PIN 22 -29- 309 -022 ORDINANCE NO. 904 AN ORDINANCE GRANTING A ZONING VARIANCE TO ALLOW A REDUCTION OF THE REQUIRED FRONT YARD SETBACK AT 1152 STATE STREET - McDONALD'S RESTAURANT WHEREAS, McDonald's Corporation, hereinafter identified as "the Petitioner ", are the owners of 1152 State Street, referred to as "the subject property ", legally described in Exhibit A. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a zoning variance to allow the construction of an enclosed play area with a front yard setback reduced from 40 feet to 18 feet; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on September 5, 1995 to review the request for the zoning variance; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Planning & Zoning Commission recommended approval of the proposed variance; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the approval of the requested variance; and WHEREAS, the President and Board of Trustees of the Village approve the variance for 1152 State Street. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. The subject property described above be and the same is hereby granted a variance to allow a minimum front yard setback of not less than 18 feet. THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW.
