ORDINANCE NO.
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
that the Office of City Collector is hereby established in accordance with the provisions of
Chapter 24, Section 3 -11 -25 as follows:
SECTION 1: APPOINTMENT AND TERM OF OFFICE. There is created the
Office of City Collector who shall be appointed by the Mayor and with the consent of the
Board of Trustees. The appointee shall hold office for the term of one (1) year or until a
successor shall be appointed and qualified, but the term of office shall not exceed that of
the Mayor.
SECTION 2: BOND OF COLLECTOR. Before entering upon the duties of office,
the City Collector shall execute a bond with two (2) or more individual sureties in the
penal sum of not less than $3,000, conditioned for the faithful performance of the duties
of said office, such bond to be approved by the Board of Trustees.
SECTION 3: DUTIES OF COLLECTOR. It shall be the duty of the City Collector
to receive all funds due the Village and, unless otherwise specifically provided, the Collector
shall issue licenses and permits required by this code and the ordinances of the Village.
The City Collector shall perform such other duties as may be prescribed by this code, the
ordinances of the Village or by the Village Administrator.
The Collector shall preserve all warrants, and shall keep the books and accounts in
the manner that the Board of Trustees may prescribe. All of the City Collector's warrants,
books and vouchers, and all papers pertaining to the office, may be examined at any time
by the Mayor, Village Clerk, Village Administrator, or any member or committee of the
Board of Trustees. Weekly, or more often, if required by the Board of Trustees, the City
Collector shall pay over to the Village Treasurer, all money collected from any source
whatever, taking the Village Treasurer's receipt therefor in duplicate and filing one of the
receipts immediately with the Village Clerk. At that time, or on demand, the Village Clerk
shall give the City Collector a copy of any receipt so filed.
SECTION 4: REPORT; ANNUAL STATEMENT. When required by the Board of
Trustees or by Ordinance, the City Collector shall make a written report to the Board of
Trustees or to any official designated by the Board of Trustees, of all money collected, the
account whereon collected, or of any other official matter. Between the first and tenth of
April of each year, the City Collector shall file with the Village Clerk a statement of:
a. All the money collected during the year;
b. The particular warrant, special assessment, or account on
which collected;
c. The balance of money uncollected on all warrants in the
Collector's possession; and
d. The balance remaining uncollected at the time of the return on
all warrants which were returned to the Village Clerk during
the preceding fiscal year.
SECTION 5: SEPARATION OF FUNDS. The Collector is expressly prohibited
from keeping the money of the Village in his /her hands or in the hands of any person, or
corporation, to his /her use, for a period longer than one month from the time he /she
collects the same until he /she turns the same over to the Village Treasurer, and any
violation of this Ordinance shall subject the Collector to immediate removal from office.
SECTION 6: COMPENSATION. Compensation of the City Collector shall be
established by the Board of Trustees.
This Ordinance shall be in full force and effect from and after its passage, approval
and publication in the manner provided by law.
All ordinances or parts of ordinances in conflict herewith shall be and the same are
hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.
