RESOLUTION AUTHORIZING ADOPTION OF A LETTER OF UNDERSTANDING
WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION
REGARDING INSTALLATION OF A SIDEWALK/BIKEPATH
ON THE ROUTE 83 BRIDGE
WHEREAS, The Illinois Department of Transportation has committed to
reconstruct the bridge and roadway on Route 83; and
WHEREAS, The Village of Lemont has requested construction of a sidewalk
/ bikepath along Route 83; and
WHEREAS, The Village has agreed to maintenance responsibility of the sidewalk
/bikepath.
NOW, THEREFORE, BE IT RESOLVED by the Presdient and Board of Trustees
that the attached Letter of Understanding be approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS,
on this 11th day of March , 1996.

Dear Mr. Kwasneski:
The STATE, through its Division of Highways, is desirous of improving FAP
Route 344 (IL Route 83 from Bluff Road to IL. Route 171 South Junction in the
Village of Lemont, Cook/DuPage County, Illinois (State Section: 545X -R -1,
545VB -2 -BY; 545(B -5 & 8VB -1, 3 & 4)R) by making the following
improvements.
Resurfacing on IL. Route 83 from 277 meters (909 ft) north of the center line of
Bluff Road to 223 meters (731 ft) southeast of the center line of Bluff Road,
providing two (2) 3.6 meters (12 foot) through traffic lanes in each direction, a 6
meter (20 foot) and variable width raised median with 3.6 meter (12 foot) and
variable width left turn lanes at Bluff Road; and
Reconstructing on IL. Route 83 from 223 meters (731 feet) south east of the
center line of Bluff Road to 371 meters (1218 feet) northwest of the center line
of Main street/111th Street, removing and replacing the IL. Route 83 Bridge
(super & substructure) over AT & SF Railroad, in its entirety (Structure No.:
022 - 1069), removing, widening and replacing the superstructure and widening
the substructure on the IL. Route 83 Bridge over the: Des Plaines River
(Structure No.: 022 - 0053), Chicago Sanitary & Ship Canal (Structure No.: 016-
0425), IC Railroad (Structure No.: 016- 0426), Cal -Sag Channel (Structure No.:
016 -0427 & 016 - 1022); providing two (2) 3.0 -3.6 meter (10 -12 foot)

through traffic lanes in each direction, a 1.8 -4.4 meter (6 -14.5 foot) painted or
raised median with 3.3 -3.6 meter (11 -12 foot) left and right turn lanes at various
locations as shown on plans, realigning Jeans Road at IL. Route 83; and;
Resurfacing on IL. Route 83 from 371 meters (1218 feet) northwest of the center
line of Main street/111th Street to 217 meters (712 feet) southwest of the center
line of Main Street/111th Street and on Main Street/111th Street/IL. Route 83
from 551 meters (1807 feet) west of the center line of IL. Route 83/IL. Route
171 /Archer Avenue to 399 meters (1308 feet) east of the center line of IL. Route
83/IL. Route 171 /Archer Avenue, providing two (2) 3.6 meter (12 foot) through
traffic lanes in each direction, a 5.0 meter (16 foot) and variable width raised
median with 3.0 -3.6 meter (10 -12 foot) left and right turn lanes at Main
Street/111th Street/IL. Route 83; and
Reconstructing on IL. Route 171 (Archer Avenue) from 198 meters (650 ft)
northeast of the center line of IL. Route 83 to IL. Route 83, and on 107th Street
from 122 meters (400 ft) east of the center line of IL. Route 171 (Archer
Avenue) to IL. Route 171, providing two (2) 3.3 -3.6 meter (11 -12 foot) through
traffic lanes on IL. Route 171 in each direction with a 3.3 meter (11 foot) west
bound right turn lane at IL. Route 83; and providing one 3.6 meter (12 foot)
through traffic lane on 107th Street in each direction; and
Modernizing the traffic signal at the IL. Route 83 intersection with Archer
Avenue /107th Street, installing a highway lighting system at various locations,
installing retaining walls, constructing a 2.4 meter (8 foot) combination
sidewalk/bikeway across the IL. Route 83 Bridge over Chicago Sanitary & Ship
Canal (connecting the existing I & M Canal bikeway with the future recreational
facilities of the Central Trail), providing a bike path and bike bridge from the
south end of the CSSC bridge to the I & M Canal bikeway, which is under IL.
Route 83, constructing curb and gutter inlets an a storm sewer system for
highway drainage, and by performing all other work necessary to complete the
improvement in accordance with the approved plans and specifications.
During construction 107th Street will be closed. A detour route will be provided
to avoid congestion problems.

