AN ORDINANCE AMENDING ORDINANCE 0-02-08 FOR PROPERTY
GENERALLY LOCATED AT 12920 BELL ROAD
(West Shore Pipeline)
WHEREAS, West Shore Pipeline, hereinafter referred to as the "Petitioner", applied for
a special use for a cellular tower and a zoning map amendment for property generally located at
12920 Bell Road in Lemont, Illinois, (P.I.N.s 22-35-201-012 and 22-35-201-020) ,hereinafter
referred to as the "Subject Property" and legally described in Exhibit "A"; and,
WHEREAS, the Village Board of Trustees approved Ordinance 0-02-08 on January 14,
2008, granting to the Petitioner a special use for a cellular tower and a zoning map amendment
from Cook County R-3 Residence District to Village of Lemont B-3 Arterial Commercial
District for Lot lon the Final Subdivision Plat for West Shore Pipeline Subdivision, attached
hereto as Exhibit "B", and a zoning map amendment from Cook County R-3 Residence District
to Village of Lemont R-1 Single Family Detached Residential District for Lot 2 on the Final
Subdivision Plat for West Shore Pipeline; and,
WHEREAS, Ordinance 0-02-08 contained an error in the legal description describing
the Subject Property; and,
WHEREAS, subsequent to the adoption of Ordinance 0-02-08 and the recordation of
said Plat of Subdivision, Stonelake Survey Company Ltd., Surveyor for the Petitioner, recorded a
Certificate of Correction, recorded as Document # 0813744011 with the Cook County Recorder
of Deeds, which amended lot dimensions and lot areas on the Plat of Subdivision but not its legal
description, said certificate being attached hereto as Exhibit "C"; and,
WHEREAS, the President and Board of Trustees have determined that the best interests
of the Village will be served by amending Ordinance 0-02-08 so it more accurately reflects the
property subject to the zoning map amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONY, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
Section 1 Legal Description Amendment. An amendment to Ordinance 0-02-08 is
hereby granted, replacing the original legal description from Ordinance 0-02-08 with the legal
description attached hereto as Exhibit "A". Said legal description describes land depicted on
Exhibit "B", attached hereto.
Section 2 Certificate of Correction. The Certificate of Correction, attached hereto as
Exhibit "C", is recognized by the Village solely to the extent that it amends the lot dimensions
and lot areas depicted on Exhibit "B".
Section 3 Publication. This ordinance shall be in force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONY, COUNTIES OF COOK, WILL, AND DU PAGE,
ILLINOIS, on this 20t" day of April, 2009.
