ORDINANCE AMENDING ZONING ORDINANCE
SECTION VII RESIDENCE DISTRICTS
WHEREAS, the President and Board of Trustees of the Village
of Lemont have requested the Lemont Plan Commission to review the
Residence District classifications under the current Zoning
Ordinance, and
WHEREAS, the Lemont Plan Commission, pursuant to notice and
publication, held its first public hearing on January 18, 1989 and
continued from time to time to allow comments by Village staff and
general public, and
WHEREAS, the Lemont Plan Commission, after thorough review
and study, has recommended various changes to Ordinance Number 426,
Section VII Residence Districts.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTY OF COOK, that Ordinance
Number 426 entitled "Lemont Zoning Ordinance of 1980, Lemont,
Illinois dated March 10, 1980" specifically "Section VII Residence
District" be repealed and in its place the following shall be
adopted:
SECTION VII
RESIDENCE DISTRICTS
A. RESIDENCE DISTRICT PROVISIONS
Unless otherwise provided in the regulations of this ordinance, the following
provisions shall apply to all residence districts:
1. Nameplates and Signs
a. Nameplates shall be permitted in accordance with the following regu-
lations:
(1)
For single - family attached and detached dwellings and two -
family dwellings -- one nameplate, not to exceed 120 square
inches in area for each dwelling unit, indicating the name
and address of the occupant. For multiple - family dwellings
-- one nameplate not to exceed four square feet in area
provided such nameplate shall contain only the name and
address of the building and may contain also the name, address
and telephone number of the management thereof.
(2) Such nameplates may be affixed flat against the building, or
may also be located in a yard adjoining a street, provided
they are not nearer to the street than one -half of the depth
of the yard and do not exceed four feet in height.
(3) Nameplates may be illuminated by non - flashing direct or in-
direct illumination from a source of artificial lighting
customarily accessory to residential uses.
b. "For Sale" and "For Rent" signs appertaining to the sale or rental
of property on which they are located shall be permitted in accordance
with the following regulations:
There shall be not more than one sign on a lot except on a
corner lot or through lot, one such sign facing each street shall
be permitted. Said sign shall not have artificial illumination,
Shall not have more than 12 square feet of.area, and it
shall be located not less than eight feet from the nearest
interior lot line. Such a sign when affixed to a building wall
shall not project higher than ten feet above grade and a ground
sign shall not project higher than five feet above the ground
grade elevation below it.
c. Identification for non - resident uses shall be permitted in accord-
ance with the following regulations:
One identification sign affixed flat against a building wall
and one ground sign which in both cases may be illuminated by
non - flashing direct or indirect illumination arranged in a

manner that direct rays of light are not beamed onto
adjoining lots and streets, shall be permitted, and on a
corner or through lot, one additional such sign shall be
permitted facing the side street of a corner lot or the
street adjoining the rear lot line of a through lot. Each
sign shall contain not more than 16 square feet of area and
when (1) affixed to a building wall, it shall not project higher
than ten feet above floor grade at entrance doorways, and
(2) a ground sign shall not be located nearer than eight feet
from the nearest interior lot line and not less than one -
half the depth of the required yard from the nearest lot line
adjoining a street and it shall not project higher than ten
feet above ground grade elevation at the sign.
d. Temporary signs for unified housing developments are permitted in
accordance with the following:
In a unified housing development containing more than 12
dwelling units, one sign may be erected along each street
frontage of the development. Such sign may be a ground
sign or be attached to a building, and it shall contain not
more than 180 square feet of gross surface area, provided
that such sign: (1) may be illuminated with non - flashing
illumination provided direct rays of light are not beamed
onto adjacent lots or streets; (2) shall not project higher
than 30 feet above grade; (3) shall not be located nearer
than 15 feet from the property line abutting a street, except
it shall not be nearer than 50 feet from the lot corner formed
by the intersection of any two street right -of -way lines and
not nearer than 20 feet from the lot line of an adjacent lot;
and (4) shall be removed within three months after completion
of construction of the development, or one year after the
first dwelling unit is occupied, whichever is sooner.
2. Home Occupations
In all residence districts, any customary home occupation shall be
permitted provided:
a. it is conducted entirely within the dwelling and only by the
occupants of the dwelling and only when such home occupation is
incidental and secondary to the use of the dwelling for dwelling
purposes;
b. it is not conducted from a detached or attached garage or any
accessory building nor does it require internal or external
alteration, or involve construction features or use of equipment
not customary in a dwelling or an office, the entrance to the
space devoted to such occupation shall be from within the dwelling,
and not more than one - fourth of the floor area of a story, including
also the attic or basement, of the dwelling is devoted to such
home occupation;

