DATE OF APPROVAL /./-/ 3 - -- c5 RESOLUTION APPROVING PRELIMINARY PLAT OF SUBDIVISION FOR ABBEY OAKS SUBDIVISION UNIT III AND IV WHEREAS, the petitioner is the owner of certain property consisting of approximately 20 acres legally described in Exhibit "A ", which is attached hereto and made a part hereof; and WHEREAS, the petitioner has prepared a Preliminary Plat of Subdivision known as Abbey Oaks Subdivision Units III and IV, which is attached hereto and made a part hereof; and WHEREAS, the Lemont Planning & Zoning Commission at its meeting of August 1, 1995, reviewed the preliminary plat and submitted its recommendations as required by Village of Lemont ordinance; and WHEREAS, the Lemont Planning & Zoning Commission recommended approval of said plat, attached hereto as Exhibit "B "; and WHEREAS, the President and Board of Trustees of the Village of Lemont have determined the proposed Preliminary Plat of Subdivision to be in the best interest of the Village of Lemont. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees that the Preliminary Plat for Abbey Oaks Subdivision Unit III and IV, which is attached hereto and made a part hereof, is hereby approved. The Commission also considered the petition at its subsequent meetings of August 8th and August 15th. The Commissioners heard testimony from Village Planner Tim Teddy, petitioner's attorney John Griffin, and three members of the public, including two who spoke in support of the petition. The findings of the majority of the Commission were that the proposed rezoning and preliminary plat are in general conformance with the Village's Comprehensive Plan and development policies and consistent with development trends in the area. The basis for the dissenting vote on this matter was that the intent of the original approved Planned Development, which was to allow for the development of 53 acres and the protection and distinctive adaptive re -use for at least.a portion of the remaining 20 -acre seminary site, had not been met. $79 - 2 - Accordingly, by a vote of 3 - 1, the Planning & Zoning Commission recommends amendment of the existing Planned Unit Development (Ordinance 774) to permit the rezoning from R -1 PUD (minimum 3 -acre lots) to R -4 PUD (minimum 10,000 s.f. lots) and preliminary plat of subdivision for a two - phase, 49 -lot development with no exceptions or variations based on the following: 1. Development shall occur in phases according to the plan. 2. Demolition of the existing buildings shall be permitted after preliminary plan approval. 3. The ornamental fence installed for Phases I & II shall be installed along the 127th Street frontage and no additional rear yard fences shall be permitted. 4. Lots 111 and 113 shall be adjusted to provide a minimum 80' width at the building line on all lots. 5. Public improvements, designs and locations shall be as approved by the Village Engineer. 6. If the Village Board adopts an Environmental Checklist procedure, the owner shall be required to file the same prior to any development.
