O-60-09 08-24-2009VILLAGE OF LEMONY ORDINANCE NO. °(~ ORDINANCE REQUIRING COMMONWEALTH EDISON TO PERFORM NON-STANDARD CONSTRUCTION WORK (Overhead lines at Talcott) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY THIS 24T" DAY OF AUGUST, 2009 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Cook, DuFage, and Will Counties, Illinois this 24th day of August, 2009 ORDINANCE REQUIRING COMMONWEALTH EDISON TO PERFORM NON-STANDARD CONSTRUCTION WORK (Overhead lines at Talcott) WHEREAS, under Rider Local Government Compliance Adjustment (LGC) as approved by the Illinois Commerce Commission, Commonwealth Edison is permitted to recover the cost of complying with non-standard requirements imposed by municipalities; and WHEREAS, the undergrounding of Commonwealth Edison's distribution lines located within the rights-of--way of Talcott , as shown on the Lemont "Overhead to Underground Sketch", prepared by Commonwealth Edison attached hereto as Exhibit 1 and made a part hereof, is anon-standard municipal requirement; and WHEREAS, the corporate authorities of the Village desire to require Commonwealth Edison to place its existing distribution wires underground within the rights-of- way as shown on the "Overhead to Underground Sketch"; provided, however, that Commonwealth Edison recover the cost of placing the wires underground in the following manner: the cost of the underground wiring identified on the "Overhead to Underground Sketch" shall be recovered by Commonwealth Edison under Rider LGC; and WHEREAS, the specific Commonwealth Edison distribution wires which are to be placed underground are depicted in the "Overhead to Underground Sketch"; NOW, THEREFORE, BE IT ORDAINED by the corporate authorities of the Village of Lemont, Cook, Will and DuPage Counties, Illinois, as follows: SECTION ONE: The recitals set forth hereinabove shall be and are hereby adopted as findings as if said recitals were fully set forth within this Section One. SECTION TWO: Commonwealth Edison shall be and is hereby required to place underground all of its distribution wires, located within the rights-of--way, which are not already below ground, as shown on the "Overhead to Underground Sketch"; SECTION THREE: The Mayor and Board of Trustees hereby approve the Customer work Agreements attached hereto as Exhibit 2 and made a part hereof, and the Mayor shall be and is hereby authorized and directed to execute said Customer Work Agreements in substantially the form attached hereto. SECTION FOUR: Any policy, resolution or ordinance of the Village which conflicts with the provisions of this ordinance shall, to the extent of such conflict, be repealed. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. GomEd to furnish, install, own and maintain two {2) 4-bay switchgear compartment & foundation at Location 5, 11; install transformers and foundations at locations 3, 9 & 14; service pedestals; and place primary underground cables in conduit as shown on the attached sketch. Trench or pits wil! be backfilled with the excavated earth. Sidewalk, asphalt, other pavements repair/replacement and landscaping are not included in the scope of work. 6. ComEd to furnish standard lugs and connect customer underground electric service cables at the pedestals andlor transformers. 7. Village of Lemont to provide a utility easement for 4-bay switchgear compartments and transformers that will provide continuous access and 8'-0" minimum clearance from doors. Recorded plat should be submitted to ComEd four (4) weeks prior to the start of construction. 8. Village of Lemont to furnish, own install and maintain vehicular barriers at Location 17. Barriers must be installed prior to livening new underground equipment. ComEd standard C5295 is a#tached. 9. Village of Lemont to furnish, own install and maintain all secondary underground service cables to pedestal or transformer.. ComEd will identify the connection points. ViNage of Lemont will place cable underground in conduit, terminating 18' from connection point and leave excess coiled. Village of Lemont will determine the exact secondary cable route. 10. ComEd to obtain all necessary Municipal and/or State permits for its own construction work.
