Construction Company, Inc., hereinafter referred to as "the Petitioner ", is the owner of a 2.3 -acre parcel, hereinafter referred to as "the subject property ", located on the south side of Wend Street at Warner Avenue in Lemont, Illinois and legally described as follows: LOTS 23, 24, 25, 26, EXCEPT THE EAST 18.8 FEET THEREOF, OF QUARRY RIDGE, A SUBDIVISION OF PART OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 29, TOWNHSIP 37 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN IN COOK COUNTY, ILLINOIS. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential Planned Unit Development to be known as WATERFORD COURT TOWNHOMES; and WHEREAS, the Plan Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on May 5, 1992, for approval of a Planned Unit Development known as WATERFORD COURT TOWNHOMES; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Lemont Plan Commission has recommended the adoption of a Planned Unit Development Ordinance by the Board of Trustees of the Village; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of the Plan Commission recommendations specified below regarding the subject property; and WHEREAS, the President and Board of Trustees of the Village approve the development of the subject property as a Planned Unit Development pursuant to I11.Rev.Stat.Ch.24, 11- 13 -1.1. e ' NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: Planned Unit Development Approval. That a Planned Unit Development be and is hereby approved and granted to allow the Owner or successors or assigns, (collectively referred to as the "Owner ") to construct a Planned Unit Development upon the subject property legally described above pursuant to Owners Preliminary Site Development Plans attached hereto as Exhibit A and subject to the following Planning Stipulations: 1. That the property be rezoned from B -1 Commercial to PUD with underlying zoning of R -5 Residential. 2. That the property be developed in accordance with the site plan for no more than 16 townhomes. 3. That no parking be allowed on the cul -de -sac other than in the designated guest parking area. 4. That a final landscape plan including all signage and lighting details be approved prior to the issuance of occupancy permits. 5. That the petitioner submit Homeowners Association (HOA) declarations including provisions for snow removal and repair and maintenance of all improvements, including the cul -de -sac, parking area and detention facilities. 6. That all final engineering plans be approved by the Village Engineer. SECTION 2: Zoning District Change and Variation. The subject property described above be and the same is hereby rezoned from its present B -1 District Zoning Classification to PUD with an underlying zoning of R -5 Residential to allow the construction of single - family attached townhomes in accordance with the Preliminary Site Development Plans attached hereto as Exhibit A and the Planning Stipulations identified above. The zoning map of the Village of Lemont be and the same is hereby amended in accordance with the provisions of this Ordinance. Under the Planned Development provisions of the Lemont Zoning Ordinance, variances are hereby granted to allow the cul -de -sac to be privately held and maintained (variance to Section VIII -F -2 -b of Lemont Subdivision Control Ordinance) and to allow the construction of a 4' carriage walk adjacent to the curb (variance tp Village of Lemont Standard Specifications for the Design and Construction of Public Improvements as referenced in Section XI -D -2 -g of the Subdivision Control Ordinance). SECTION 3: Permits. That the Building and Zoning Administrator of the Village is hereby authorized to issue, upon proper application and engineering a building permit as required for the said Planned Unit Development. THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW.
