O-29-09 04-13-2009VILLAGE OF LEMONY ORDINANCE NO. ®P o'L, - 0 AN ORDINANCE GRANTING PRELIMINARY PLAT APPROVAL AND ZONING MAP AMENDMENT FOR TWO PARCELS LOCATED AT 12622 AND 12640 DERBY ROAD, LEMONY, COOK COUNTY (Saddlebrook) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY THIS 13TH DAY OF APRIL, 2009 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 13TH DAY OF APRIL, 2009 ORDINANCE NO. ~-~~-n9 AN ORDINANCE GRANTING PRELIMINARY PLAT APPROVAL AND ZONING MAP AMENDMENT FOR TWO PARCELS LOCATED AT 12622 AND 12640 DERBY ROAD, LEMONY, COOK COUNTY (Saddlebrook) WHEREAS, BF Investment Group, LLC, hereinafter referred to as "the Petitioner," is the owner of the subject property consisting of two parcels covering approximately 5.98 acres, located at 12622 and 12640 Derby Road, Lemont, Cook County, and legally described in Exhibit A, attached; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for preliminary plat approval, and zoning map amendment to Lemont R-4 Single-Family Detached Residential District from Cook County R-3 Single Family Residence District; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with Lemont Zoning Ordinance, conducted a public hearing on the petition on September 18, 2007, and voted 6-0 with one member absent to not recommend approval of the petitioner's request; and WHEREAS, the Village Board of Trustees, having reviewed the petitioner's application and the record of the public hearing, finds that the proposed development will: 1. Contribute to the orderly growth and development of the community; and 2. Adhere to the provisions of the Lemont Zoning Ordinance; and 3. Provide single-family residential options of generally high quality to the residents and future residents of the Village; and 4. Result in residential densities consistent with the Village of Lemont Comprehensive Plan of 2002; and WHEREAS, the petitioner has submitted a Preliminary Plat, labeled "Final Plat of Subdivision", and prepared by Midwest Technical Consultants with a revised date of 11/02/07, attached hereto as Exhibit B; and WHEREAS, said Plat substantially conforms with the physical development policies and standards of the Village of Lemont and was previously approved as part of an annexation agreement between the Village and the petitioner; NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois: Section 1. The subject property, as described in Exhibit A, is hereby rezoned from Cook County R-3 to Lemont R-4 Single-Family Detached Residential District. Section 2. The Preliminary Plat (Exhibit B) is hereby approved with the following condition 2 that must be completed prior to approval of Final Plat: The Petitioner shall grant to the Village of Lemont, and/or obtain grants to the Village of Lemont, all necessary easements for the extension of sewer, water, street, or other utilities, including cable television, or for other improvements, subject to the provisions of the Unified Development Ordinance of 2008, as amended, which may serve not only the subject property, but other territory in the general area, if requested by the Village of Lemont in the future. Section 3. This ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
