RESOLUTION REGARDING ENCROACHMENTS
WITHIN MAIN STREET RIGHT -OF -WAY
WHEREAS, the Village of Lemont has applied for State and Federal transportation
funding assistance for the re- design and construction of improvements to Main Street from
State Street to Illinois Street; and
WHEREAS, survey data has indicated that three unauthorized encroachments exist
along the Main Street right -of -way; and
WHEREAS, the encroachments are considered legal, non - conforming uses by the
Village, and are subject to the building and zoning regulations governing such uses; and
WHEREAS, the Illinois Department of Transportation will not require removal of
the encroachment if the Village provides a permit authorizing a continuation of the
encroachment.
NOW, THEREFORE BE IT RESOLVED that the following properties contain legal,
non - conforming encroachments which shall not be subject to removal for the roadway
improvements proposed for Main Street:
A). NICK'S TAVERN
221 MAIN STREET
B). THE MET NEWSPAPER
223 MAIN STREET
C). MAIN INN
302 MAIN STREET
BE IT FURTHER RESOLVED that the above listed properties shall be subject to
those building and zoning regulations governing legal, non - conforming use.
