RESOLUTION APPROVING PRELIMINARY PLAT OF SUBDIVISION
FOR STONE CREEK SUBDIVISION
WHEREAS, the petitioner is the owner of certain property
consisting of approximately 5 acres legally described in Exhibit
"A ", which is attached hereto and made a part hereof; and
WHEREAS, the petitioner has prepared a Preliminary Plat of
Subdivision known as Stone Creek Subdivision, which is attached
hereto and made a part hereof; and
WHEREAS, the Lemont Planning & Zoning Commission at its
meeting of December 5, 1995, reviewed the preliminary plat and
submitted its recommendations as required by Village of Lemont
ordinance; and
WHEREAS, the Lemont Planning & Zoning Commission recommended
approval of said plat; and
WHEREAS, the recommendation of the Planning and Zoning
Commission is made a part hereof and attached hereto as Exhibit
"B".
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees that the Preliminary Plat of Stone Creek Subdivision,
which is attached hereto and made a part hereof, is hereby approved
in accordance with the conditions of approval, attached hereto as
Exhibit "C ".

RE: Case No. 95.13 - Request by J.B. Properties for approval of an
Eight (8) Lot Preliminary Plat of Subdivision and Three (3)
Variations from the Subdivision Ordinance Requirements (Stone
Creek)
Dear. Mayor Kwasneski and Village Trustees:
The Planning and Zoning Commission conducted a public hearing on
the above noted case on December 5, 1995. The petitioners
requested approval of a preliminary plat of subdivision for eight
(8) single family lots. The petitioner also requested three (3)
variances from the Subdivision Ordinance relating to right -of -way
width, pavement width and sidewalks along the northern access point
to the site. The site is currently zoned R -4 Single Family
Residence District, and would be a permitted use.
The Commission heard testimony by the Village Planner, the
petitioner and concerned citizens. Only one person spoke regarding
the petition, and she was concerned about how the development would
affect on- street parking on Czacki Street and school bus
circulation in the area. No other objections to the project were
stated.
The Planning and Zoning Commission, by unanimous vote, recommends
that the Board of Trustees approve of the requested subdivision and
three (3) variances from the Subdivision Ordinance. The Commission
feels that this proposal would be the highest and best use for the
site considering the unique topography and surrounding uses. While
the open space designation for this land on the Comprehensive Plan
is still desirable, the Park District has not made any offers to
purchase the land for open space purposes. Therefore, the next best
use for the land would be single family residential.

EXHIBIT "C"
CONDITIONS OF APPROVAL
1. The development shall substantially conform to the proposed
Lot Layout Plan, by Hoefferle- Butler Engineering, Inc., last
revised 11/28/95, except as such plans may be changed to
conform to Village Codes and Ordinances and the conditions
below.
2. An easement or right -of -way dedication is required along the
school district property. This easement or right -of -way needs
to be at least 19 feet wide to maintain a right -of -way of at
least 35 feet.
3. The proposed sidewalk along Division Street (extended) shall
be located along the north side of the street pavement.
4. A Plat of Vacation shall be submitted upon final plat approval
for the unimproved 30 foot wide Stephen Street to the west of
the property. The east 15 feet of Stephen Street shall be
included in the final plat of resubdivision.
5. Grading and tree preservation plans shall be submitted for
each lot at the time of application for building permit. All
requirements of the Tree Preservation Ordinance No. 789 shall
be complied with during construction to minimize grading and
to maximize tree preservation on each site.
6. Final engineering plans and specifications, including grading
requirements for public improvements, shall be reviewed and
approved by the Village Engineer prior to recording of the
plat.
7. The cul -de -sac along Division Street shall be relocated 16
feet to the east to utilize the existing alley right -of -way.
The remaining alley shall intersect with the cul -de -sac at a
right angle, with a concrete or asphalt apron.
8. A hydrant shall be installed on either side of the Division
Street water main to allow flushing same. These revisions
shall be made to the final engineering plans prior to approval
of the final plat.
9. Any utility easements proposed shall be indicated on the final
plat.
10. The curbing along the northern (Division) street should be
extended along the entire street length. The school entrances
should be driveways separated by the street curbing.
11. The no parking sign along the west side of Czacki Street shall
be reviewed and the location shall be approved by the Village.
12. A contribution will be required to allow sewer separation
elsewhere in the Village since this project will connect to a
combined sewer in the amount of $10,000.
13. A minimum setback /conservation easement shall be established
along both sides of the stone walled creek on the final plat.
This easement shall also allow for ingress, egress and
maintenance for the creek by the Village. The easement should
be a minimum of 30 -40 feet wide centered on the creek
centerline. No buildings or encroachments may be constructed
in this area except for a private bridge to access the
northern portions of Lots 5 and 6.
14. The actual locations of the homes should be indicated on Lots
5 and 6.
15. The plans shall be revised to either incorporate on -site
detention for the property, or to connect the southern part of
the subdivision into an existing storm sewer located along
Logan Street. If the storm sewer does not have adequate
capacity to service the development, on -site detention shall
be required.
