AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF
LEMONT AND APPROVING AN AMENDMENT TO A PLANNED UNIT
DEVELOPMENT KNOWN AS ABBEY OAKS
WHEREAS, Pat Cronin Construction Inc., as the beneficiary of
State Bank of Countryside Trust No. 92 -1216 and Worth Bank and
Trust Company Trust No. 4868, is the owner of a 73 -acre parcel
(formerly the St. Vincent Seminary), hereinafter referred to as
"the subject property ", located on the north side of 127th Street
west of Archer Avenue in Lemont, Illinois and legally described as
follows:
PARCEL 1: THE SOUTH 1600 FEET OF THE WEST 1/2 OF THE
SOUTHEAST 1/4 AND THE SOUTH 1600 FEET OF THE WEST 1/2 OF THE
EAST 1/2 OF THE SOUTHEAST 1/4 OF SECTION 28, TOWNSHIP 37
NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK
COUNTY, ILLINOIS
PARCEL 2: EASEMENT FOR THE BENEFIT OF PARCEL 1 FOR THE
PURPOSE OF INSTALLING, LAYING, CONSTRUCTING, OPERATING,
UTILIZING, INSPECTING, MAINTAINING, REPAIRING AND REPLACING
VARIOUS UTILITIES AND INGRESS AND EGRESS THERETO OVER, UNDER
AND ACROSS THE FOLLOWING DESCRIBED LAND AS CREATED BY GRANT OF

VINCENT DE PAUL HIGH SCHOOL.
WHEREAS, the Owner /Petitioner made application under the
provisions of the Lemont Zoning Ordinance for a residential Planned
Unit Development to be known as ABBEY OAKS; and
WHEREAS, the Planning Commission of the Village of Lemont,
Illinois (the "Village ") did heretofore commence and conduct a
Public Hearing on January 5, 1993, for approval of a Planned Unit
Development known as ABBEY OAKS; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Lemont
Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Lemont Planning Commission has recommended the
adoption of a Planned Unit Development Ordinance by the Board of
Trustees of the Village; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by the adoption of the Planning Commission recommendations
specified below regarding the subject property; and
WHEREAS, the President and Board of Trustees of the Village
approve the development of the subject property as a Planned Unit
Development pursuant to I11.Rev.Stat.Ch.24, 11- 13 -1.1.
WHEREAS, the President and Board of Trustees of the Village of
Lemont adopted Ordinance 774 on March 22, 1993, approving the Abbey
Oaks Planned Unit Development; and

WHEREAS, Pat Cronin Construction, Inc., as the beneficiary of
State Bank of countryside Trust No. 92 -1216 and Worth Bank and
Trust Company Trust No. 4868, made application to amend the Planned
Unit Development; and
WHEREAS, the proposed amendment would authorize rezoning of
the 20 -acre parcel from R -1 to R -4 Single - family Residence District
and the demolition of all buildings on that 20 -acre parcel; and
WHEREAS, the Lemont Planning & Zoning Commission conducted a
Public Hearing on August 1, 1995, after publication of appropriate
notices; and
WHEREAS, the Lemont Planning & Zoning Commission recommended
approval of the proposed amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Planned Unit Development Approval. That a Planned
Unit Development be and is hereby approved and granted to allow the
Owner or successors or assigns, (collectively referred to as the
"Owner ") to construct a Planned Unit Development upon the subject
property legally described above pursuant to Owner's Preliminary
Plans attached hereto as Exhibit A and subject to the following
Planning Stipulations:
1. That the property be rezoned from R -1 Single- family
Residence District to PUD with underlying zoning of R -4
Single- family Residence District on approximately 20
acres, as indicated by the Owner's Preliminary Plan
(Exhibit A).
2. That all buildings on the 20 acres may be demolished upon
receipt of appropriate permits and approvals.
3. That a tree preservation /replacement plan, to consist of
a conservation easement and tree -care provisions in the
development plans and specifications, shall be submitted
for Village review and approval prior to final plat.
Such a plan shall protect all trees greater than 8 -inch
caliper within the conservation easement and shall
require the protection or replacement of all such trees
within the non - buildable areas of lots and public rights-
of-way.

4. That the fence and entrance gate on 127th Street shall be
of a unified design and construction materials, and no
additional rear -yard fences shall be permitted for lots
along 127th Street. The fence shall be constructed by the
Owner, or successors or assigns.
SECTION 2: Zoning District Change. The subject property
described above be and the same is hereby rezoned from its present
R -1 Single- family Residence District Zoning Classification to PUD
with an underlying zoning of R -4 Single- family Residence on
approximately 20 acres legally described as follows:
THE SOUTH 1600 FEET OF THE WEST 1/2 OF THE SOUTHEAST 1/4 AND
THE SOUTH 1600 FEET OF THE WEST 1/2 OF THE EAST 1/2 OF THE
SOUTHEAST 1/4 OF SECTION 28, TOWNSHIP 37 NORTH, RANGE 11 EAST
OF THE THIRD PRINCIPAL MERIDIAN, MORE PARTICULARLY DESCRIBED
AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF THE WEST 1/2
OF THE EAST 1/2 OF THE SOUTHEAST 1/4 OF SECTION 28, TOWNSHIP
37 NORTH, RANGE 11 THENCE SOUTH 88 38' 49" EAST A DISTANCE
OF 875.08 FEET ALONG THE SOUTH LINE OF THE SOUTHEAST 1/4 OF
SECTION 28, TOWNSHIP 37 NORTH, RANGE 11 THENCE NORTH 01 21'
11" EAST A DISTANCE OF 776.47 FEET TO A POINT OF CURVATURE,
THENCE NORTHERLY ALONG A CURVE TO THE LEFT, A DISTANCE OF
128.19 FEET TO POINT OF TANGENCY, SAID CURVE HAVING A CENTRAL
ANGLE OF 17 04' 51" A RADIUS OF 430.00 FEET AND HAVING A
CHORD LENGTH OF 127.72 FEET WHICH BEARS NORTH 07 11' 15"
WEST, THENCE NORTH 15 43' 41" WEST A DISTANCE OF 133.34 FEET
TO A POINT OF CURVATURE, THENCE NORTHERLY ALONG A CURVE TO THE
RIGHT A DISTANCE OF 128.72 FEET, SAID CURVE HAVING A CENTRAL
ANGLE OF 10 46' 00" A RADIUS OF 685.00 FEET AND HAVING A
CHORD LENGTH OF 128.53 FEET WHICH BEARS NORTH 10 20' 41"
WEST, THENCE SOUTH 70 08' 49" EAST A DISTANCE OF 498.83 FEET,

OF BEGINNING, IN COOK COUNTY, ILLINOIS.
The zoning map of the Village of Lemont be and the same is hereby
amended in accordance with the provisions of this Ordinance.
THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY
LAW.