c. there is no display or activity that will indicate from the
exterior of a dwelling that it is being used in whole or in part
for any use other than a dwelling, except one nameplate, not more
than one square foot in area which contains only the name of the
occupant of the dwelling and the home occupation conducted therein
and is attached to the dwelling and not illuminated,shall be permitted;
d. stock in trade, including that which is produced on the premises,
shall not require receipt or delivery of merchandise, goods, or
equipment other than by United States letter carrier mail,
similar parcel delivery service or by private passenger automobile;
e.
there can be no operation of any wholesale or retail business un-
less conducted entirely by mail and does not involve the sale,
receipt or delivery, of merchandise on the premises;
f. there can be no manufacturing or processing of goods, materials
or products;
g.
academic or religious instructions may be given to not more
than three persons at the same time, and other instructions may be
given to not more than one person at the same time.
B. R1 SINGLE - FAMILY DETACHED RESIDENCE DISTRICT
1. Permitted Uses
a. Single - family detached dwellings (including Log home, Earth Shelter
home, or Dome home).
b. Agriculture on a tract of land 5 acres or more in area.
c. Truck and flower gardening, nurseries, orchards, and greenhouses
for commercial purposes on lots containing not less than 5 acres of land.
d. Roadside stand on lots containing not less than 5 acres of land where
the principal use is agriculture, the sale of trees, shrubs, flowers,
vegetables, fruit, poultry and poultry products or other farm
products, all of which are grown or raised on said lot.
e. Public land and buildings
(1) Libraries - public
(2) Parks, playgrounds, forest preserves, and recreational
areas — public.
(3) Schools, public elementary, junior high and high schools.
f. Home occupations.

Temporary buildings for construction purposes for a period not
to exceed such construction.
h. Accessory uses.
2. Special Uses
a. Cemeteries and mausoleums, excluding crematories -- on a lot not
less than ten acres in area and provided no building shall be
located less than 300 feet from a lot line.
b. Colleges, universities and accessory uses thereto -- on a lot not
less than 20 acres in area and provided no building is located less
than 200 feet from a lot line.
c. Church, chapels, synagogues and temples.
d. Day care center.
e. Golf courses, standard; but not including "par 3" golf courses,
commercially operated driving ranges, or miniature golf courses,
and provided that no club house or accessory building shall be
located less than 200 feet from a lot line.
f. Hospitals -- on a lot not less than ten acres in area and provided
no building shall be located less than 200 feet from a lot line.
g.
Planned developments -- residential.
h. Private clubs, recreational areas, or camps, when not operated
for profit -- on a lot not less than five acres in area and
provided no building or structure shall be located less than 200
feet from a lot line.
i. Riding academies operated on a commercial basis.
J. •
Public utility and governmental service uses on lots having areas,
widths, yards, and other conditions as approved by the Village
Board.
(1) Electric substations and booster stations.
(2) Filtration plants, pumping stations, water reservoirs, and
wells.
(3) Gas regulator stations.
(4) Police and fire stations.
(5) Railroad rights -of -way and passenger stations, but not
including classification yards, terminal facilities, or
maintenance facilities.
(6) Sewage treatment plant.
(7) Telephone exchange and micro -wave relay towers.
(8) Other governmental uses.
k. Schools - private.
1. Seminaries, convents, monasteries, and similar religious
institutions on a lot not less than five acres in area and
provided no building or structure shall be located less than
100 feet from a lot line.
m. Tourist homes having not more than three rooms for transient guests.
n. Unique uses as provided by Section XII, Subsection 1 Special Uses.
3. Lot Area
a. Single - family detached dwellings -- not less than three acres.
b. Other permitted uses -- not less than three acres unless otherwise
specified.
4. Lot Width
a. Single - family detached dwellings . -- not less than 250 feet at the
building line.
b. Other permitted uses -- not-less than 300 feet at the building line.
5. Building Height
a. Single - family detached dwellings -- not more than two and one -half
stories or 35 feet, whichever is lower.
b. Other permitted uses -- not more than three stories or 40 feet,
whichever is lower.
6. Floor Area Ratio
a. Single- family detached dwellings -- not applicable.
b. Other permitted uses -- not more than 0.2.
7. Yards
Except as may be herein otherwise required, yards shall be in accordance
with the following regulations:

