P93- AN ORDINANCE AMENDING LEMONT ZONING ORDINANCE PERTAINING TO SIGNS IN THE B-2 ZONING DISTRICT ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT This day of 1995. Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, I 'nois, this /Y day of 1995 ORDINANCE c� ORDINANCE AMENDING LEMONT ZONING ORDINANCE PERTAINING TO SIGNS IN THE B-2 ZONING DISTRICT WHEREAS, the Lemont Planning and Zoning Commission has conducted a public hearing to consider an Amendment to the Lemont Zoning Ordinance pertaining to the erection of signs within the B -2 Zoning District; and WHEREAS, the Village Board has considered this revision and determined it is in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that Ordinance 426 entitled Lemont Zoning Ordinance be amended to reflect the following: Section VIII entitled Business Districts B-2, Paragraph 6: "Awnings, Marquees and Signs" be amended by deleting and rescinding paragraph 6 in its entirety, and adopting the language attached as Exhibit A. This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form. Central Shopping District Signs This sign ordinance is adopted for the following purposes: A) To authorize the use of signs which are: 1) Compatible with their surroundings. 2) Appropriate to the activity to which they refer. 3) Expressive of the identity of individual proprietors or of the community as a whole. 4) Legible in the circumstances in which they are seen. B) To preserve, protect, and promote the public health, safety, and welfare. C) To enhance the economy, business, and industry of the Downtown District by promoting the reasonable, orderly, and effective display of signs. D) To preserve the aesthetic value and historic authenticity of the Downtown District. E) To protect the general public from damage and injury which may be caused by faulty, uncontrolled construction, or use of signs in the Downtown District. F) To protect the pedestrians and motorists from damage or injury caused by distractions, obstructions, or hazards created by certain signs. Boundary This ordinance shall be enforced on the following: all properties fronting Stephen Street from the Illinois and Michigan Canal right -of -way to Illinois Street; all properties fronting Talcott Avenue from Stephen Street to fifty feet past the "Strand Parking Lot "; all properties fronting Canal Street from Stephen Street to Lemont Street; all properties fronting the south right -of -way of Canal Street from Lemont Street to "old" State Street; all properties fronting Lemont Street from Illinois and Michigan Canal to Illinois Street; all properties fronting Main Street from Fremont Street to State Street; all properties fronting Fremont Street from Main Street to Illinois Street; only north properties fronting Illinois Street from Fremont Street to State Street. This boundary is congruent with the Downtown B -2 zoning. See Exhibit B. page 1 c : \winword\design\so719.doc Definitions A) B) Window Sign: Wall Sign: Any flat sign mounted or applied to a building side. C) Projecting Sign: D) Hanging Sign: E) Awning Sign: or Canopy Sign or Marquee Sign E(2) Awning: Canopy/Marquee F) Portable: or Sandwich Signs: G) Freestanding: or Ground - Mounted Signs: H) Flashing sign: page 2 Any sign painted or applied to window glass or within twelve (12) inches of the glass line. Any sign attached to and placed perpendicular to a building facade. Any sign suspended from an awning or canopy. Any sign painted or applied to the face, valance, or side panels of an awning/canopy /marquee. A retractable structure extended before a window, door, over a patio, or deck as protection from the sun or rain. A non - retractable structure on a framework sheltering an area or forming a sheltered walk to the entrance of a building. Any sign that is not permanently affixed to a building, structure, or the ground; a sign designed to be moved from place to place. These signs primarily include, but are not limited to, signs attached to wood or metal frames designed to be self - supporting, and movable; paper, cardboard, or canvas signs wrapped around supporting poles. A sign completely or principally self - supported by posts or other supports independent of any building or other structure and anchored in or upon the ground. Any sign which contains an intermittent or flashing light source, or which includes the illusion of intermittent or f lashing light by means of animation, or an externally mounted intermittent light source. c: \winword\design\so719.doc I) Changing Sign: Automatic changing signs such as public service, time and temperature signs, or electronically controlled message centers are classified as changing signs and not as flashing signs. J) Pennant sign: Any sign printed or displayed upon cloth or other flexible material, with or without frames. This includes a group of signs displayed which are attached on a string or cord. K) Flags: A piece of cloth or bunting, attached to a staff, with distinctive colors, patterns, or symbolic devices. L) Festoon lighting. Any group of lights displayed on a string or cord which is permanently attached to the facade.. M) Roof sign: Any sign wholly erected, constructed, or maintained on the roof structure or parapet wall of any building. N) Beacon: A stationary or revolving light which flashes or projects illumination in any manner which is intended to attract or divert attention. 