RESOLUTION ACCEPTING GRANT OF EASEMENT
(GLUSZEK PROPERTY)
WHEREAS, the Village of Lemont has received a Grant of Easement, attached as
Exhibit "A ", for property owned by ELMHURST NATIONAL BANK, n /k/a OLD KENT BANK,
as Trustee, under Trust Agreement dated March 3, 1959, and known as Trust 1192, which
is legally described as follows:
A PARCEL OF PROPERTY LYING 20.00 FEET TO THE RIGHT OF THE FOLLOWING
DESCRIBED LINE: BEGINNING AT A POINT THAT IS 505.00 FEET WEST OF THE EAST LINE
OF THE SOUTHWEST 1/4 OF SECTION 21, TOWNSHIP 37 NORTH, RANGE 11 EAST OF THE
THIRD PRINCIPAL MERIDIAN AND 340.00 FEET SOUTH OF THE NORTH LINE OF SAID
SOUTHWEST 1/4; THENCE WEST ALONG SAID LINE BEING 340.00 FEET SOUTH OF THE
NORTH LINE OF THE SOUTHWEST 1/4 301.83 FEET; THENCE NORTHWESTERLY TO A
POINT IN THE SOUTHERLY LINE OF MAIN STREET THAT IS PERPENDICULAR TO THE
SOUTHERLY LINE OF MAIN STREET AND PASSES THROUGH A POINT THAT IS 340.00 FEET
SOUTH OF THE NORTH LINE OF SAID SOUTHWEST 1/4 AND 806.83 FEET WEST OF THE
EAST LINE OF SAID SOUTHWEST 1/4, ALL IN COOK COUNTY, ILLINOIS.
WHEREAS, said Grant of Easement shall allow the Village of Lemont to authorize the
installation, construction and maintenance of water, sanitary sewer, and storm drainage
facilities as may be necessary.
NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont that the Grant of Easement attached hereto be hereby approved.

GLUSZEK EASEMENT GRANT
THIS GRANT OF EASEMENT, made this 20th day of November, 1995, from
ELMHURST NATIONAL BANK, n /k /a OLD KENT BANK, as Trustee, under Trust
Agreement dated March 3, 1959, and known as Trust No. 1192, (hereinafter called the
"GRANTOR "), to the VILLAGE OF LEMONT, a Municipal Corporation organized and
existing under the laws of the State of Illinois (hereinafter termed the "VILLAGE "), 418
Main Street, Lemont, Illinois 60439.
WITNESSETH
WHEREAS, the VILLAGE has requested a public utility easement under certain
property that is owned by the GRANTOR; and
WHEREAS, the GRANTOR is willing to grant said perpetual easement, right,
privilege, and authority to the VILLAGE, upon the terms and conditions herein set forth;
NOW, THEREFORE, in consideration of the mutual benefit of the parties, the
GRANTOR does hereby bargain, sell, transfer and convey to its successors and assigns,
the perpetual easement, right, permission, and authority to construct, reconstruct, repair,
replace, operate, and maintain public utilities under and through the following property
legally described as:
A parcel of property lying 20.00 feet to the right of the following described
line: Beginning at a point that is 505.00 feet West of the East line of the
Southwest 1/4 of Section 21, Township 37 North, Range 11 East of the Third
Principal Meridian and 340.00 feet South of the North line of said Southwest
1/4; thence West along said line being 340.00 feet South of the North line of
the Southwest 1/4 301.83 feet; thence Northwesterly to a point in the
Southerly line of Main Street that is perpendicular to the Southerly line of
Main Street and passes through a point that is 340.00 feet South of the North
line of said Southwest 1/4 and 806.83 feet West of the East line of said
Southwest 1/4, all in Cook County, Illinois.

IN CONSIDERATION of the grant of the perpetual easement, right, privilege, and
authority herein contained, this Easement Grant is subject to the following conditions:
FIRST: The Preambles set forth above are hereby incorporated into and made a
part of this Grant of Easement.
SECOND: The rights and obligations of the GRANTOR and the VILLAGE
respectively hereunder shall inure to the benefit of and be binding upon their respective
successors and assigns, and all terms, conditions and covenants herein shall be construed
as covenants, running with the land.
THIRD: The term GRANTOR, as provided for in this Easement Grant shall be
deemed to be ELMHURST NATIONAL BANK, n /k /a OLD KENT BANK, as Trustee,
under Trust Agreement dated March 3, 1995, and known as Trust No. 1192.
FOURTH: Any manholes installed on the subject property shall be at the proposed
grade as approved by Cook County Department of Building and Zoning which is
approximately the same as the grade immediately to the West of the subject property.
FIFT1* During construction or maintenance, access shall be maintained to allow
an existing roadway to the South of the subject property to remain open so as to not disrupt
the business operation of the GRANTOR.
SIXTH: No recapture fee shall be levied by the VILLAGE nor shall it enter into
any Recapture Ordinance that will require the GRANTOR or its successors in interest to
pay a recapture fee in connection with sewer or water to the subject property.
SEVENTH: The sanitary sewer line extended along Main Street shall connect to
the MWRD Interceptor Drop to the West and shall be an eight (8) inch line with sufficient C%
capacity to accommodate approximately 115 single family homes for possible construction V''
on GRANTOR'S 55 acres.
EIGHTH: No additional easements will be required by the GRANTOR for the
development of the Hirsekom Ridge Estates Subdivision.
IN WITNESS WHEREOF, the GRANTOR and the VILLAGE have executed this
instrument consisting of 3 pages, in quintuplicate, and have hereunto set their hands and
seals on the day and date first written above, hereby releasing and waiving all rights under
and by virtue of the Homestead Exemption Laws of the State of Illinois.