a. For Single - family detached dwellings:
(1) Front yard - not less than 50 feet.
(2) Side yards - two side yards each not less than 50 feet
in width.
(3) Rear yard - not less than 50 feet.
b. For other permitted use:
(1) Front yard - not less than 50 feet.
(2) Side yards - two side yards each not less than 50 feet in
width, and for structures more than 100 feet in length,
measured perpendicular to the front lot line, the interior
side yards shall be increased in depth by 1 foot for each
two feet the building exceeds 75 feet in length.
(3) Rear yard - not less than 50 feet.
8. Off - Street Parking and Off- Street Loading
In accordance with regulations set forth in Section X.
C. R2 SINGLE- FAMILY DETACHED RESIDENCE DISTRICT
1. Permitted Uses
a. As listed in the R1 District, except Single - family detached dwellings
of unusual design, ie Log Home, Dome Home, Earth Shelter Home, requires
a special use permit.
2. Special Uses
a. As listed in the R1 District.
b. Single - family detached dwelling of unusual design, ie Log Home,
Dome Home, Earth Shelter Home.
3. Lot Area
Residential - not less than 40,000 square feet.
Other permitted uses - not less than 60,000 square feet.
4. Lot Width
Residential - not less than 150 feet at the building line.
Other permitted uses - not less than 150 feet at the building line.
5. Building Height
a. Single - family detached dwellings - not more than two and one -half
stories or 35 feet, whichever is lower.
b. Other permitted uses - not more than 3 stories or 40 feet, whichever
is lower.
6. Floor Area Ratio
a. Single - family detached dwellings - not applicable.
b. Other permitted uses - not more than 0.4.
7. Yards
Except as may be herein otherwise required, yards shall be in accordance
with the following regulations:
a. Single - family detached dwellings:
(1) Front yard - not less than 50 feet.
(2) Side yards - two side yards each not less than 25 feet in width,
except on corner lots, the side yard adjoining a street shall
not be less than 50 feet in width.
(3) Rear yard - not less than 50 feet.
b. Other permitted use:
(1) Front yard - not less than 50 feet.
(2) Side yards - two side yards each not less than 40 feet in width,
except on corner lots, the side yard adjoining a street shall
not be less than 50 feet in width, and for structures more than
75 feet in length, measured perpendicular to the front lot line,
the interior side yards shall be increased in depth by 1 foot
for each two feet the building exceeds 75 feet in length.
(3) Rear yard - not less than 50 feet.
8. Off - Street Parking and Off- Street Loading
In accordance with regulations set forth in Section X.
D. R3 SINGLE - FAMILY DETACHED RESIDENCE DISTRICT
1. Permitted Uses
a. As listed in the R2 District.

a. Single - family detached dwellings - not less than 20,000 square feet.
b. Other permitted uses - not less than 40,000 square feet unless
otherwise specified.
c. If both an individual sewage disposal system and an individual
water supply system are used to serve the same lot, a minimum lot area
of 40,000 square feet is required.
4. Lot Width
a. Single - family detached dwellings - not less than 100 feet at the
building line.
b. Other permitted uses - not less than 150 feet at the building line.
5. Building Height
a. Single - family detached dwellings - not more than two and one -half
stories or 35 feet, whichever is lower.
b. Other permitted uses - not more than three stories or 40 feet,
whichever is lower.
6. Floor Area Ratio
a. Single - family detached dwellings - not applicable.
b. Other permitted uses - not more than 0.4.
7. Yards
Except as may be herein otherwise required, yards shall be in accordance
with the following regulations:
a. Single - family detached dwellings:
(1) Front yard - not less than 40 feet.
(2) Side yards - two side yards each not less than 15 feet in
depth, except on corner lots, the side yard adjoining a street
shall not be less than 40 feet in width.
(3) Rear yard - not less than 40 feet.
b. Other permitted uses
(1) Front yard - not less than 40 feet.

