A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS
AT WOODGLEN SUBDIVISION, PHASE ONE
WHEREAS, pursuant to the Lemont Unified Development Ordinance, an owner or
developer of a subdivision is required to deposit certain security or evidence thereof with the
Village of Lemont to guarantee the installation of public improvements; and
WHEREAS, in the matter of Woodglen Subdivision, Phase One, owned and developed
by Woodglen Development, LLC, located generally south of Schultz Street and west of First
Street in the Village of Lemont, a Standby Letter of Credit No. SBY/07/30382 issued by First
American Bank in the amount of $2,719,828.78 was deposited with the Village of Lemont to
guarantee completion of public improvements in said subdivision; and
WHEREAS, the President and the Board of Trustees of the Village of Lemont
subsequently reduced said letter of credit per Resolutions R -70 -07 and R -67 -08 to $510,829.00;
and
WHEREAS, Don Stevens of Woodglen Development, LLC, requested acceptance of
Woodglen Subdivision, Phase One and provided a Bill of Sale for the public improvements
(attached hereto as Exhibit A) and established an escrow account of $51,500 to cover the cost of
construction of a pedestrian bridge and path and /or First Street improvements; and
WHEREAS, a map of Woodglen indicating the subdivision's two phases is attached
hereto as Exhibit B; and
WHEREAS, authorized engineer of the Village of Lemont, James Cainkar, inspected
certain portions of the improvements and recommends acceptance of said subdivision's Phase
One and the initiation of the two -year subdivision maintenance period;
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, that the public improvements at Woodglen Subdivision Phase One are
hereby accepted and that the Letter of Credit No. SBY/07/30382 is hereby released with the
following conditions:
1. A letter of credit in the amount of $112,796.75 is submitted to the Village of
Lemont to guarantee completion of public improvements in Phase Two of the Woodglen
Subdivision; and
2. A letter of credit or other financial guarantee in the amount of $189,205.48 is
submitted to the Village to cover the required two -year maintenance period for Phase One.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE,
ILLINOIS, on this 23`d day of January, 2012.

BILL OF SALE
KNOW ALL MEN BY THESE PRESENTS, that Donald A. Stevens, on behalf of Woodglen
Development, LLC, an Illinois Liability Company (hereafter referred to as the "Developer ") in
consideration, does hereby grant, sell, transfer and deliver unto the VILLAGE OF LEMONT, an
Illinois municipal corporation, the following goods, chattels and other items of personal property in
connection with the Woodglen Subdivision Phase 1 namely:
All public improvements located within the Woodglen Subdivision Phase 1 located generally
south of Schultz Street, on the west side of First Street, Village of Lemont, such public improvements
including but not limited to all sanitary sewer and water lines, all storm sewer lines, all streets and street
improvements, all curbing, all sidewalks, all streetlights, signs and parkway trees.
The object of this Bill of Sale is to grant, sell, transfer and deliver to the Village the .
ownership of all items of personalty that comprise the sanitary sewer, water distribution system and
street system installed by the Developer to date within the Woodglen Subdivision Phase 1 located south
of Schultz Street, on the west side of First Street.
FURTHER BE IT KNOWN: That Developer does hereby covenant that it is the lawful owner of
the aforedescribed goods, chattel and personalty; that such items are free from all encumbrances; that
it has the right to sell the same as aforesaid; and that it warrants and will defend the act of said
corporation.
