AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT FOR THE TIEDT PROPERTY WHEREAS, NORMAN TIEDT is the Owner of a tract of land, hereinafter referred to as "the subject property ", located on the Southeast corner of State Street and Bluff Road in Lemont, Illinois and legally described on the attached Exhibit "A "; and WHEREAS, NORMAN TIEDT, the Petitioner herein, has filed an Application for a Zoning Map Amendment following a voluntary annexation to the Village of Lemont; and WHEREAS, the Plan Commission of the Village of Lemont conducted a Public Hearing on said Petitioner's request for a Zoning Amendment from an R -1 Single Family Residence District to M -3 Manufacturing District; and WHEREAS, notice of the aforesaid Public Hearing was held in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the proposed Zoning District is generally consistent with the Village Comprehensive Plan; and WHEREAS, the Lemont Plan Commission recommended an amendment to the Lemont Zoning Map from R -1 Single Family Residence District to M -3 Manufacturing District; and WHEREAS, the President and Board of Trustees at their regular meeting on December 27, 1988 unanimously voted to amend the zoning map from R -1 Single Family Residence District to M -3 Manufacturing District and directed the Mayor and Clerk to prepare and execute an Ordinance; and WHEREAS, it appears, after a search of Village records, such Ordinance cannot be located reflecting such action. NOW, THEREFORE, IN ORDER TO MEMORIALIZE PRIOR BOARD ACTION, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, ILLINOIS: That the Lemont Zoning Map be amended from R -1 Single Family Residence District to M -3 Manufacturing District for the property legally described on the attached Exhibit "A ". This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form. Antonopoulos, Village Attorney February 20, 1.996 RE: Zoning Amendments; Union Oil, Ozinga Brothers and Norman Tiedt In 1987 the above- captioned property owners voluntarily annexed their property to the Village of Lemont without requesting an Annexation Agreement with the understanding that the Village would rezone the property to an industrial classification similarly existing under the County Zoning Ordinance. Subsequent to the Annexation, the Village Plan Commission conducted a Public Hearing and unanimously recommended that the recently annexed parcels be rezoned M -3 Manufacturing. Enclosed is a copy of the Minutes of the December 27, 1988 meeting directing the Mayor and Clerk to prepare an executed Ordinance reflecting the Zoning Amendment. The Planning Staff is unable to Locate the Ordinance amending the zoning map and requested that I prepare the appropriate Ordinances amending the zoning from the R -1 Single Family District to M -3 Manufacturing District. If any Board Member has any questions prior to the meeting, T would suggest that they contact the Planner or my office directly. December 27, 1988 The regular meeting of the Lemont Village Board took place on Tuesday, December 27, 1988, at 7:30 p.m. President John Nelson presiding. Roll call: Buschman, Johnson, Kwasneski, Murray, Skopec, present. Quinn, absent. Motion by Buschman, seconded by Johnson, to approve the minutes of the last meeting. Voice vote, 5 yeas. Motion passed. The Clerk then swore in Dwayne Jasper as a Lemont Police Officer. Audience Participation None this evening. Motion by Skopec, seconded by Buschman, to approve the payroll and the bills in the amount of $83,223.13. Roll call: Buschman, Johnson, Kwasneski, Murray, Skopec, yeas. Quinn, absent. Motion passed. After, Mr. Skopec moved all checks to Beling Consultants not be paid at this time, seconded by Johnson. Roll call: Buschman, Johnson, Kwasneski, Murray, Skopec, yeas. Quinn, absent. Motion passed. Clerk's Correspondence The first letter read was from the Plan Commission unanimously recommending M3 Manu- facturing Zoning for the Union Oil, Ozinga Bros. & Norm Tiedt properties. Motion by Buschman, seconded by Skopec, to accept their recommendation. Roll call: Buschman, Johnson, Kwasneski, Murray, Skopec, yeas. Quinn, absent. Also, to have the Mayor and Clerk prepare and execute the Ordinance. Motion passed. The second letter, also from the Plan Commission, unanimously recommended approval of the subdivision plat for Equestrian Woods Unit 3, 4 & 5. Motion by Skopec, seconded by Kwasneski, to accept said recommendation. Roll call: Voice vote, 5 yeas. Motion passed. The third letter was from Pastor Steve Swarga of the Emmanuel Baptist Church at 1191 McCarthy Road, requesting a tap -on for Lemont water. Motion to refer to Sewer and Water Committee by Skopec, seconded by Buschman. Voice vote, 5 yeas. Motion passed. The next letter was from the Lemont Zoning Board recommending the request for variation by Charles Klotz of 414 Sara Avenue for a section of decorative fence to shield an in- ground pool. Motion by Skopec, seconded by Murray, to approve said recommendation. Mr. Skopec and Murray withdrew their motion. Motion to table the motion by Skopec, seconded by Buschman. Voice vote, 5 yeas. Motion passed. The Lemont Zoning Board recommended in another letter that a request for variation on set -backs for a proposed building at Illinois and Main Street NOT be granted because of the following: The view at the intersection The lot is too small Heavy traffic at the intersection Having the egress and ingress 20 ft from a stop sign. Motion to approve said recommendation not to rezone by Murray, seconded by Kwasneski. Roll call: Buschman, Johnson, Kwasneski, Murray, Skopec, yeas. Quinn, absent. Motion passed. The next letter also concerned a request by Ridge Outdoor Advertising for B3 zoning from R4. The Plan Commission voted NOT to recommend the angher recommendation due ffc and size. Motion by Skopec, seconded by Kwasneski, to approve s. Quinn, absent. rezone. Roll call: Buschman, Johnson, Kwasneski, Murray, Skopec, yeas. Motion passed.
