RESOLUTION 39-'6) RESOLUTION AUTHORIZING ADOPTION OF SUPPLEMENT NO. 1 TO AN ENGINEERING AGREEMENT WITH BEAM, LONGEST AND NEFF FOR PHASE II DESIGN ENGINEERING ON MAIN STREET (ILLINOIS TO STATE STREET OVERPASS) WHEREAS, the Village of Lemont has committed resources to perform a Phase II design study for a section of Main Street; and WHEREAS, the Village of Lemont has selected BEAM, LONGEST AND NEFF to perform design engineering on this project; and WHEREAS, the Village has received FAU funding on the construction fo this project; and WHEREAS, the Village has expanded the scope of services on this project requiring additional engineering services. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees that the attached Supplement No. 1 to the Engineering Agreement be approved. CHARLENE SMOLLEN, Village Clerk SNESKI, Village President Route: Main Street (FAU 3587) Project No.: STPM- 7003(65) Section No.: 93- 00020 -00 -PV Job No.: D- 91- 516 -93 Cook County, Illinois SUPPLEMENT NO. 1 TO THE AGREEMENT FOR CONSULTANTS SERVICES WHEREAS, The VILLAGE OF LEMONT, the VILLAGE has entered into an AGREEMENT with BEAM, LONGEST AND NEFF, INC., the CONSULTANT, dated January 23, 1995 and authorized by the Illinois Department of Transportation, the DEPARTMENT, on June 2, 1995 to perform Phase II preliminary engineering services for the PROJECT, and, WHEREAS, the VILLAGE in compliance with the Illinois Environmental Protection Agency under the Authority of the United States Environmental Protection Agency through the National Pollutant Discharge Elimination System Permit Program shall take action to provide separately sewer storm and sanitary collection systems on new construction projects; and, WHEREAS, the construction of such a system on this project would comply with Ordinance No. 879 and would reduce the loading on the VILLAGES sewage treatment system and reduce the total loading of pollutants entering the Illinois - Michigan Canal due to combined sewer overflows; and, WHEREAS, the practicality of providing a separately sewered system was not considered feasible during the previously performed Phase I studies due to the lack of a suitable outfall into the Illinois- Michigan Canal and the extreme cost involved in the construction of a new outfall to the canal; and, WHEREAS, new information has become available regarding an existing suitable outfall location not previously known; and, WHEREAS, the DEPARTMENT and VILLAGE desire that the CONSULTANT perform Phase II design engineering for the rehabilitation of this existing outfall and the separation of the combined sanitary sewer /storm sewer within the project limits; said studies constitute extra work and include: • Field reconnaissance, inspection and survey of existing outfall condition and structural adequacy. • Development of outfall repair plans, specifications, bidding documents and estimates. • Development of an additional sewer plan, profile grade quantities, pay items and cost estimates in conjunction with the separate storm sewer system tying into outfall. and, USER3\MARKET \ AGREE \BLN- 03.DOC 1 Route: Main Street (FAU 3587) Project No.: STPM- 7003(65) Section No.: 93- 00020 -00 -PV Job No.: D- 91- 516 -93 Cook County, Illinois WHEREAS, the DEPARTMENT and VILLAGE also desire that the CONSULTANT perform additional work to prepare Right -of -way Plats and Legal descriptions for temporary easements necessary in conjunction with the abandonment of the vaulted sidewalks at two locations; and, WHEREAS, said Extra Work requires an increase in the upper limit of compensation to the CONSULTANT, which were not identified in the AGREEMENT and could not have been reasonably anticipated; and, WHEREAS, the circumstances which necessitate this Supplement were not within the contemplation of the agreement as signed; and, WHEREAS, said work requires an increase in the upper limit of compensation; NOW, THEREFORE, BE IT RESOLVED THAT the parties hereto do mutually agree as follows: A. Scope of Work The CONSULTANT shall provide the following Extra Work: • Perform additional data collection, field survey and inspections of existing 72" limestone outfall tunnel located in the vicinity of Lemont Street. • Perform storm sewer sizing calculation for separated roadway storm sewer system connection to outfall tunnel, analyze utility conflicts and coordinate with various agencies. Prepare plan drawings for separate sewer systems. • Prepare detail plans, specification and cost estimate for the repair and rehabilitation of the 72" limestone outfall tunnel. • Preparation of 2 plats and legal descriptions and necessary documentation for temporary easements in conjunction with the abandonment of vaulted sidewalk. Prime Compensation P.03 Route: Main Street (FAD 3587) Project No.: STPM- 7003(65) Section No.: 93- 00020-00 -PV Job No.: D-91- 516 -93 Cook County, Illinois In accordance with Sections 4.2 and 4.3 of the AGREEMENT, the Prime Compensation shall be increased as follows: Subject to an Upper Limit of Compensation of 528,385, the CONSULTANT shall receive as full payment for completing the work required under this SUPPLEMENT NO. 1, reimbursement of his eligible actual casts in accordance with Section 2.45 of the STANDARD PROVISIONS, plus a Net Fee of 53,534. The upper limit of compensation and net fee are a result of Exhibits A, 13, C, D and Exhibit E, the Cost Estimate of Consultant Services, all attached herein. With the addition of this SUPPLEMENT NO. 1 to the AGREEMENT, the Prime Compensation for the Phase 11 Engineering increases from S89,964 to an Upper Limit of Compensation of $1 18,349. The Drug Free Workplace Act, effective January 1, 1992, requires that no grantee or contractor shall receive a grant or be considered for the purposes of being awarded a contract for the procurement of any property or services from the State anless that grantee or contractor has certified to the State that the grantee or contractor will provide a drug free workplace. False certification or violation of the certification may result in sanctions including, but not limited to, suspension of contract or grant payments, termination of the contract or grant and debarment of contracting or grant opportunities with the State for at least one (1) year, but not to be more than five (5) years. For the purpose of this certification, "grantee" or "contractor" means a corporation, partnership, or other entity with twenty -five (25) or more employees at the time of issuing the grant, or a department, division, or other entity with twenty-five (25) or more employees at the time of issuing the responsible for the specific performance under a contract or grant of $5,000 or more from the State.
