AN ORDINANCE GRAI~ITING PRELI'VIINARY PLAN/PLAT APPROVAL, SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND ZONING NIAP AMENDMENT FOR 18.290 ACRES LOCATED NORTHWEST OF WALKER ROAD AND MAIN STREET (Windsor Courts) WHEREAS, Morgan Development is the Owner/Developer of the subject property covering 18.290 acres located at the northwest corner of Walker Road and Main Street and legally described and depicted on the Plat of Annexation, attached hereto and incorporated herein as Exhibit A; and WHEREAS, the Petitioner made application under the provisions of the Lemont Unified Development Ordinance for preliminary plan/plat approval, special use for a planned unit development and zoning map amendment from Cook County R-4 Single-Family Residence District to Lemont R-5 Single-Family Attached Residential District and Special Use for planned unit development consisting of not more than 196 units in two phases; and WHEREAS, the petitioner has submitted a PUD Preliminary Plan/Plat consisting of the following: 1. Site Plan, prepared by N. Batistich, Architects and dated April 15, 2008, attached hereto and incorporated herein as Exhibit B; and 2. Engineering Plans, prepared by Hoefferle-Butler Engineering, Inc., dated 06-06-08, attached hereto and incorporated herein as Exhibit C; and 3. Preliminary Landscape Plan, prepared by Lang F. Beiswanger, undated, attached hereto and incorporated herein as Exhibit D; and 4. The exteriors of buildings will be in compliance with the Proposed Street Elevations, prepared by N. Batistich, Architects, undated, attached hereto and incorporated herein as Exhibit E. WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with Lemont Unified Development Ordinance, conducted a public hearing and on January 2, 2007, and February 6, 2007, and voted to recommend approval of the petitioner's request; and WHEREAS, the Village Board of Trustees, having reviewed the petitioner's application, Village staff recommendations, and the record of the public hearing, finds that: 1. The development is so designed, located, and proposed to be operated that the public health, safety, and welfare will be protected. 2 2. The proposed land use is consistent with or complimentary to surrounding land uses and thus will not create substantial injury to the value of nearby properties. 3. The proposed development will be near recreational amenities, and will provide a road that will increase access to such amenities. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that the PUD Preliminary Plan/Plat with zoning map amendment to R-5 Single-Family Attached District with special use for planned unit development is approved with the following condition: 1. Prior to final plat approval the OwnerlDeveloper shall provide evidence of easement or right of way necessary for utility extension to the subject property. Such evidence shall be a title commitment from Chicago Title Insurance Company or any other licensed title company naming the Village of Lemont as party insured to guarantee an easement for public utilities from the existing point of connection to the development. 2. Final PUD Plan/Plat and development shall be in compliance with the terms of Section III, "Zoning and Land Use Restrictions" of the Windsor Courts Annexation Agreement. PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS, on this 22nd day of June, 2009.