(2) Side yards - two side yards each not less than 30 feet in
width, except on corner lots, the side yard adjoining a
street shall not be less than 40 feet in width. For
structures more than 75 feet in length, measured perpen-
dicular to the front lot line, the interior side yards shall
be increased in depth by 1 foot for each two feet the building
exceeds 75 feet in length. Also for buildings more than 35
feet in height, each side yard and rear yard shall be increased
in width or depth by 1 foot for each additional two feet of
building height over 35 feet.
(3) Rear yard - not less than 40 feet.
8. Off - Street Parking and Off- Street Loading
In accordance with regulations set forth in Section X.
E. R4 SINGLE- FAMILY DETACHED RESIDENCE DISTRICT
1. Permitted Uses
As listed in the R2 District.
2. Special Uses
As listed in the R2 District.
3. Lot Area
a. Single - family detached dwellings - not less than 10,000 square feet.
b. Other permitted uses - not less than 30,000 square feet unless
otherwise specified.
c.
If an individual sewage disposal system or an individual water supply
system is used to serve the same lot, a minimum lot area of 20,000
square feet is required. If both an individual sewage disposal and
water supply system is used, a minimum lot area of 40,000 square
feet is required.
4. Lot Width
a. Single - family detached dwellings - not less than 80 feet at the
building line.
b. Other permitted uses - not less than 150 feet at the building line.

a. Single - family detached dwellings - not more than two and one -half
stories or 35 feet, whichever is lower.

a major street.
(3) Rear yard - not less than 30 feet.
b. Other permitted uses
(1) Front yard - not less than 40 feet.
(2) Side yards - two side yards each not less than 25 feet in
width, except on corner lots, the side yard adjoining a street
shall not be less than 40 feet in width. For structures more
than 75 feet in length, measured perpendicular to the front
lot line, the interior side yards shall be increased in width
by 1 foot for each 2 feet the building exceeds 75 feet in
length. For buildings more than 35 feet in height, each side
yard shall be increased in width by 1 foot for each additional
2 feet of building height over 35 feet..

In accordance with regulations set forth in Section X.
F. R5 SINGLE- FAMILY ATTACHED RESIDENCE DISTRICT
1. Permitted Uses
a. As listed in the R -2 District,

a. As listed in the R -2 District.

e. Other permitted uses - not less than 150 feet at the building line.
5. Building Height
a. Single- family detached dwelling, townhouse, duplex, and two -flat -
not more than two and one -half stories or 35 feet, whichever is
lower.
b. Other permitted uses - not more than three stories or 40 feet
whichever is lower.
6. Floor Area Ratio
a. Single- family detached, townhouse, duplex and two - flats: not applicable.
b. Other permitted uses - not more than 0.4.

7. Yards
Except as may be herein otherwise required, yards shall be in accordance
with the following regulations.
a. Single - family detached dwellings:
(1) Front yard - not less than 25 feet. A front yard adjacent to
a major street shall be not less than 40 feet.
(2) Side yards - two side yards each not less than 15 feet in Width,
except on corner lots, the side yard adjoining a street shall
not be less than 25 feet in width and 40 feet in width adjoining
a major street.
(3) Rear yard - not less than 30 feet.
b. Townhouse, duplex, and two -flat:
(1) Front yard - not less than 25 feet. A front yard adjacent to
a major street shall be not less than 40 feet.
(2) Side yards - two side yards each not less than 15 feet in width,
except on corner lots, the side yard adjoining a street shall
not be less than 25 feet in width and 40 feet in width adjoining
a major street.
(3) Rear yard - not less than 30 feet.
c. Other permitted uses - yards shall be required as stated in the
R4 District.
8. Spacing Between Structures
When two or more structures which contain single- family attached dwellings,
single - family semi- detached dwellings, or two - family dwelling structures,
or combinations thereof are on a lot or on contiguous lots comprising
a unified development under the same owenrship or control, the distance
between the structure walls shall be as follows:
a. When the front wall of a structure faces the front wall or rear wall
of the nearest structure, the distance between the two structure
walls shall be not less than 60 feet.
b. When the rear wall of a structure faces the rear wall of the nearest
structure, the distance between the two structure walls shall be not
less than 60 feet.
c.
When the side wall of a structure faces the front or rear wall of
the nearest structure, the distance between the two structure walls
shall be not less than 40 feet, except when the side wall contains
more than two windows on a floor that are not from bathrooms or
storage rooms, such distance between structures shall be not less
than 50 feet, or 60 feet if a main entrance doorway is in such
side wall.

