AN ORDINANCE AUTHORIZING THE EXECUTION OF THE HUNDU TEMPLE OF GREATER CHICAGO ANNEXATION AGREEMENT WHEREAS, the Annexation Agreement has been drafted, a copy of which Is attached hereto and included herein; and WHEREAS, the developers and the legal owners of record of the territory which is the subject of said agreement are ready, willing and able to enter into said agreement and to perform the obligations as required hereunder; and WHEREAS, the statutory procedures provided for in the Illinois Municipal Code for the execution of said Agreement have been fully complied with. F RZLEY, V' ge resident • • HINDU TEMPLE OF GREATER CHICAGO ANNEXATION AGREEMENT THIS AGREEMENT, made and entered into this 2 day of No ►' v e ►o" 19 9 0, been the VILLAGE OF LEMONT, a municipal corporation of the County of Cook, in the State of Illinois (hereinafter referred to as "VILLAGE ") and Hindu Temple of Greater Chicago an Illinois Non - for - Profit Corporation (hereinafter referred to as "Owner "). WITNESSETH: WHEREAS, OWNER is the owner of record of the real estate (hereinafter referred to as "TERRITORY"), the legal description of which is shown on the Plat of Annexation and identified and attached as Exhibit "A" and by this reference made a part hereof; and, WHEREAS, OWNER has submitted to the VILLAGE a Petition for Annexation; and, WHEREAS, OWNER intends the TERRITORY to develop as set forth on the attached site plan; and, WHEREAS, the parties hereto desire the TERRITORY which is contiguous to the VILLAGE to be annexed to the VILLAGE on the terms and conditions hereinafter set forth; and, WHEREAS, OWNER and VILLAGE agree that they will be bound by the terms of this Annexation Agreement; and, WHEREAS, the VILLAGE would extend its zoning, building, health and other municipal regulations and ordinances over the TERRITORY, thereby protecting the VILLAGE from possible undesirable or inharmonious use and development of unincorporated areas surrounding the VILLAGE; and, II ZONING AND LAND USE RESTRICTION Upon the Annexation of the TERRITORY to the VILLAGE, the territory shall be zoned R -2 and shall permit the present and expanded special use as a religious temple and related uses in consideration for annexing the territory the VILLAGE agrees to: a. Adopt a Special Use Ordinance which will include a Temple, Guest Houses used in connection with Temple functions, Ministers Quarters, Auditorium, Community Center, multi -level parking facility, Ganesh Temple Indianization and restaurant to be used exclusively by devotees and in house residents. b. The Temple shall have the right to continue the use of its present well and septic system with the right to connect to the Village water and sewer in the future at the sole option of the Temple, but at current connection rates. c. That there are no annexation fees due from the Temple to the Village of Lemont and that the Temple's attorneys' fees in this matter shall be paid by the Village of Lemont. d. The Village of Lemont will not adopt a Special Assessment Ordinance effecting the subject property without the express written consent of the Owner. III FEES, BUILDING ORDINANCES, PERMITS AND GENERAL MATTER The VILLAGE agrees to accept the present condition of the buildings and improvements on the TERRITORY and agrees that all of such buildings and improvements comply in all respect with the present applicable provision of the VILLAGE building code. The subject property has paved parking lots in its upper portion and gravel parking lots in the lower portion. currently the plans of the Community Center with Marriage Hall is in progress. Village agrees and permits the present usage of the facility as is; and also will allow the usage of the Community Center with Marriage Hall with the gravel based parking lot. After completion of the INDIANISATION of the Community Center, the owner will complete paving of the parking lots. • • • V TERMS OF THIS AGREEMENT This Agreement shall be binding upon all parties hereto, their respective successors and assigns for the maximum period of time permitted by law.
