ORDINANCE NO. L ( COMMUTER PARKING Section 1. Designation. This Ordinance shall apply to all Village parking lots designated as "Commuter Parking." The following areas are designated as commuter parking locations and may be so designated by the Village Board by posting adequate notice in such locations of said designation: a) The North side of the Illinois Central Gulf Railroad tracks (as depicted on the attached map). b) Under the high -rise bridge. Daily Parking meters are located on the West side of State Street. c) The South side of the Illinois Central Gulf Railroad tracks (as depicted on the attached map). Section 2. Issuance and Sale of Permits. a) Suitable window permits shall be prepared and made available for issuance and sale. The aggregate number of permits prepared, available and designated for any specific permit lot at any one time shall not exceed the number of parking spaces available for parking vehicles in such lot (or such portion thereof.) Notwithstanding anything in this Ordinance to the contrary, the number of permits sold shall not exceed the number of parking spaces actually available for parking of vehicles in such lot (or such portion thereof) unless the Village Board determines, on the basis of surveys of parking space vacancy rates and other relevant • • criteria, that the sale of an additional amount of parking permits is justified, in which event, an additional amount of parking permits may also be sold at the direction of the Village Board. Permits shall be issued and sold for a one month period commencing March 1, 1989. Permits for each month shall be designed by different colors or in some other manner approved by the Village Administrator. b) Under the direction of the Village Administrator, permits shall be offered for sale during regular business hours at the Village offices in advance of the commencement of each such one month period and shall be sold to applicants in accordance with the chronological priority of applications for such permits, subject to the following: At the discretion of the Village Administrator, permit renewal notices may be mailed to existing permit holders, and renewal permits may be issued and sold to such permit holders, in advance of the time when such permits are made available for sale at the Village offices. c) The fee for each such permit, for each month shall be $15.00. Such fee shall be reduced, based on a daily proration of the number of days that have expired prior to the date of sale of such permit card. d) The fee for daily designated parking spaces shall be $1.00 per day. The payment of such fee shall be paid in advance by depositing said sum in a designated depository. e) Notwithstanding any contrary provision in this division, the Village Administrator shall be authorized to refuse to issue any such permit, or renewal thereof, to any permit holder who is convicted of more than three violations of any of the provisions of this division within any consecutive period of six months. Section 3. Marking Parking Spaces; Parking and Movement Requirements. Suitable markings approved by the Village Administrator shall be painted or placed upon the pavement, curb, street or other location for the purpose of designating parking spaces within each permit parking lot. Each vehicle parked within any permit parking lot shall be parked wholly within such markings. Parking in areas marked "no parking" or in any other manner that will interfere with traffic into, through or out of a permit parking lot shall be unlawful. Vehicles shall travel only in directions indicated by traffic arrows or signs and shall not exceed a speed of ten miles per hours. Section 4. Violations. It shall be unlawful for any person: a) To park or let stand any vehicle in any parking space in any permit parking lot at any time between the hours of 6:00 A.M. and Midnight, local time, on any day, except Saturdays and Sundays, unless such vehicle shall have attached to the inside surface of the lower left -hand corner of the rear window thereof a currently valid permit issued by the Village for such permit parking lot. b) To park or let stand any vehicle across or upon any marking designating a parking space in a permit parking lot; or c) To park or let stand any vehicle in a parking space in a permit parking lot in such manner that the front of such vehicle is directed away from the curbing or other wheel barrier provided for such parking space; provided, that the provisions of this • • subsection shall not apply to any parking unless there shall be posted in conspicuous places in the vicinity of such parking space appropriate signs stating the restriction imposed by this subsection. The restrictions imposed by subsection (a) of this section shall be inapplicable with respect to any metered parking space that may be established from time to time in any permit parking lot, provided, that the parking or standing of vehicles in any such metered parking space shall otherwise be subject to the restrictions imposed by other sections of this Ordinance for such metered parking space. d) Any vehicle parked in violation of the provisions of this Ordinance may be towed away by or at the order of the Police Department and impounded until payment in full of all reasonable costs and expenses incurred in connection with such towing and storage of such vehicle, as well as any fines authorized by this Chapter. Section 5. Compromise Payments and Penalties. a) Any person charged with a violation of this Ordinance may settle and compromise such charge by paying to the village, within fourteen days after the time of the police department citation alleging such offense, a sum of ten dollars. If such penalty or compromise payment has not been made prior to the expiration of fourteen days, the police department shall cause to be mailed, by first class U.S. mail, addressed to the last known address of the registered owner of the vehicle involved in the offense so charged, a final notice referring to the offense so charged. At any time 1 prior to the expiration of the fourteen days from the date of mailing of such final notice, any person charged with a violation of this Ordinance may settle and compromise such charge by paying to the Village the amount of the fine established herein together with an additional sum of three dollars for each offense so charged. All such compromise payments may be made at the Village police station and receipts shall be issued by the police department for all payments so received; all such payments shall be promptly delivered to the Village Treasurer and credited to the commuter parking account of the Village. In each case in which such compromise payment is made, the police department is authorized to waive further prosecution of such alleged violation. b) Any person found guilty of a violation of this Ordinance shall be subject to a fine of not less than ten dollars nor more than one hundred dollars for each such violation. Section 6. That all Ordinances or parts of Ordinances in conflict herewith are to the extent of such conflict repealed. Section 7. That each section, sentence, paragraph, clause and provision of this Ordinance is separable, and if any provision is held unconstitutional or invalid for any reason, such decision shall not affect the reminder of said Ordinance, nor any part thereof, other than that part affected by such decision. Section 8. That this Ordinance shall be in full force and effect from and after its passage and due publication according to law.