0) Off - Premises Sign: Any sign promoting or advertising a business or service which is not located in the building or on the property in which it is displayed. P) Back -lit Signs: A sign constructed with translucent material that has internal illumination, also called a lit box. Q) Mural Signs: A sign painted directly on a wall. R) Temporary Signs: A sign which is not permanently attached to wall or window. Location of Signs A) Wall signs shall not project more than eight (8) inches from the wall, nor shall it project higher than the bottom of the window sills of the second floor or other second floor architectural features of the building whichever is less. Wall signs shall not extend within two (2) feet of the edge of the wall. Murals are prohibited on front facades. page 3 c: \winword\design\so719.doc B) Projecting signs shall have a minimum vertical clearance of eight (8) feet above the sidewalk. If a building has no front yard setback, projecting signs may extend to no more than one -half (1/2) the sidewalk width. If a building a building is set back from the property line, a projecting sign may extend eight (8) feet from the building wall, but in no case shall it extend more than one -half (1/2) the sidewalk width. Projecting signs can not extend past second floor windows or bottom of any architectural cornice. C) Hanging signs shall be allowed when such signs have a minimum vertical clearance of eight (8) feet and do not extend beyond the awning or canopy projection. D) Awning/Canopy/Marquee signs shall be allowed when such signs are painted or applied flat against the awning/canopy /marquee surface. The actual awning/canopy /marquee shall have a headroom of not less than eight (8) feet and in no case shall it not extend more than one -half (1/2) the sidewalk width. Measurement may be taken from highest point under awning/canopy /marquee. E) Portable signs shall be located in such a manner at they do not impede or restrict pedestrian and /or vehicle traffic. Internally lit message boards are prohibited. F) Freestanding signs shall be placed one (1) foot off property line and placed out of public right -of -way. G) Off - Premises signs are allowed only if the off - premise sign meets ordinance standards. Size of Signs A) Wall signs maximum size shall be based on the following: 1) For every one (1) linear foot of primary or entrance -side building width, two (2) square feet of sign area shall be allowed. 2) Wall signs on secondary, side - street, or alley frontage shall not exceed the size of the wall signs on the primary or entrance -side frontage. 3) Mural Signs shall not be placed on primary facade, only on secondary and/or rear building walls. B) Window signs shall cover no more than 50% of the total glass area of the window on which they are placed. The sign coverage shall be determined by an imaginary square or rectangle that encompasses the window sign graphics. A series of which are separated by frames and supporting material of less than six (6) inches in width shall be considered as a single window for the purpose of computation. page 4 c: \winword\design\so719.doc C) Each face of a hanging sign shall be no more than eight (8) square feet in size (maximum two (2) faces). D) The size of a projecting sign face (2 faces maximum) shall be based upon the linear footage of the front building wall. Maximum area allowed is listed as follows: Up to 30 linear feet of front building wall: 8 square feet per sign face Greater than 30 linear feet, but less than 50 linear feet: 16 square feet per sign face 50 linear feet or greater: 32 square feet per sign face E) Awning/canopy /marquee signs shall not exceed 50% of the total exterior surface of the awning/canopy /marquee. F) Each face of a portable sign shall not exceed eight (8) square feet in area. The base width of a portable sign shall not exceed two (2) feet. (maximum two (2) faces) G) Each face of a freestanding sign shall not exceed thirty -two (32) square feet or eight (8) feet in any one (1) dimension. Overall height from ground to top of sign shall not exceed fifteen (15) feet, with a minimum vertical clearance of eight (8) feet above the ground. Materials Allowed A) Restraint and simplicity is encouraged in the selection of materials. Materials used should be in keeping with the architecture of the building and must conform to all applicable building codes. 1) No fluorescent materials and/ paints shall be allowed, excluding lighting. 