VILLAGE OF LEMONT RESOLUTION NO. 3S/ _ DATE OF APPROVAL /(� 3X15 RESOLUTION APPROVING PRELIMINARY PLAT OF SUBDIVISION FOR OAK TREE SUBDIVISION WHEREAS, the petitioner is the owner of certain property consisting of approximately 20 acres legally described in Exhibit "A ", which is attached hereto and made a part hereof; and WHEREAS, the petitioner has prepared a Preliminary Plat of Subdivision known as Oak Tree Subdivision, which is attached hereto and made a part hereof; and WHEREAS, the Lemont Planning & Zoning Commission at its meeting of September 19, 1995, reviewed the preliminary plat and submitted its recommendations as required by Village of Lemont ordinance; and WHEREAS, the Lemont Planning & Zoning Commission recommended denial of said plat; and WHEREAS, the recommendation of the Plan Commission is made a part hereof and attached hereto as Exhibit B . NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees that the Preliminary Plat Oak Tree Subdivision, which is attached hereto and made a part hereof, is hereby approved in accordance with the Planning & Zoning Commission recommendation noted above. Stapleton October 10, 1995 Re: Request for Annexation, Zoning Map Amendment, Preliminary Plat Revision, and relief from the public sidewalk requirement along Archer Avenue for Oak Tree Subdivision Dear Mayor Kwasneski & Village Board of Trustees: Subsequent to the referral of the above - referenced petition by the Village Board of Trustees, the Planning & Zoning Commission conducted a Public Hearing on the proposed project on September 19, 1995. The Commissioners heard testimony from the petitioner's attorney, Michael Malicki. No members of the public came forward to testify either for or against the proposed project. Upon closure of the Public Hearing, the Commission took the matter under advisement and scheduled a workshop discussion for October 3, 1995. The petitioner has made the requested 4 changes: 1) Elimination of stub street. 2) Waiver of sidewalk along Archer Avenue. 3) Changes in dimensions to Lots 9, 10, 11, making them wider by eliminating the stub R.O.W. This also changes the dimension of the detention area. 4) Single family houses only. At the workshop, the Commission voted to deny, 6 -0, the petitioner's requests as submitted. However, the Commission made it very clear to the petitioner that the Commission would recommend approval to the Mayor and Village Board if the original plat was submitted (with the street stub and original lot and detention dimensions). Furthermore, the Commission would grant the waiver of the sidewalk along Archer if two criteria were met: 1) A cash donation to the Village in the amount of $25,000 to be used on sidewalk anywhere in the Village that may be more currently needed. 2) That the interior sidewalk of Oak Tree be continuous from lots 20 - 40, including both sides of Holly Court. (See sketch attached). Note: The developer agreed to put sidewalk on both sides of Holly Court, even though it was not originally required, in exchange for the waiver consideration. This was in addition to the $25,000 cash donation. Please do not hesitate to contact me or any of the other Commissioners should you wish to discuss our recommendation further.
