AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT AND APPROVING A RESIDENTIAL PLANNED DEVELOPMENT ON THE FRANCISCAN SISTERS OF CHICAGO PROPERTY WHEREAS, The Franciscan Sisters of Chicago, hereinafter referred to as "the Petitioner ", is the owner of approximately 105 acres, hereinafter referred to as "the subject property ", located southwest of the intersection of Walker Road and Main Street in Lemont, Illinois and legally described in Exhibit A (see attached) WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential Planned Unit Development; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on October 4, 1994 for approval of a zoning map amendment from Cook County R -4 Single - family Residence District and Special Use - Planned Development to Village of Lemont R -5 Single - family Attached Residence and Special Use - Residential Planned Development; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Village of Lemont Board of Trustees, after a public hearing as required by law, approved an annexation agreement between the Village and the owner of the subject property which requires the Village of Lemont to adopt a Zoning Map Amendment and Planned Development Ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of a Planned Unit Development ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village approve the Zoning Map Amendment and a Residential Planned Development pursuant to ILCS 65 11- 13 -1.1. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Co 2 SECTION 1: Zoning Map Amendment. The subject property described above be and the same is hereby rezoned from its present Cook County R -4 Single - family Residence Zoning Classification and Special Use - Planned Development to Village of Lemont R -5 Single - family Residence District. The zoning map of the Village of Lemont be and the same is hereby amended in accordance with the provisions of this Ordinance. SECTION 2: Planned Unit Development Approval. That a Residential Planned Development be and is hereby approved and granted to allow a Residential Planned Development upon the subject property legally described above, subject to the following Planning Stipulations: 1. That the existing uses, buildings and structures on the subject property, including the Franciscan Village Planned Development including the Nursing Home and Retirement Community, Motherhouse Convent, and related site improvements and structures, are hereby recognized as legal, conforming uses, buildings and structures under the R -5 District zoning classification and this ordinance. 2. That the owner shall be permitted to develop and redevelop the subject property in a manner consistent with the existing mixed -use campus, including future expansions of the convent residence, nursing home, retirement community and accessory retail uses, and new development of senior citizen housing, health care, day care, educational uses and related accessory uses. 3. That the owner shall be permitted to develop the property in accordance with the permitted uses described herein, so long as such development is consistent with the bulk regulations in the R -5 District and other applicable ordinances of the Village. Compliance with this ordinance shall be determined by the Village staff and no further public hearings shall be required in the event that the proposed development is in accordance with said bulk regulations and other applicable ordinances. 4. Upon conveyance of any portion of the subject property to a non - related party (hereinafter defined), the property may be developed only for those uses expressly permitted herein. For purposes of this provision, a "non- related party" shall be defined as any entity having no corporate or partnership relationship with the owner or its successors or assigns. Such non - related party would be prohibited, without further zoning approvals, from developing retirement housing unless such housing qualifies as Housing for Older Persons, as defined by the United States Department of Housing and Urban Development 3 rules and regulations, as they are from time to time amended. Notwithstanding anything herein to the contrary, however, in the event the Petitioner conveys a certain triangular parcel of land on its western border legally described upon Exhibit "B" attached hereto and included herein, to Janas & Hirsekorn Partnership, or a related entity, said triangular parcel shall become part of Case File Number 94.01, known as Carriage Ridge Estates Unit III Planned Development" and shall be zoned as the remainder of the land which is subject to that Case File.
