ORDINANCE NO. ORDINANCE APPROVING A SPECIAL USE FOR AGRICULTURE AT THE SOUTHEAST CORNER OF THE INTERSECTION OF 127TH STREET AND ROLLING MEADOWS DRIVE IN LEMONY, IL (Rolling Meadows Special Use) WHEREAS, Jurinek and Riskus, Inc., hereinafter referred to as the "Petitioner," is the owner of the subject property covering approximately 8.3 acres located at the southeast corner of the intersection of 127t" Street and Rolling Meadows Drive (PINs# 22-31-101-009 and 010); and WHEREAS, the Petitioner is seeking a special use to allow agriculture on the subject property, which is zoned B-3; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on August I9, 2009 for approval of the special use; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and was published in the Southtown Star, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village has reviewed the matter herein and has determined that the same is in the best interest of the Village of Lemont, and herein adopts the finding of facts as set forth in Exhibit "A". NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS:. SECTION 1: Special Use Approval. A special use is granted to allow agriculture on the subject property. SECTION 2: Conditions of Approval. The above special use shall be approved subject to the following conditions: 1. Livestock operations shall not be allowed; and 2. The special use approval shall be re-evaluated by Village staff every two years to determine whether the use remains compatible with the surrounding area. If found to be compatible, the special use approval will be extended an additional two years. If found to be incompatible, the special use approval shall expire. In evaluating the special use approval, staff shall consider the construction of additional residences near the subject site, any registered complaints about the special use operation, and efforts of the applicant to resolve any instances of incompatibility between the farming operations and nearby residential uses; and 3. No outdoor storage or overnight storage is allowed; and 4. All farm equipment shall be limited to one point of access to the subject property. SECTION 3: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication provided by law. PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONY, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on this 28th day of September, 2009. The special use includes adequate safeguards to ensure long-term compatibility of the proposed farming operations with nearby residential uses. 2. The special use is temporary in nature, and will not have long-term cansequences on the value of surrounding property. 3. The proposed special use will not create an excessive demand for Village services, since few people will be involved in the operations and minimal traffic will be generated.
