 1 requirements of the UDO in order to promote and allow innovation and flexibility of design in keeping with the public interest and welfare. It is understood that the subdivision will provide diversity to the existing housing stock and the residential design of the homes is a feature that is of public interest and welfare. As provided for in Chapter 17.08 (Planned Unit Developments) of the Unified Development Ordinance, the VILLAGE has deemed it appropriate to approve reduced lot sizes and setbacks as part of the Planned Unit Development for Birch Path, as indicated on Exhibit D 2.
