AN ORDINANCE ADOPTING THE CABO ONE AND TWO FAMILY
DWELLING CODE, 1995 EDITION, REGULATING THE
FABRICATION, ERECTION, CONSTRUCTION, ENLARGEMENT,
ALTERATION, REPAIR, LOCATION, AND USE OF
DETACHED ONE AND TWO FAMILY DWELLINGS AND THEIR
APPURTENANCES AND ACCESSORY STRUCTURES
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
Counties of Cook, Will, and DuPage, _ State of Illinois as follows:
SECTION 1. ADOPTION OF THE CABO ONE AND TWO FAMILY DWELLING CODE.
That a certain document, three (3) copies of which are on file in the offices of the
Village of Lemont, being marked and designated as "The CABO One and Two Family
Dwelling Code, 1995 Edition" as published by the Council of American Building Officials,
be and is hereby adopted as the One and Two Family Dwelling Code of the Village of
Lemont, in the State of Illinois; for the purposes of establishing minimum regulations
governing the design, construction, repairs and remodeling of one and two family dwellings
and their appurtenances and accessory structures; and each and all of the regulations,
provisions, penalties, conditions and terms of said CABO One and Two Family Dwelling
Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this
Ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section
3 of this Ordinance.
SECTION 2. INCONSISTENT ORDINANCES REPEALED.
That Section 4 of Ordinance Number 656 of the Village of Lemont entitled "An
Ordinance Adopting the BOCA National Building Code /1990 ", and all other ordinances or
parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. ADDITIONS, INSERTIONS AND CHANGES.
That the CABO One and Two Family Dwelling Code is amended and revised in the
following respects:
Section 106.4 - Penalty. Change to Read:
Any person, firm or corporation violating any of the provisions of this code shall be
guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense
for each and every day or portion thereof during which any violation of any of the provisions
of this code is committed, continued or permitted, and upon conviction of any such violation
such person shall be punishable by a fine of not less then $25.00 nor more than $750.00 at
the discretion of the court.
SECTION 4. SAVING CLAUSE.
That nothing in this Ordinance or in the One and Two Family Dwelling Code hereby
adopted shall be construed to affect any suit or proceeding impending in any court, or any
rights acquired, or liability incurred, or any cause or causes of action acquired or existing,
under any act or ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall
any just or legal right or remedy of any character be lost, impaired or affected by this
Ordinance.
SECTION 5. DATE OF EFFECT.
That the Village Clerk of the Village of Lemont, Counties of Cook, Will and
DuPage, State of Illinois, shall certify to the adoption of this Ordinance, and cause the same
to be published in pamphlet form.
This Ordinance shall take full force and effect ten (10) days after this date of final
passage, approval, and publication in the manner provided by law.
