AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS KEEPATAW TRAILS WHEREAS, Keepataw Trails Group, L.L.C., hereinafter referred to as "the Petitioner ", is the owner of an approximately 29 acre parcel, hereinafter referred to as "the subject property ", located on the south side of 127th Street and west of Archer Avenue in Lemont, Illinois and legally described in Exhibit "A ". WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential Planned Unit Development to be known as KEEPATAW TRAILS; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore conduct a Public Hearing on August 15, 1995 and subsequently on October 3, 1995 recommended approval of a Residential Planned Development known as KEEPATAW TRAILS; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Village of Lemont Board of Trustees, after a public hearing as required by law, approved an annexation agreement between the Village and the owner of the subject property, which agreement requires the Village of Lemont to adopt a Planned Unit Development Ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of a Planned Unit Development ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village approve the development of the subject property as a Planned Unit Development pursuant to ILCS (1994) 65 5/7 -1 -8. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: 2 CZ SECTION 1: Planned Unit Development Approval. That a Planned Unit Development be and is hereby approved and granted to allow the Owner or successors or assigns, (collectively referred to as the "Owner ") to construct a Planned Unit Development upon the subject property legally described pursuant to Owners Preliminary Plans attached hereto as Exhibit A and subject to the following Planning Stipulations: 1. That the zoning classification of the subject property shall be amended from Cook County R -4 Single - family Residence to a Special Use - Planned Unit Development with an underlying zoning of R -4 Single - family Residence. 2. That the property be developed in accordance with the preliminary plans for no more than 58 single- family attached dwelling units (townhomes) and 40 single- family dwelling units on individual lots. 3. That the petitioner submit Homeowners Association (HOA) declarations including provisions for snow removal and repair and maintenance of all private common area improvements, including the cul -de -sac islands, parking spaces, driveways, and detention facilities. 4. That all final engineering plans be approved by the Village Engineer. SECTION 2: Zoning District Change. The subject property described above be and the same is hereby rezoned from its present Cook County R -4 Single- family Residence Zoning Classification to Planned Unit Development with an underlying zoning of R -4 Single - family Residence to allow the construction of single- family attached residences (townhomes) in accordance with the Preliminary Plans attached hereto as Exhibit A and the Planning Stipulations identified above. The zoning map of the Village of Lemont be and the same is hereby amended in accordance with the provisions of this Ordinance. THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY F LAW. C .
