O-657-90 04/09/90- tr ORDINANCE NO. AN ORDINANCE ADOPTING THE 1990 BOCA NATIONAL MECHANICAL CODE, ESTABLISHING THE MINIMUM REGULATIONS GOVERNING THE DESIGN, INSTALLATION AND CONSTRUCTION OF MECHANICAL SYSTEMS, BY PROVIDING REASONABLE SAFEGUARDS TO PROTECT THE PUBLIC HEALTH AND SAFETY AGAINST THE HAZARDS OF INADEQUATE, DEFECTIVE OR UNSAFE MECHANICAL SYSTEMS AND INSTALLATIONS; KNOWN AS THE MECHANICAL CODE. BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, County of Cook, State of Illinois, that: SECTION 1. ADOPTION OF MECHANICAL CODE. That a certain document, three (3) copies of which are on file in the offices of the Village of Lemont, being marked and designated as "The BOCA National Mechanical Code, Seventh Edition, 1990," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Mechanical Code of the Village of Lemont in the State of Illinois; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the said BOCA National Mechanical Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Ordinance, with the additions, insertions, deletions and changes, if any prescribed in Section 3 of this Ordinance. SECTION 2. INCONSISTENT ORDINANCES REPEALED. That Ordinance Number 560 of the Village of Lemont entitled "An Ordi- nance Adopting the BOCA National Mechanical Code, Sixth Edition, 1987, and all other Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 3. ADDITIONS, INSERTIONS AND CHANGES. That the following sections are hereby revised as follows: Section M -100.1 (page 1, second line). Insert: Village of Lemont Section M -114.2 (page 7). "Periodic Inspections" shall be deleted in its entirety. Section M -114.3 (page 7, third line). Insert: Fee Schedule. Permit fees for all mechanical work shall be as indicated in the following schedule: 1. Mechanical permit fees for new construction will be combined with the Building Permit fee. This fee will be based on total construction costs and include all structural, electrical, plumbing, mechanical, interior and exterior finishes, and normal site preparation. 2. Except as provided above, the permit fees for mechanical work shall be as indicated in the following schedule: a) Central Air Conditioner b) Furnace /Low Pressure Boiler c) Fireplace d) Mechanical Equipment e) Minimum Inspection Fee $25.00 each unit $25.00 each unit $25.00 $25.00 each $25.00 Section M -117.4 (page 9, fifth, sixth & seventh lines). Insert: Misdemeanor, $500.00, 0 days. Section M -118.2 (page 10, fourth & fifth lines). Insert: Section M -122.0 entitled Add New Section M -123.0 (page 12): $25.00 and $500.00 "Means of Appeal" shall be deleted in its entirety. Registration of Contractor Section M -123.1 Fee: All HVAC contractors not working under a General Contractor must be registered with the Village and pay a $50.00 per year registration fee, to conduct business or work within the Village, whether or not their place of business is located within the Village. Section M -123.2 Insurance: All HVAC contractors must maintain sufficient insurance to protect the interests of the property owner and the community during their work. All insurance must be placed in financially responsible companies that are authorized under the insurance laws of Illinois to do business in the State of Illinois. Minimum coverage must include the following types of insurance in the following amounts: 1. Workman's Compensation and Employee's Liability - not less than $100,000 per person; 2. Comprehensive Public Liability - not less than $250,000 for injuries, including accidental death to any one person, and subject to the same limits for each persons, in an amount of any one accident; 3. Property Damage - not less than $100,000 for damage to property in any one accident with any aggregate limit of not less than $300,000. Evidence shall be filed along with the application to the Village in the form of a certificate of insurance naming the Village of Lemont as a certificate holder. Article 20 entitled "Boilers and Pressure Vessels, Maintenance and Inspection," shall be deleted in its entirety and the State Mechanical Code shall apply. SECTION 4. SAVING CLAUSE. That nothing in this Ordinance or in the Mechanical Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or Ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance. SECTION 5. DATE OF EFFECT. This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form.