In order that the STATE and the VILLAGE may benefit by this proposed
improvement, we are requesting concurrence with the following:
1. The STATE agrees to make the surveys, obtain all necessary rights of
way, prepare plans and specifications, receive bids and award the
contract, furnish engineering inspection during construction and cause
the improvement to be built in accordance with the approved plans,
specifications, and contract.
2. Previous discussions with the VILLAGE have indicated that the
VILLAGE is not interested in participating in additional work such as
street lighting, additional sidewalks, parking lanes, etc. Therefore, the
STATE will pay for all surveys, construction, and engineering costs.
However, we will expect the VILLAGE to adopt and put into effect the
following ordinances prior to the STATE advertising for bids:
A. An ordinance requiring parking within the designated parking
lanes be parallel to the curbs and prohibited at all other locations
within the limits of the improvement, a copy of which is attached
hereto and will in the future, prohibit parking at such locations on
or immediately adjacent to the improvement as may be
determined necessary by the STATE from traffic capacity
studies.
B. An ordinance prohibiting sanitary sewer and industrial waste
water discharge into any drainage facilities constructed as part of
the improvement.
C. An ordinance relative to the disposition of existing
encroachments and prohibiting in the future any new
encroachments within the limits of the improvement, a copy of
which is attached hereto. The disposition of encroachments will
be cooperatively determined with the VILLAGE and STATE
representatives.
Copies of samples ordinances are attached which you may use as guides.
Copies of the adopted or existing ordinances, as mentioned above, will
need to be in our files prior to our recommending construction of this
improvement.

3. We expect the VILLAGE to provide us with a letter, prior to the STATE
advertising for the work to be performed hereunder, approving the plans
and specifications as prepared. The plans and specifications will be
forwarded as soon as they are available for your inspection and use,
together with a request for your approval.
4. We ask the VILLAGE not to permit driveway entrance openings to be
made in the curb, as constructed, of STATE maintained highways
improved as part of our project, without first obtaining our consent.
5. The STATE will cause private utilities to be relocated at no expense to
the STATE or VILLAGE. Where a municipal utility has been installed
1. on right of way acquired by the Illinois Department of Transportation
or 2. within defined limits of a route the Illinois Department of
Transportation has accepted for maintenance responsibilities, subsequent
to the date of such acceptance the VILLAGE will bear all utility
relocation or adjustment costs made necessary by the construction of this
improvement.
6. Upon completion of the improvement and final field inspection by the
STATE, and so long as IL. Route 83, and IL. Route 171 (within the
limits of the improvement) are used as State Highways, the STATE will
maintain, or cause to be maintained, the median, the through traffic
lanes, the turning lanes, and the curb and gutter or stabilized shoulders
and ditches adjacent to those lanes, excluding the bikeway and its
appurtenances. The STATE will be responsible for the maintenance of
lane line and median line markings. The STATE will need to access the
proposed bike trail below the IL. Route 83 Bridge for maintenance and
construction of the bridge structure.
7. Upon completion of the improvement and final field inspection by the
STATE, and so long as IL. Route 83, and IL. Route 171 (within the
limits of the improvement) are used as State Highways, the VILLAGE
will maintain those portions of the improvement (within VILLAGE
limits) not maintained by the STATE, including all manholes, catch
basins, parkways, storm sewers, sidewalks, VILLAGE owned utilities
and appurtenances, as well as stopline and pavement markings. The
VILLAGE will also be responsible for the maintenance of the mast arm
cross street signing facing VILLAGE maintained streets.

8. Upon final field inspection of the bike path and bike bridge, the
VILLAGE agrees to assume responsibility for the administration,
control, reconstruction, and maintenance of the bike path and bike bridge
extension from the proposed Illinois Route 83 alignment to the existing I
& M Canal bike path, including the retaining wall adjacent to the bake
path, the bridge handrail, and possible shielding, if necessary, to preclude
concrete from falling onto the bike path. The VILLAGE further agrees
that should future STATE highway project (s) necessitate the
relocation/realignment of that portion of the bikeway located on STATE
right of way, the VILLAGE shall cause the aforesaid adjustment to be
made at no expense to the STATE.
9. Upon acceptance by the STATE of the traffic signal work included
herein, the financial responsibility for the maintenance and electrical
energy charges for the operation of the signal(s) shall be proportioned as
follows:

It is understood that the actual signal maintenance will be performed by
the STATE either with its own forces or through an ongoing contractual
agreement, and that the signals shall be maintained to at least the Level
of Maintenance shown above.
The STATE retains the right to control the sequence and timing of the
traffic signals.
PLAN APPROVAL
WHEREAS, in order to facilitate the improvement of IL. Route 83, State Section
545X -R -1, 545VB -2 -BY; 545(B -5 & 8VB -1, 3 & 4)R, the Village of Lemont hereby
approves the plans and specifications for the proposed construction.

Approval of this Letter of Understanding shall be considered as concurrence
with and acceptance of all terms contained herein, and shall be binding upon and
inure to the benefit of the parties hereto, their successors and assigns.
