ORDINANCE NO. , -/3 An Ordinance Amending Title 1 of the Lemont, Illinois Municipal Code Relating to Returned Checks WHEREAS, the Village of Lemont ( "Village ") is an Illinois Municipal Corporation pursuant to the Illinois Constitution of 1970 and the Statutes of the State of Illinois; and WHEREAS, the Village President and Board of Trustees desire to amend the Village Code of the Village of Lemont relating to returned checks; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, DUPAGE AND WILL COUNTIES, ILLINOIS, as follows: SECTION l: The Lemont, Illinois Municipal Code ( "Village Code "), as amended, is hereby further amended in Title 1, GENERAL PROVISIONS, by adding section 1.18 as follows: 1.16.010. — Returned checks. Any person who pays any bill, fine, charge or fee of the village with any check or draft which is subsequently returned unpaid to the village because of insufficient funds or because of a stop order on such check or draft, shall be liable to the village the greater of the bank charge incurred by the village, plus the administration costs of collecting the money, or twenty -five dollars ($25.00), for each and every check so returned. Such service charges shall be paid within seven (7) days of notification, in cash, money order, certified check or credit card before the bill, fine, charge or fee, for which such check was rendered, shall be considered paid. If said service charge is not paid, the check will be sent for collection, and the maker of the check or draft will incur all costs involved with the process, or twenty -five dollars ($25.00), whichever is greater. Should two (2) such checks or drafts be returned within a one -year period, no further payments shall be accepted from such person except in the form of cash, certified check, cashier's check, money order or credit card for a period of three (3) months from the date of the return of the second check or draft. SECTION 2: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
