ORDINANCE NO. AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW ESTABLISHMENT OF A DRIVE -IN BANK AT THE SOUTHWEST CORNER OF DERBY ROAD AND ARCHER AVENUE (Southwest Financial Bank & Trust of Orland Park) WHEREAS, Southwest Financial Bank & Trust Company of Orland Park, an Illinois corporation, is the contract purchaser of approximately 0.9 acres, hereinafter referred to as "the subject property," generally located at the southwest corner of the intersection of Derby Road and Archer Avenue in Lemont, Illinois and legally described in Exhibit A, attached; and WHEREAS, Section VIII- E -2(i) of the Village of Lemont Zoning Ordinance classifies drive -in establishments including banks as a special use; and WHEREAS, Southwest Financial Bank & Trust of Orland Park, hereinafter referred to as "the Petitioner ", filed an application for approval of a special use permit to allow establishment of a drive -in bank; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois conducted a Public Hearing on May 2, 1995 on the petitioner's request for a special use permit; and WHEREAS, notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the proposed special use is generally consistent with the Village Comprehensive Plan; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of an ordinance to approve the special use permit as specified below; and WHEREAS, the President and Board of Trustees of the Village approve the special use permit for the subject property pursuant to ILCS 24, 11- 13 -1.1. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: Special Use Permit Approval. The Village of Lemont hereby approves a special use permit, to allow the establishment of a drive -in bank, subject to the conditions specified below, on an approximately 0.9 acre parcel legally described as follows: 2 SECTION 2: Site Plan Approval. As a condition of this special use permit, development of the drive -in bank shall be in accordance with a detailed site plan to be hereinafter reviewed by the Village of Lemont staff for compliance with Village of Lemont ordinances. SECTION 3: Vehicle Storage Requirement for Drive -in Lanes. As a further condition of this special use permit, the drive - through facilities shall be located and designed to provide storage, or stacking, space for no fewer than fifteen (15) automobiles. THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW.
