ORDINANCE GRANTING FRONT AND REAR YARD VARIANCES
AND TO ALLOW PARKING LOT TO BE ON THE
PROPERTY LINES ABUTTING ARCHER & McCARTHY ROAD
(Arnold Property)
WHEREAS, an application has been filed by Joyce Arnold, in
connection with a Request for Variation for the property legally
described in Exhibit "A" and located at 12300 S. Archer Avenue in
Lemont, Illinois.
WHEREAS, the applicant is seeking relief from the Lemont
Zoning Ordinance in order to allow a variation for a front yard
setback of 16.29 feet, a rear yard setback of 13.12 feet and a
variation to allow an existing parking lot to be on the property
lines abutting Archer Avenue and McCarthy Road; and
WHEREAS, the Planning and Zoning Commission of the Village of
Lemont, Illinois, in accordance with said Zoning Ordinance,
conducted a Public Hearing on the petition on January 2, 1996; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the
Reporter /Progress Newspaper, a newspaper of general circulation
within the Village; and
WHEREAS, the Lemont Planning and Zoning Commission has
recommended approval of the variations to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interest of the Village will be
served by the approval of this petition granting a variation for
the subject property.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Lemont, that the petitioner, Joyce
Arnold be granted a variance to allow front yard setback of 16.29
feet along Archer Avenue, rear yard setback of 13.12 feet along
McCarthy Road and to allow an existing parking lot to be on the
property lines abutting Archer Avenue and McCarthy Road subject to
the following conditions:
1. All parking or paved areas located in the McCarthy Road
right -of -way shall be removed prior to issuance of an occupancy
permit for the facility, except apron access areas in
conformance with Cook County Highway Department standards.
2. Any building addition which expands the building footprint
within required setback areas will require a new variance
approved by the Village Board.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMON, COUNTY OF COOK, ILLINOIS, on this
