ORDINANCE AMENDING CHAPTER 11, "WATER," ARTICLE III.
METERS: RATES. SECTIONS 11.305, 11.306, 11.307
WHEREAS, the Village of Lemont has reviewed the current billing and
operating provisions of the Water Department; and
WHEREAS, the Sewer and Water Committee, after thorough investigation
and study, has proposed to change the method of billing for water services.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Lemont, Illinois as follows:
That the Municipal Code of the Village of Lemont dated 1964, Chapter 11,
"Water," Article III. Meters: Rates. Sections 11.305, 11.306, 11.307 (as
amended) is hereby further amended to read as follows:
11.305 Rates
The water rates or charge for all property upon which any building has
been or may be hereafter erected having a connection with the Village water
system shall be based upon the amount of water consumed as indicated by the
water meters in accordance with the following schedule and rates:
1. Water service for each two month period starting on February 1, 1988,
shall be as follows:
A. Single family residence $20.00 minimum charge plus $2.50 per 1,000
gallons for each 1,000 gallons in excess of 4,000 gallons.
B. Single business building $20.00 minimum charge plus $2.50 per 1,000
gallons for each 1,000 gallons in excess of 4,000 gallons.
C. Multiple family residence $15.00 minimum charge per dwelling unit
plus $2.50 per 1,000 gallons for each 1,000 gallons in excess of
a 4,000 gallon allowance per dwelling unit.
D. Multiple business building $15.00 minimum charge per business unit
plus $2.50 per 1,000 gallons for each 1,000 gallons in excess of
a 4,000 gallon allowance per business unit.
E. Residential- Business building $15.00 minimum charge per residential
or business unit plus $2.50 per 1,000 gallons for each 1,000 gallons
in excess of a 4,000 gallon allowance per residential or business
unit.

2. For the purpose of this ordinance, the following definitions will apply.
A. A single family residence means a building containing one dwelling
unit.
B. Multiple family residence means a building containing two or more
dwelling units.
C. Business means a proprietorship, partnership, corporation, association
(profit or non - profit) or State, County, Township or Municipal entity
which provides services, labor, manufactured goods, equipment, mer-
chandise, edibles or consumer goods in return for compensation or
for the good of the general public. A single business building contains
one business. A multiple business building contains two or more
businesses.
D. A Residential- Business building is a building having at least on
dwelling unit and at least one business unit.
11.306 Bills
A. Bills for water used shall be sent out every two (2) months.
B. All bills for water used shall be in the name of the property or
building owner.
C. The net amount of all water bills are due and payable in full upon
receipt of said bill. Any bill paid after the 20th day of the billing
month will have a ten percent (10 %) late charge added to the bill
amount.
D. There shall be a Senior Citizen homeowner discount of fifty percent
(50 %) of the minimum charge on their water bill. Any amount which
exceeds the minimum will be paid at the same rate and schedule as
all other water customers. The discount is only applicable to the
dwelling unit in which the senior citizen resides. To obtain the
discount, the Senior Citizen must present to the Village Collector
proof of the following.
1. his or her age being 65 or older;
2. ownership of the property;
3. residency on the property.
11.307 Non - Payment
A. In the event the owner of any dwelling unit or building fails to
pay the water bill or any portion including delinquent charges within
30 days after the charges therefor become due and owing, it shall
be the duty of the Director of Public Works to shut off the water
service to the building provided proper notice is given to the owner.
B. Before the Director of Public Works can shut off the water services,
the owner of the dwelling unit or units must be properly notified.
The notice must be sent by registered mail, return receipt requested,

at least eight (8) days prior to the actual date of shutoff of services
to the owner. The notice must state the reason for the shutoff and
the date the shutoff will occur, as well as, charges for the resump-
tion of the services after the services have been discontinued on
account of such default. The notice must also give information about
the right of appeal and procedure for pursuing such appeal.
C. Appeals of the shutoff of services shall be taken to the Sewer and
Water Committee of the Lemont Village Board. If the owner of the
land wishes to appeal the shutoff of services, he must so notify
the Director of Public Works in writing before the actual shutoff
date. If the owner notifies the Director of Public Works in writing,
the director shall place the owner on the agenda for the next regularly
scheduled committee meeting at which time the Sewer and Water Committee
of the Lemont Village Board shall decide whether or not all or part
of the water services shall be shut off until the final determination
is made by the Sewer and Water Committee of the Lemont Village Board.
D. When any service is shut off it shall not be renewed except upon
payment of all amounts in arrears and a ten dollar ($10) turn -on
fee is paid. Any water supply which has been shut off due to delin-
quent payment of bills will be turned on only between the hours of
7:30 a.m. and 4:00 p.m.
Repeal of Conflicting Ordinance. This ordinance shall be in full force and
effect from and after its passage, approval and publication in the manner
provided by law. All ordinances or parts of ordinances in conflict herewith
shall be and the same are hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption
of this Ordinance and cause the same to be published in pamphlet form.