d. When the side wall of a structure faces the side wall of the nearest
structure, the distance between the two structure walls shall be not
less than 30 feet, except when the facing side walls of either of
such structures contain more than two windows on a floor that are
not from bathrooms or contain more than two windows on a floor that
are not from bathrooms or storage rooms, such distance between the
two structures shall be not less than 50 feet, or 60 feet if a main
entrance doorway is in such side wall.
e.
A wall of a structure forming the end of a court shall be not less
than ten feet from the nearest wall of a structure forming the sides
of the court, and a structure forming the end of the court may be
attached to one or both of the structures forming the sides of the
court, provided the distance between facing walls of the structures
forming the sides of the court is not less than the applicable requirements
as set forth above.
f. Where structures are not parallel to each other the required spacing
shall be measured at the midpoint of the distance along which they
face each other, however the spacing between the structures at the
narrowest point shall in no event be less than one -half the required
distance.
g.
Building setbacks from public or private streets shall be in accor-
dance with the required yard areas within the district.
9. Off- Street Parking and Off - Street Loading
In accordance with regulations set forth in Section X.
G. R6 MULTI - FAMILY RESIDENCE DISTRICT
1. Permitted,Uses
a. Any of the permitted uses listed in the R5 District.
b. Multiple family dwellings not over two and one -half stories in height
and the minimum gross area of the development under single ownership
is 15,000 square feet.
2. Special Uses
a. As listed in the R2 District
b. Boarding and lodging houses on a lot not less than 10,000 square feet
in area and not less than 80 feet in width.
c. Multiple family dwellings over two and one -half stories in height on
a lot not less than two acres and not less than 150 feet in width.
d. Tourist homes having not more than five rooms for transient guests.

or 35 feet, whichever is lower.
c. Other permitted uses - not more than three stories or 40 feet, whichever
is lower.
6. Floor Area Ratio
a. Not applicable for dwellings; except multiple family dwellings.
b. Multiple family dwelling
(1) for one -story structures - not more than 0.3; and
(2) for structures having two stories or more - not more than 0.5.
c. Other permitted uses - not more than 0.4.
7. Yards
Except as may be herein otherwise required, yards shall be in accordance
with the following regulations:
a. Single family detached dwellings:
Yards shall be required as stated in the R5 District.
b. Townhouse, duplex and 2 -flat yards shall be required as stated in
the R5 District.
c. For multiple family dwellings:
(1) Front yard - not less than 25 feet. A front yard adjacent to
a major street shall be not less than 40 feet.
(2) Side yard - two side yards each not less than 15 feet in width,
except a side yard adjoining a street shall not be less than
25 feet in width and 40 feet in width adjoining a major street;
for structures more than 30 feet in length, measured perpendicular
to the front lot line, an interior side yard shall be increased
in width by one -half foot for each foot the building exceeds
30 feet in length.
(3) Rear yard - not less than 30 feet.
d. Other permitted uses: Yards .shall be required as stated in the R4 District.

8. Spacing Between Structures
When two or more structures which contain single family attached dwellings,
single - family semi - detached dwellings, or two or more multiple family
dwelling structures, or combinations thereof, are on a lot or on contiguous
lots comprising a unified development under the same ownership or control,
the distance between the structure walls shall be required as stated in
the R5 District.
9. Off- Street Parking and Off- Street Loading
In accordance with regulations set forth in Section X.
This Ordinance shall be in full force and effect from and after its
passage, approval and publication in the manner provided by law.
All Ordinances or parts of Ordinances in conflict herewith shall be and
the same are hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption
of this Ordinance and cause the same to be published in pamphlet form.
