AN ORDINANCE AMENDING THE GATEWAY TAX
INCREMENT REDEVELOPMENT PROJECT AND PLAN FOR
THE GATEWAY REDEVELOPMENT PROJECT AREA OF
THE VILLAGE OF LEMONT, ILLINOIS BY CLARIFYING
THE LEGAL DESCRIPTION THEREOF, THE TAX PARCELS
THEREIN, AND THE MAP THEREOF
WHEREAS, pursuant to a series of ordinances (Nos. 0- 05 -09, 0 -06 -09 and 0- 07 -09)
passed January 19, 2009 and Ordinance No. 0 -12 -09 passed January 26, 2009 (collectively the
"TIF Ordinances ") in connection with Gateway Redevelopment Project Area (the
"Redevelopment Project Area "), the Village of Lemont, Illinois (the "Village ") adopted the
redevelopment plan and the redevelopment project (the "Redevelopment Plan" and
"Redevelopment Project "), designated the Redevelopment Project Area, and authorized tax
increment financing ( "TIF ") under the Tax Increment Allocation Redevelopment Act, 65 ILCS
5/11- 74.4 -1 et seg., (the "TIF Act "); and
WHEREAS, the legal description of the Redevelopment Project Area, the tax parcels
therein and the map thereof need to be clarified in order to resolve any ambiguities in the nature
and extent thereof; and
WHEREAS, the amended Redevelopment Project Area, the tax parcels therein and the
map thereof effect changes which do not (1) add additional parcels of property to the proposed
redevelopment project area, (2) substantially affect the general land uses proposed in the
redevelopment plan, (3) substantially change the nature of the redevelopment project, (4)
increase the total estimated redevelopment project cost set out in the redevelopment plan by
more than 5% after adjustment for inflation from the date the plan was adopted, (5) add
additional redevelopment project costs to the itemized list of redevelopment project costs set out
in the redevelopment plan, or (6) increase the number of inhabited residential units to be
displaced from the redevelopment project area, as measured from the time of creation of the
redevelopment project area to a total of more than 10; and
WHEREAS. the amendment proposed by this ordinance may be passed and implemented
by the Village without any prior notice or hearing to the Joint Review Board for the
Redevelopment Project Area.
NOW, THEREFORE, BE IT ORDAINED by the Village President and Board of
Trustees of the Village of Lemont, Counties of Cook, DuPage and Will. State of Illinois, as
follows:
Section 1. Amendment. The Redevelopment Plan is hereby amended such that the
legal description for the Redevelopment Project Area, the tax parcels in the Redevelopment
Project Area, and the map of the Redevelopment Project Area shall be, and hereby are, as set
forth on Exhibits A, B and C, respectively, attached hereto.
Section 2. Notice. A copy of this ordinance shall be mailed no later than 10 days
after passage to each affected taxing district and any registrant on the interested parties registry.
Section 3. Publication. -- A copy of this ordinance- shall -be published no later than 10
days after passage to in a newspaper of general circulation within the Village.
Section 4. Filing. A certified copy of this ordinance shall be filed with the County
Clerk of Cook County.
Section 5. Conflict. All ordinances (including the TIF Ordinances). the
Redevelopment Plan and the Redevelopment Project. or parts thereof, in conflict herewith be and
the same are hereby repealed to the extent of such conflict.
Section 6. Effective Date. This ordinance shall be in full force and effect from and
after its passage and approval.

AN ORDINANCE AMENDING THE GATEWAY TAX
INCREMENT REDEVELOPMENT PROJECT. AND PLAN FOR
THE — GATEWAY REDEVELOPMENT PROJECT AREA OF
THE VILLAGE OF LEMONT, ILLINOIS BY CLARIFYING
THE LEGAL DESCRIPTION THEREOF, THE TAX PARCELS
THEREIN, AND THE MAP THEREOF
WHEREAS, pursuant to a series of ordinances (Nos. 0- 05 -09, 0 -06 -09 and 0- 07 -09)
passed January 19, 2009 and Ordinance No. 0 -12 -09 passed January 26. 2009 (collectively the
"TIF Ordinances ") in connection with Gateway Redevelopment Project Area , (the
"Redevelopment Project Area "), the Village of Lemont, Illinois (the "Village ") adopted the
redevelopment plan and the redevelopment project (the "Redevelopment Plan and
"Redevelopment Project "), designated the Redevelopment Project Area, and authorized tax
increment financing ( "TIF ") under the Tax Increment Allocation Redevelopment Act, 65 ILCS
5/11- 74.4 -1 et seq., (the "TIF Act "); and
WHEREAS, the legal description of the Redevelopment Project Area, the tax parcels
therein and the map thereof need to be clarified in order to resolve any ambiguities in the nature
and extent thereof; and
WHEREAS, the amended Redevelopment Project Area. the tax parcels therein and the
map thereof effect changes which do not (1) add additional parcels of property to the proposed
redevelopment project area, (2) substantially affect the general land uses proposed in the
redevelopment plan, (3) substantially change the nature of the redevelopment project, (4)
increase the total estimated redevelopment project cost set out in the redevelopment plan by
more than 5% after adjustment for inflation from the date the plan was adopted, (5) add
additional redevelopment project costs to the itemized list of redevelopment project costs set out
in the redevelopment plan, or (6) increase the number of inhabited residential units to be
displaced from the redevelopment project area, as measured from the time of creation of the
redevelopment project area to a total of more than 10; and
WHEREAS. the amendment proposed by this ordinance may be passed and implemented
by the Village without any prior notice or hearing to the Joint Review Board for the
Redevelopment Project Area.
NOW, THEREFORE, BE IT ORDAINED by the Village President and Board of
Trustees of the Village of Lemont, Counties of Cook, DuPage and Will. State of Illinois, as
follows:
Section 1. Amendment. The Redevelopment Plan is hereby amended such that the
legal description for the Redevelopment Project Area, the tax parcels in the Redevelopment
Project Area, and the map of the Redevelopment Project Area shall be, and hereby are, as set
forth on Exhibits A, B and C, respectively, attached hereto.
Section 2. Notice. A copy of this ordinance shall be mailed no later than 10 days
after passage to each affected taxing district and any registrant on the interested parties registry.
- Section 3. Publication. A copy of this ordinance shall be published no later than 10
days after p assage to in a newspaper of general circulation within the Village.
Section 4. Filing. A certified copy of this ordinance shall be filed with the County
Clerk of Cook County.
Section 5. Conflict. All ordinances (including the TIF Ordinances), the
Redevelopment Plan and the Redevelopment Project, or parts thereof, in conflict herewith be and
the same are hereby repealed to the extent of such conflict.
Section 6. Effective Date. This ordinance shall be in full force and effect from and
after its passage and approval.
