ORDINANCE NO.
AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF
LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS
CARRIAGE RIDGE ESTATES III
WHEREAS, Independent Trust Corporation, as Trustee under
Agreement dated May 6, 1987, known as Trust No. 575 and the Janas
and Hirsekorn Partnership, an Illinois General Partnership,
hereinafter referred to as "the Petitioner ", is the owner of an
approximately 39 acre parcel, hereinafter referred to as "the
subject property ", located on the north side of Mccarthy Road and
west of Carriage Ridge Estates Units I & II in Lemont, Illinois and
legally described in Exhibit "A ".
WHEREAS, the Petitioner made application under the provisions
of the Lemont Zoning Ordinance for a Residential Planned
Development to be known as CARRIAGE RIDGE ESTATES III; and
WHEREAS, the Planning & Zoning Commission of the Village of
Lemont, Illinois (the "Village ") did heretofore commence and
conduct a Public Hearing on November 1, 1994 for approval of a
Residential Planned Development known as CARRIAGE RIDGE ESTATES
III; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Lemont
Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Village of Lemont Board of Trustees, after a
public hearing as required by law, approved an annexation agreement
between the Village and the owner of the subject property, which
agreement requires the Village of Lemont to adopt a Planned
Development Ordinance as described herein; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by the adoption of a Planned Development ordinance as
described herein; and
WHEREAS, the President and Board of Trustees of the Village
approve the development of the subject property as a Planned Unit
Development pursuant to ILCS 65/1- 13 -1.1.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Zoning District Change. The subject property
described above be and the same is hereby rezoned from its present
Cook County R -4 Single- family Residence Zoning Classification to
Village of Lemont R -4 Single - family Residence District. The zoning
map of the Village of Lemont be and the same is hereby amended in
accordance with the provisions of this Ordinance.
SECTION 2: Planned Development Approval. That a Planned
Development be and is hereby approved and granted to allow the
Owner or successors or assigns, (collectively referred to as the
"Owner ") to construct a Planned Development upon the subject
property legally described above pursuant to Owners Preliminary
Plans attached hereto as Exhibit B and subject to the following
Planning Stipulations:
1. A bulk exception is granted to permit a minimum lot width
of seventy -five (75) feet.
2. A bulk exception is granted to permit a minimum interior
side yard setback of twelve and one -half (12 1/2) feet.
3. Said bulk exceptions are conditioned on the preservation
of open space along the natural drainage way which traverses
the site from south to north. The drainage way shall be
protected from development by a drainage easement as indicated
on the preliminary plans.
THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY
LAW.
