NUISANCE ORDINANCE NO. 5V B
WHEREAS, the Illinois General Assembly has expanded the scope
of Municipal powers relating to inoperable motor vehicles located
on private property; and
WHEREAS, Chapter 24, Section 11 -40 -3 now permits a
Municipality, by Ordinance, to declare all inoperable motor
vehicles on public and private property in view of the general
public to be a nuisance.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Lemont as follows:
SECTION 1: That inoperable motor vehicles, whether on public
or private property and in view of the general public are hereby
declared to be a nuisance. An inoperable vehicle or any part
thereof, shall be authorized for removal by the Village Police
Department after seven (7) days notice sent to the owner of the
vehicle or under a persons control. However, nothing in this
Section shall apply to any motor vehicle that is kept within a
building when not in use, to operate historic vehicles over 25
years of age, or to a motor vehicle on the premises of a place of
business engaged in the wrecking or junking of motor vehicles.
SECTION 2: As used in this Ordinance, "inoperable motor
vehicle" means any motor vehicle from which, for a period of at
least seven (7) days, the engine, wheels or other parts have been
removed, or on which the engine, wheels or other parts have been
altered, damaged or otherwise so treated that the vehicle is
incapable of being driven under its own motor power. "Inoperable

motor vehicle" shall not include a motor vehicle which has been
rendered temporarily incapable of being driven under its own motor
power in order to perform ordinary service or repair operations.
SECTION 3: All vehicles towed by order of the Police
Department and authorized by Illinois Revised Statutes Chapter 24,
Section 11 -40 -3, shall be towed to Village storage facilities and
shall not be released until proof of payment of towing and storage
charges. Storage charges at Village owned facilities shall be
Twenty Five Dollars ($25.00) for each twenty four hour period or
part thereof.
SECTION 4: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner
provided by law.
SECTION 5: All ordinances or parts of ordinances in conflict
herewith shall be and the same are hereby repealed.
SECTION 6: The Village Clerk of the Village of Lemont shall
certify to the adoption of this Ordinance and cause the same to be
published in pamphlet form.