2) No paper product (paper, cardboard, posterboard, and construction paper) sign shall be allowed as a permanent sign. 3) Only canvas or cloth awnings are allowed. Lighting Allowed A) Signs may be back -lit or may be illuminated by flood or spot lights, with exception of externally exposed neon type tubing. page 5 c: \winword\design\so719.doc B) When signs are illuminated, the light source must be located or shielded in such a way the glare does not reach the street or adjacent property. Lettering Standards A) Lettering used should be consistent and harmonious with the architecture of the building and surroundings. B) Lettering should be proportional to the relative size of the sign area. C) Lettering should be of a professional quality. Signs Extending into the Public Right -of -Way A) When authorized under the provisions of this ordinance, permanently installed signs may extend beyond private property lines and into the public right-of-way. However, this right is granted only for marquees, canopy signs, awning signs or projecting signs which indicates only the name and/or address of the establishment located on the premises. Prohibited Signs A) Flashing sign. B) Pennant sign. C) Festoon lighting. D) Roof sign. E) Beacon. F) Internally lit awnings /canopies. Quantity of Signs Each building is allowed signage, but subject to the following conditions: Primary (Streetfront) Facade is allowed three non - temporary signs. All business window signs are classified as one sign when calculating signage quantity. page 6 c: \winword\design\so719.doc Secondary (Side and Rear external walls) Facades are allowed one non - temporary sign per side. Temporary Sign Allowed A) Certain temporary signs and attention - getting devices such as banners, pennants, valance, or advertising display constructed of cloth, canvas, light fabric, cardboard, wall board or other light material may be permitted for promoting special community activities, special promotional sales, special events, or activities subject to the following provisions: 1) Seasonal (Holiday) Signs: Christmas Signs are allowed from Nov. 1st to Jan 10th. Any other Seasonal (holiday) Signs are allowed 30 days before and 10 days after the holiday. 2) Special Sale Signs: Displayed for thirty (30) days. After the thirty day period, a different temporary sign may be displayed. 3) Special Event Signs: Same as Special Sale Signs, but if in public right -of -way, then the Village of Lemont must grant permission for the sign, unless removed daily. 4) Temporary signs cannot exceed allotted sign space. Exemptions A) Traffic or other municipal street signs such as railroad crossing signs, legal notices, and such temporary emergency signs as may be authorized by the Village of Lemont. B) Directional, informational, or public service signs not pertaining to private enterprise, excluding public utilities, erected for the convenience of the public, such as signs identifying entrances, exits, parking areas, no parking areas, rest rooms, public telephones, walkways, and similar features of public facilities. C) Public signs and other signs incidental thereto for identification, information, or directional purpose erected or required by governmental bodies, or authorized for a public purpose by any law, statute, or ordinance. page 7 c: \winword\design\.so719.doc D) Temporary signs such as political campaign signs, real estate signs, construction signs, etc., in accordance with the ordinances of the Village of Lemont. E) Professional nameplates not exceeding one (1) square foot in area. F) Residential nameplates, not exceeding two (2) square feet in area indicating the address and occupant of said dwelling. G) Portable or Sandwich signs providing that they meet the standards of this ordinance. Non - Conforming Signs Non - conforming signs need not be replaced unless one or more of the following conditions occur. A) Any sign which does not meet the standards of this ordinance at the time of adoption: 1) Shall not be removed and relocated unless replacement sign conforms with provisions of this ordinance. 2) Shall not be replaced with a new sign unless said new sign conforms with the provisions of this ordinance. 3) Shall not be redesigned unless said redesign conforms with provisions of this ordinance. 4) Shall not be altered in the manner of illumination unless such illumination conforms with provisions of this ordinance. 5) Shall not be transferred or assigned to any other person, entity, corporation, or partnership. B) The sign which no longer serves the purpose for which it was constructed shall be removed by the owner of the building within one (1) month after the termination of its use. C) A non - conforming sign must be removed either when it is damaged by any means to the extent that it is damaged more than 50% of its replacement cost or within six (6) months after there has been a sale, transfer, or assignment of ownership of the business or building which owns the sign. SECTION IV Any policy, resolution or ordinance of the Village or portion thereof which may conflict with any portion of this Ordinance shall be, and it is hereby repealed.
