O-38-08 07-28-2008.,: VILLAGE OF LEMONY ORDINANCE NO. ~ _~~ - p,~'' AN ORDINANCE GRANTING FINAL PLAN/PLAT APPROVAL FOR A PLANNED UNIT DEVELOPMENT (PUD) AN ASSISTED LIVNG FACILITY LOCATED AT THE SOUTHEAST CORNER OF PARKER ROAD AND 131sT STREET (Paradise Park) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY THIS 28TH DAY OF JULY, 2008 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 28TH DAY OF JULY, 2008 ORDINANCE NO. ~-3$- obi AN ORDINANCE GRANTING FINAL PLAN/PLAT APPROVAL FOR A PLANNED UNIT DEVELOPMENT (PUD) AN ASSISTED LIVNG FACILITY LOCATED AT THE SOUTHEAST CORNER OF PARKER ROAD AND 131sT STREET (Paradise Park) WHEREAS, Paradise Park Assisted Living -Lemont, LLC. hereinafter referred to as "the Petitioner," is the owner of the subject property covering approximately 12 acres located at the southeast corner of Parker Road and 1315 Street and legally described in Exhibit A, attached hereto and incorporated herein; and WHEREAS, the Petitioner applied for preliminary plan/plat approval, special use for a planned unit development and zoning map amendment from Cook County R-3 Single Family Residence District to Lemont R-5 Single-Family Attached Residential District and Special Use for an assisted living facility; and WHEREAS said application, preliminary plans and plat were reviewed in accordance with the Lemont Unified Development Ordinance of 2008 and approved by the Village Board of Trustees on June 9, 2008; and WHEREAS, the petitioner has submitted a PUD Final Plan/Plat consisting of the following: 1. Final Plat of Subdivision, prepared by R.E. Allen and Associates, Ltd, attached hereto and incorporated herein as Exhibit B; and 2. Final Landscape Plan, three sheets, prepared by JPS & Associates and Countryside Landscape Architects & Contractors , with a date of 6-26-08 and a revision date of 7-02-08, attached hereto and incorporated herein as Exhibit C; and 3. Final Engineering Plan, prepared by Seton Engineering, signed and dated June 24, 2008, attached hereto and incorporated herein as Exhibit D; and 4. Architectural elevations, three sheets, prepared by JPS & Associates, dated 06-26- 08, attached hereto and incorporated herein as Exhibit E; and WHEREAS, the Village's Community Development Department and Planning & Zoning Commission have reviewed the PUD Final Plan/Plat and found the documents to be in substantial compliance with the approved PUD Preliminary Plan/Plat. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that the PUD Final Plan/Plat for an assisted living facility is approved with the following conditions: 2 1. All required contributions and fees. as outlined in the Annexation Agreement shall be paid in full prior to the issuance of any type of site development permit; and 2. Site development and buildings shall be in compliance with the Final Plan/Plat unless amended or revised in accordance with the Lemont Unified Development Ordinance of 2008. 3. The landscaping along the northern and western perimeters of the subject property, as identified in Exhibit F, attached hereto and incorporated herein, shall be installed and maintained in accordance with the "Prairie and Wetland Seeding" document, attached hereto and incorporated herein as Exhibit G; and 4. Landscaping shall be provided at the adjacent property at 13455 Arctic Lane. This landscaping, when mature, shall be sufficient to screen the residence from headlights of vehicular traffic exiting the Paradise Park facility along 131St Street; PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on this 28th day of July, 2008.
