(Ashford Condos) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY THIS 22°d DAY OF JUNE, 2009 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 22ND DAY OF JUNE, 2009 ORDINANCE NO.~ ` ~% AN ORDINANCE GRANTING PRELIMINARY PLAN/PLAT APPROVAL, SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND ZONING MAP AMENDMENT FORA 56-UNIT, MULTI-FAMILY RESIDENTIAL DEVELOPMENT LOCATED AT THE INTERSECTION OF WALKER ROAD AND MAIN STREET. (Ashford Condos) WHEREAS, Marquette Bank as Trustee under Land Trust No. 16099 dated February 20, 2002, is the owner, and Eire Construction Company, an Illinois corporation, and Haven Development, Inc., an Illinois corporation, as beneficiaries under Land Trust No. 16099 dated February 20, 2002, are the developers of the subject property covering approximately 5.98 acres located at the intersection of Walker Road and Main Street and legally described in Exhibit A, attached hereto and incorporated herein, and shown on the Plat of Annexation, attached hereto and incorporated herein as Exhibit B; and WHEREAS, the Petitioner made application under the provisions of the Lemont Unified Development Ordinance for preliminary plan/plat approval, special use for a planned unit development and zoning map amendment from Cook County R-4 Single-Family Residence District to Lemont R-6 Multi-Family Residential District; and WHEREAS, the petitioner has submitted a PUD Preliminary PlanlPlat consisting of the following: 1. Site Plan, prepared by the Shalvis Group P.C. Architecture, dated February 20, 2008, attached hereto and incorporated herein as Exhibit C; 2. Preliminary Engineering Plan, prepared by DJA Civil Engineers and Surveyors, dated July 30, 2008, attached hereto and incorporated herein as Exhibit D; and 3. Architectural Elevations, prepared by the Shalvis Group P.C. Architecture, dated September 11, 2008, attached hereto and incorporated herein as Exhibit E; and 4. Landscape Plan prepared by Bret-Mar Landscape Inc., dated 8-08, attached hereto and incorporated herein as Exhibit F. WHEREAS, the Planning and Zoning Commission. of the Village of Lemont, Illinois, in accordance with Lemont Zoning Ordinance, conducted a public hearing on the petition on April 15 and May 20, 2008, and did not vote to recommend approval of the petitioner's request; and WHEREAS, the Village Board of Trustees, having reviewed the petitioner's application, Village staff recommendations, and the record of the public hearing, finds that: 2 1. The proposed development's density is consistent with policy of Village as verbally expressed by the mayor and trustees; 2. The proposed development will increase the number of dwelling units for a housing product. (condominium). that is not. prevalent in the. Village; 3. The proposed development will be near recreational amenities, and will provide a road that will increase access to such amenities. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that the PUD Preliminary Plan/Plat with zoning map amendment to R-6 Multi-Family Residential District with special use for a residential planned unit development is approved with the following conditions: 1. Prior to final plat approval the Owner/Developer shall provide evidence of easement or right of way necessary for utility extension to the subject property. Such evidence shall be a title commitment from Chicago Title Insurance Company or any other licensed title company naming the Village of Lemont as party insured to guarantee an easement for public utilities from the existing point of connection to the development. 2. Prior to final plat approval, the engineering plans shall be revised to: comply with the requirements of Articles Three and Six of the executed Annexation Agreement; include a water main extension along Main Street at least to the boundary of the floodway; show a 66 foot right of way for Walker Road; indicate the base flood elevation data for the full length of Covenant Creek in one foot intervals; include a temporary turnaround for Walker Road until such time as a railroad crossing is permitted.
