O-572-87 11/23/87ORDINANCE NO. 5/ ORDINANCE AMENDING THE VILLAGE OF LEMONT BUILDING CODE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, County of Cook, that the BOCA National Building Code as previously adopted is thereby amended to include the following: Section 1. GRADING PLAN With application for a building permit to construct or relocate a principal building or an accessory building greater than 576 sq. ft. on a lot, a certified grading plan must be submitted to the Community Development Department for review. The grading plan must have the stamp and signature of a registered professional engineer. The plan must be drawn in accordance with an accurate boundary line survey and show to scale the size and location of all the new construciton and all existing structures on the site, distances from lot lines, established street grades, proposed elevations for top of foundation and grade, elevation of adjacent lots and tops of existing foundations, drainage swales and drainage break points, and location and elevation of utility structures. In an already approved engineered subdivision, an individual lot grading plan would not be required to be submitted with a building permit application for a principal building, provided that the proposed principal building will be constructed in accordance with the engineered subdivisions plans. Section2. FOUNDATION CERTIFICATION After the foundation has been installed and prior to construction of flooring or walls, a Building Spot Survey shall be performed. The Building Spot Survey shall certify that the foundation walls have been installed in accordance with the grading plans and Village Building Setback requirements. • • The Building Spot Survey shall be certified by a registered land surveyor or registered professional engineer, and submitted to Lemont's Department of Community Development for approval to continue construction. Section 3. FINAL SURVEY Prior to the issuance of a certificate of occupancy, the builder /owner shall be required to submit two (2) copies of an accurate boundary line survey for the lot, indicating the following. A. Existing top of foundation grade. B. Existing lot corner elevations. C. Existing finished grade elevation at the four (4) corners of the home. D. Existing elevation of all drainage break points and drainage arrows within the lot. E. Existing location and elevation of all utility structures on the lot. F. Stamp and signature of a registered land surveyor or a registered professional engineer, indicating the following statement: "The final grading of the lot has been completed and fully complies with the engineering plans submitted for the lot." Section 4. LANDSCAPING All lot areas including parkway area on Village right -of -way not improved with driveway or building structures shall be seeded, sodded, or landscaped prior to a final occupancy permit being issued. A landscape permit must be obtained by the landscaping contractor or owner prior to final grading and the installation of sod or seed on a lot. If seeding or sodding is not completed at occupancy, the contractor or owner may apply for a temporary occupancy permit. Section 5. TEMPORARY OCCUPANCY PERMIT A temporary occupancy permit may be issued without the filing of the final survey or landscaping as provided in Section 2 and 3 of this Ordinance upon the filing of the following: A. A written statement of the incompleted work necessary to bring the construction site into full compliance with the final engineering plans, the date the structure is to be occupied and the name, address, and telephone number of the prospective occupant, said statement to be signed by both the contractor and the property owner and /or contract purchaser and duly acknowledge and attested by a notary public. B. Two (2) copies of a spot survey shall be submitted by the builder indicating the following: 1. Existing top of foundation grade. 2. Existing and proposed lot corner elevations. 3. Existing and proposed finished grade elevations at the four (4) corners of the home. 4. Existing and proposed elevations of all drainage break points and drainage arrows within the lot. 5. Existing location and elevation of all utility structures on the lot. 6. Stamp and signature of a registered land surveyor or a registered professional engineer. C. A written statement signed by both the contractor and the property owner and /or contract purchaser that it would create a hardship to require the filing of the required survey or statement prior to issuance of an occupancy permit because inclement weather has prevented the necessary grading, or the contractor has been unable to obtain an Illinois registered land surveyor or registered professional engineer to prepare the required survey or statement. D. Except as otherwise provided herein, a temporary occupancy permit shall be effective for a period of sixty(60)days. A temporary occupancy permit issued between November 15 and April 15 shall be effective until the next following fifteenth day of June if the applicant includes a statement in his application that the necessary work cannot be completed within sixty(60)days due to adverse weather conditions. E. A temporary occupancy permit shall not be renewed or reissued except by a motion and approval of the Village Board upon a showing of reasonable excuse for the applicant's failure to complete the nec- essary work within the effective period of the permit. F. Occupancy of any new or relocated building without an occupancy permit is a violation. Section 6. FEES Landscaping permit fees shall be $15.00. Landscaping contractors 4 shall be licensed with the Village of Lemont as subcontractors. Village Engineer fees shall be paid by the contractor or owners for any necessary review of plans or site inspections. Section 7. VIOLATION PENALTIES Any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to comply with, or who resists enforcement of any of the provisions of this Ordinance shall upon conviction be fined not less that $25.00 and no more than $500.00 for each offense. Each day that a violation is permitted to exist shall constitute a separate offense.
