O-661-90 04/23/90ORDINANCE NO. ait AN ORDINANCE AMENDING SECTIONS OF THE LEMONT MUNICIPAL CODE CHAPTER 5.20 ENTITLED "BUILDING CONTRACTORS" BE IT ORDAINED by the President and the Board of Trustees of the Village of Lemont, County of Cook, State of Illinois, that the following sections of the Lemont Municipal Code relating to Building Contractors be amended to read as follows: 5.20.010 Definitions. The following terms used in this Chapter have the following meanings unless the context otherwise requires: A. Contractor: any person engaged in the business of constructing, altering or repairing buildings or other structures or sidewalks or street pavements, including but not limited to: Carpentry contractors Cement or concrete contractors Dry wall contractors Fencing contractors Garage contractors General contractors Heating, air conditioning and refrigeration contractors Landscape contractors Masonry contractors Paving contractors Plastering contractors Porch and deck contractors Sewer and drain layers Sheet metal contractors Siding contractors Swimming pool contractors Window contractors Wrecking contractors B. Homeowner: the term homeowner as used in this Ordinance shall be understood to mean any person who owns a single- family residence and has lived in that residence for a period longer than 6 months. 5.20.020 License Required. It is unlawful to engage in business as a Contractor within the Village of Lemont without first having obtained a license, as • hereinafter provided. For every construction permit issued, the Primary Contractor on the job shall be licensed with the Village of Lemont and pay the license fee as provided in this Ordinance. Exception: 1) Any plumbing contractor or roofing contractor who is licensed under the State of Illinois, or electrical con- tractor who is registered as such, pursuant to the provisions of the Ordinances relating to electrical contractor, shall not be required to obtain a Village of Lemont Contractor's License to work within the Village limits. However, a current copy of the respective license must be on file with the Building Department. Exception: 2) Any homeowner as defined herein is also not required to obtain a contractor's license for doing work on his own residence. 5.20.030 License - Term The Village Clerk shall issue a license upon proper appli- cation and compliance with this Chapter. All Contractors' licenses shall expire on.December 31 of each year. 5.20.040 License - Fees The annual fee for such license shall be: For General Contractors: $150 per year For all other Contractors $ 50 per year Any Contractor who already has a business license for an office located within the Village, shall be required to pay the difference in fees in order to obtain a Contractor's license. 5.20.050 Bond Prior to the issuance of a Contractor's license, the appli- cant shall submit a License and Permit Bond to the Village of Lemont in the penal sum of five thousand dollars ($5,000); for electrical contractors, ten thousand dollars ($10,000) as security for the applicant's full and complete performance in accordance with his Village permit and applicable Codes and Ordinances of the Village. Said bond is to expire December 31 of that year. 5.20.060 Contractor Insurance Contractors must maintain sufficient insurance to protect the interests of the property owner and the community during the work. All insurance must be placed in financially responsible companies that are authorized under the insurance laws of Illinois to do business in the State of Illinois. Minimum coverage should include the following types of insurance in the following amounts: 1. Workman's Compensation and Employee's Liability - not less than $100,000 per person; 2. Comprehensive Public Liability - not less than $250,000 for injuries, including accidental death to any one person, and subject to the same limits for each persons, in an amount of any one accident; 3. Property Damage - not less than $100,000 for damage to property in any one accident with an aggregate limit of not less than $300,000. Insurance coverage should be verified with a certificate from the contractor's insuring agent and list the Village of Lemont as a certificate holder. 5.20.070 License - Revocation conditions. Any building contractor's license may be revoked by the Village President and Board of Trustees for repeated violations of any Ordinance relating to the construction of buildings, the use of streets, or the replacing of streets, sidewalks or park- ways, or any other ordinance relating to the work performed by such contractor. Such revocation may be in addition to any fine imposed for violating this chapter. (Prior code 23.404) 5.20.080 Compliance with building regulations. It shall be the duty of all building contractors to comply with all Ordinances relating to the construction of buildings or other structures, to the construction of streets or sidewalk pavements, and all laws or Ordinances pertaining to or regulating the activities engaged in. (Prior code 23.403) 5.20.090 Violation Penalty. Any person, firm or corporation violating any provision of this chapter shall be fined not less than twenty -five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. (Prior code 23.405) This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form.
