AN ORDINANCE ADOPTING THE 1993 BOCA NATIONAL MECHANICAL CODE,
ESTABLISHING THE MINIMUM REGULATIONS GOVERNING THE
DESIGN, INSTALLATION AND CONSTRUCTION OF MECHANICAL
SYSTEMS, BY PROVIDING REASONABLE SAFEGUARDS TO PROTECT
THE PUBLIC HEALTH AND SAFETY AGAINST THE HAZARDS OF
INADEQUATE, DEFECTIVE OR UNSAFE MECHANICAL SYSTEMS
AND INSTALLATIONS; KNOWN AS THE MECHANICAL CODE
ORDINANCE NO. 7/
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
Counties of Cook, Will, and DuPage, State of Illinois, as follows:
SECTION 1. ADOPTION OF MECHANICAL CODE.
That a certain document, three (3) copies of which are on file in the offices of the
Village of Lemont, being marked and designated as "The BOCA National Mechanical Code,
Eighth Edition, 1993 ", as published by Building Officials and Code Administrators
International, Inc., be and is hereby adopted as the Mechanical Code of the Village of
Lemont in the State of Illinois; for the control of buildings and structures as herein
provided; and each and all of the regulations, provisions, penalties, conditions and terms of
the said BOCA National Mechanical Code are hereby referred to, adopted and made a part
hereof, as if fully set out in this Ordinance, with the additions, insertions, deletions and
changes, if any, prescribed in Section 3 of this Ordinance.
SECTION 2. INCONSISTENT ORDINANCES REPEALED.
That Ordinance Number 657 of the Village of Lemont entitled "An Ordinance
Adopting the 1990 BOCA National Mechanical Code... ", et. al., and all other ordinances or
parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. ADDITION, INSERTIONS, AND CHANGES.
That the following sections are hereby revised as follows:
SECTION M -101.1 (page 1, second line). Insert: VILLAGE OF LEMONT
SECTION M -113.2 (page 4). Delete in its entirety:
"Periodic inspections: The fees for all periodic inspections shall be as indicated in
the following schedule."
SECTION M -113.3 (page 4, third line). Insert: Fee Schedule.
The fees for all mechanical work shall be as indicated in the
following schedule:
1. Mechanical permit fees for new construction will be combined with the
Building Permit fee. This fee will be based on total construction costs and
include all structural, electrical, plumbing, mechanical, interior and exterior
finishes, and normal site preparation.
2. Except as provided above, the permit fees for mechanical work shall be as
indicated in the following schedule:
a) Central Air Conditioner $30.00 each unit
b) Furnace /Low Pressure Boiler $30.00 each unit
c) Fireplace $30.00
d) Mechanical Equipment $30.00 each
e) Minimum Inspection Fee $30.00
SECTION M -116.4 - VIOLATION PENALTIES (page 5). Change to read:
Any person who shall violate a provision of this code or shall fail to comply with any
of the requirements thereof or who shall erect, construct, alter or repair mechanical
equipment or systems in violation of the approved construction documents or
directive of the code official, or of a permit or certificate issued under the provisions
of this code, shall be guilty of a Misdemeanor, punishable by a fine of not more than
$750.00. Each day that a violation continues after notice has been served shall be
deemed a separate offense.
SECTION 117.2 - UNLAWFUL CONTINUANCE (page 5). Insert:
Any person who shall continue any work in or about the structure after having been
served with a stop work order, except such work as that person is directed to perform
to remove a violation or unsafe condition, shall be liable to a fine of not less than
$25.00 or more than $750.00.
SECTION 4. SAVING CLAUSE.
That nothing in this Ordinance or in the Mechanical Code hereby adopted shall be
construed to affect any suit or proceeding impending in any court, or any rights acquired,
or liability incurred, or any cause or causes of action acquired or existing, under any act or
ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall any just of legal
right or remedy of any character be lost, impaired or affected by this Ordinance.
SECTION 5. DATE OF EFFECT.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.
This Ordinance shall take full force and effect ten (10) days after this date of final
passage, approval, and publication in the manner provided by law.
