RESIDENCE DISTRICT TO VILLAGE OF LEMONY R-1 (RESIDENTIAL) AND
LEMONY B-3 (ARTERIAL COMMERCIAL) AND GRANTING A SPECIAL USE FOR
A CELL TOWER

WHEREAS, West Shore Pipe Line, hereinafter referred to as "the Petitioner," is the
owner of approximately 7.6 acres, hereinafter referred to as "the subject property," located at
12920 Bell Road in Lemont, Illinois and legally described in Exhibit "A" and depicted in Exhibit
"B"; and
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance of 1999 (Ordinance Number 0-25-99), for a Zoning Map Amendment from Cook
County R-3 Residence District to Village Of Lemont B-3 (Arterial Commercial) for Lot 1 and
Lemont R-1 (Residential) for Lot 2 and variations ;and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois
(the "Village") did heretofore commence and conduct a Public Hearing on March 20, 2007 for
approval of a Zoning Map amendment by a vote of 6-0 recommends approval to the Village
Board; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published in the Daily Southtown a newspaper of general circulation within the
Village; and
WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public
hearing as required by law, approved a Zoning Map Amendment; and
WHEREAS, the President and Board of Trustees of the Village of Lemont approved an
Annexation Agreement (Ordinance No. 0-113-07) and the annexation (Ordinance No. 0-114-
07) of the subject property, and the said Agreement specifies the re-zoning and the granting of a
special use for an existing 125-foot cell tower; and
WHEREAS, the President and Board of Trustees of the Village have determined that the
best interests of the Village will be served by approving the Zoning Map Amendment and
Special Use as described herein.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Lemont, that the subject property described above is hereby rezoned
from its present Cook County R-3 Single-Family Residence District to Village Of Lemont B-3
(Arterial Commercial) for Parcel 1 and Lemont R-1 (Residential) for Parcel 2. The zoning map
of the Village of Lemont is hereby amended in accordance with the provisions of this Ordinance;
and that a Special Use is granted for an existing 125-foot cell tower located on Parcel 1.

THE VILLAGE OF LEMONY, COUNTIES OF COOK, DuPAGE AND WILL,
ILLINOIS, on this 14t" day of January, 2008.
