VILLAGE OF LEMONT ORDINANCE NO. d _a `l - ©l AN ORDINANCE GRANTING PRELIMINARY PLAN/PLAT APPROVAL, SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD), SPECIAL USE FOR AN AUTO SUPPLY /AUTO ACCESSORY USE IN THE B -1 ZONING DISTRICT, AND ZONING MAP AMENDMENT TO THE B -1 ZONING DISTRICT FOR AN 11,427 SF COMMERCIAL DEVELOPMENT AT THE NORTHEAST CORNER OF 127TH STREET AND WALTER ST. (AutoZone) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 13th DAY OF APRIL, 2009 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 13TH DAY OF APRIL, 2009 1 ORDINANCE NO. AN ORDINANCE GRANTING PRELIMINARY PLAN/PLAT APPROVAL, SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD), SPECIAL USE FOR AN AUTO SUPPLY /AUTO ACCESSORY USE IN THE B -1 ZONING DISTRICT, AND ZONING MAP AMENDMENT TO THE B -1 ZONING DISTRICT FOR AN 11,427 SF COMMERCIAL DEVELOPMENT AT THE NORTHEAST CORNER OF 127T14 STREET AND WALTER ST. (AutoZone) WHEREAS, the Reding Company, LLC, hereinafter referred to as the "Petitioner," is the contract purchaser of the subject property covering approximately 1.84 acres located at the northeast corner of the intersection of 127th Street and Walter Street (PINS# 22 -29- 309 -004 and 22 -29- 309 -005) legally described in Exhibit A, attached hereto and incorporated herein, and shown on the Plat of Annexation, attached hereto and incorporated herein as Exhibit B; and WHEREAS, the Petitioner made application under the provisions of the Lemont Unified Development Ordinance for preliminary plan/plat approval, zoning map amendment from Cook County R -4 Single - Family Residence District to Lemont B -1 Office /Retail Transitional District, special use for an auto supply /auto accessory use in the B -1 zoning district, and special use for planned unit development consisting of an 11,427 sf retail commercial development; and WHEREAS, the petitioner has submitted a PUD Preliminary Plan/Plat consisting of the following: 1. the Site Plan, prepared by Vasconcelles Engineering Corporation and dated January 30, 2009, attached hereto and incorporated herein as Exhibit C; and 2. the Site Detail Sheet, prepared by Vasconcelles Engineering Corporation and dated June 16, 2008, attached hereto and incorporated herein as Exhibit D; and 3. the Drainage & Grading & Water & Sanitary Services, prepared by Vasconcelles Engineering Corporation and dated February 03, 2009, attached hereto and incorporated herein as Exhibit E; and 4. the Photometric Plan, dated January 30, 2009, attached hereto and incorporated herein as Exhibit F; and 5. the Landscape Plan, prepared by Engineering Associates, Inc. and dated January 15, 2009, attached hereto and incorporated herein as Exhibit G; and 2 6. the Sign Plan, consisting of three sheets: Monument Sign Plan, prepared by Sign Outlet, dated February 03, 2009; Wall Sign Plan, prepared by Sign Outlet, dated January 29, 2009; and AutoZone Wall Sign Plan, prepared by Phil Record, dated June 16, 2008, attached hereto and incorporated herein as Exhibit H; and 7. the color Architectural Elevations, prepared by AutoZone and dated March 15, 2009, attached hereto and incorporated herein as Exhibit I. WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with Lemont Unified Development Ordinance, conducted a public hearing on the petition on October 21, 2008, and did not vote to recommend approval of the petitioner's request; and WHEREAS, the Village Board of Trustees, having reviewed the petitioner's application, Village staff recommendations, and the record of the public hearing, finds that: 1. A retail commercial development at this location would be a convenience for the residents of Lemont. 2. The proposed development is designed, located, and proposed to be operated in such a way that is protects the public health, safety and welfare. 3. Since the proposed use is located on a minor arterial roadway in a generally developed area of Lemont, it is not expected to create excessive demands on Village services or impair the ability of the Village to maintain the peace and provide adequate protection for its citizens. 4. The proposed rezoning will provide a transition between the B -3 zoning east of the subject site and the residential zoning west of the subject property. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that the PUD Preliminary Plan/Plat with zoning map amendment to B -1 Office /Retail Transitional District with special use for planned unit development, and special use for an auto supply /auto accessory use is approved with the following conditions: 1. The Planned Unit Development Preliminary Plan/Plat approval, and the bulk exceptions granted therein, shall lapse in the event the petitioner does not file a complete application for a PUD final plan/plat within one year of the effective date of this ordinance. 2. In the event the petitioner does not file a complete application for a PUD final plan/plat within one year of the effective date of this ordinance, the zoning of the subject property shall revert to the R -1 Single - Family zoning district. 3 PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on this 13th day of April, 2009.
