O-30-08 06-09-2008VILLAGE OF LEMONY ORDINANCE NO. ~ ~~' AN ORDINANCE GRANTING PRELIMINARY PLAN/PLAT APPROVAL, SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND ZONING MAP AMENDMENT FOR AN ASSISTED LIVNG FACILITY LOCATED AT THE SOUTHEAST CORNER OF PARKER ROAD AND 131sT STREET (Paradise Park) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY THIS 9TH DAY OF JUNE, 2008 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 9TH DAY OF .TUNE, 2008 1 ORDINANCE NO. . ~© .®g" AN ORDINANCE GRANTING PRELIMINARY PLAN/PLAT APPROVAL, SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND ZONING MAP AMENDMENT FOR AN ASSISTED LIVNG FACILITY LOCATED AT THE SOUTHEAST CORNER OF PARKER ROAD AND 131sT STREET (Paradise Park) WHEREAS, Paradise Park Assisted Living -Lemont, LLC. hereinafter referred to as "the Petitioner," is the contract purchaser of the subject property covering approximately 12 acres located at the southeast corner of Parker Road and 131St Street and legally described in Exhibit A, attached hereto and incorporated herein, and shown on the Plat of Annexation, attached hereto and incorporated herein as Exhibit B; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for preliminary plan/plat approval, special use for a planned unit development and zoning map amendment from Cook County R-3 Single Family Residence District to Lemont R-5 Single-Family Attached Residential District and Special Use for an assisted living facility; and WHEREAS, the petitioner has submitted a PUD Preliminary Plan/Plat consisting of the following: 1. Preliminary Plat of Subdivision, titled "Final Plat of Subdivision, prepared by R.E. Allen and Associates, Ltd. with a revised date of OS-02-08 attached hereto and incorporated herein as Exhibit C; and 2. Tree Preservation Plan, prepared by JPS & Associates and Countryside Landscape Architects & Contractors, attached hereto and incorporated herein as Exhibit D; and 3. Preliminary Landscape Plan, prepared by JPS & Associates and Countryside Landscape Architects & Contractors ,attached hereto and incorporated herein as Exhibit E; and 4. Preliminary Engineering Plan, prepared by Seton Engineering with a revised date of 2/14/08, attached hereto and incorporated herein as Exhibit F; and 5. Architectural elevations, three sheets, prepared by JPS & Associates, attached hereto and incorporated herein as Exhibit G. WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with Lemont Zoning Ordinance, conducted a public hearing on the petition on 2 February 19 and March 18, 2008, and did not vote to recommend approval of the petitioner's request; and WHEREAS, the Village Board of Trustees, having reviewed the petitioner's application, Village staff recommendations, and the record of the public hearing, finds that: 1. The proposed land use is complementary to the existing nearby land uses and will fulfill a need within the community and adjacent areas; and 2. The proposed use fills a need that was not addressed in the 2002 Comprehensive Plan; and 3. The proposed architecture is consistent in exterior materials, height, bulk, and overall design with the surrounding homes; and 4. The proposed use will not be injurious to the public health, safety and welfare, and will not cause substantial injury to the value of other property in the neighborhood in which it is located; and 5. The proposed use and plan are consistent with the Lemont Zoning Ordinance standards for planned unit developments; and 6. Contribute to the orderly growth and development of the community. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that the PUD Preliminary Plan/Plat with zoning map amendment to R- SSingle-Family Attached Residential District with special use for an assisted living facility is approved with the following conditions: 1. Prior to site development, a PUD Final Plan/Plat shall be submitted to the Village and approved in accordance with the Lemont Unified Development Ordinance; and; 2. Said PUD Final Plan/Plat shall be in significant compliance with the approved PUD Preliminary Plan/Plat; and 3. All required contributions and fees as outlined in the Annexation Agreement shall be paid in full at time of submission of the PUD Final Plan/Plat; and 4. The Final Landscape Plan shall include provisions for landscaping at the adjacent property at 13455 Arctic Lane. This landscaping, when mature, shall be sufficient to screen the residence from headlights of vehicular traffic exiting the Paradise Park facility along 131St Street; 5. Landscaping shall be installed and maintained in accordance with the Final Landscape Plan; and 6. The landscaping along the northern and western perimeters of the subject property, as identified in the Final Landscape Plan, shall be installed and maintained in accordance with the "Prairie and Wetland Seeding" document, attached hereto and incorporated herein as Exhibit H.
