P.A. 82 -102, ap- proved and eff. July 29, 198L 861. Short title § 1. This Act shall be known and may be cited as 'The Truth in Taxation Act ". 862. Taxing district § 2. As used in this Act: (a) "taxing district" means any unit of local govern- ment, school district, or community college district, includ- ing home rule units, authorized to levy ad valorem taxes; (b) "aggregate levy" means the annual corporate levy of the taxing district and those special purpose levies which are made annually (other than debt service levies and levies made for the purpose of paying amounts due under public building commission leases); (c) "special purpose levies" include, but are not limited to, levies made on an annual basis for contributions to pension plans, unemployment and worker's compensation, or self - insurance; (d) "debt service" means levies made by any taxi°' district pursuant to home rule authority, statute, ref endum, ordinance, resolution, indenture, agreement, 0 contract to retire the principal or pay interest on bone notes, debentures or other financial instruments whi evidence indebtedness. Amended by P.A. 86 -957, § 5, eff. Jan. 1, 1990. 863. Legislative purpose § 3. The purpose of this Act is to require taxing dis tricts to disclose by publication and to hold a public hear ing on their intention to adopt an aggregate levy i amounts more than 105% of the amount of property taxe extended or estimated to be extended, including an amount abated by the taxing district prior to such exten sion, upon the final aggregate levy of the preceding year Amended by P.A. 86 -957, § 5, eff. Jan. 1, 1990. 864. Estimate of annual aggregate levy § 4. Not less than 20 days prior to the adoption of i aggregate levy, hereafter referred to as "levy ", the Corp. rate authority of each taxing district shall determine the amounts of money, exclusive of any portion of that levy attributable to the cost of conducting an election required by the general election law, hereafter referred to as "elec- tion costs ", estimated to be necessary to be raised by taxation for that year upon the taxable property in its district. 865. Compliance by taxing district with notice and hearing provisions § 5. Until it has complied with the notice and hearing provisions of this Act, no taxing district shall levy an amount of ad valorem tax which is more than 105% of the amount, exclusive of election costs, which has been extend- ed or is estimated will be extended upon the final aggre- gate levy of the preceding year. If the estimate of the corporate authority made as provided in Section 4 1 is more than 105% of the amount extended or estimated to be extended, including any amount abated by the corporate authority prior to such extension, upon the final aggregate levy of the preceding year, exclusive of election costs, the corporate authority shall give public notice of and hold a public hearing on its intent to adopt an aggregate levy in an amount which is more than 105% of the amount extended or estimated to be extended upon the final aggregate levy extensions, includ- ing any amount abated, exclusive of election costs, for the preceding year. Such hearing may not coincide with the hearing on the proposed budget of the taxing district. If the taxing district is located entirely in one county, the notice shall be published in an English language news- paper of general circulation published in the taxing dis- trict, or if there is no such newspaper, in an English language newspaper of general circulation published in the county and having circulation in the taxing district. If the taxing district is located primarily in one county but extends into smaller portions of adjoining counties, the notice shall be published in a newspaper of general circula- tion published in the taxing district, or if there is no such newspaper, in a newspaper rf general circulation publish- ed in each county in which any part of such district is located. If the taxing district includes all or a large portion of 2 or more counties, the notice shall be published in a news- paper of general circulation published in each county in which any part of such district is located. . The notice shall appear no more than 14 days nor less than 7 days prior to the date of the public hearing. The notice shall be no less than one eighth page in size, and the smallest type used shall be twelve point and shall be enclosed in a black border no less than 1/4 inch wide. The notice shall not be placed in that portion of the newspaper where legal notices and classified advertisements appear The notice shall be published in the following form: Notice of Proposed Property Tax Increase for (commonly known name of taxing district). I. A public hearing to approve a proposed property tax levy increase for (legal name of the taxing district) for (year) will. be held on (date) at (time) at location). Any person desiring to appear at the public hearing and present testimony to the taxing district may contact (name, title, address and telephone number of an appropriate official). II. Nothing contained in this Act shall serve to extend or authorize any tax rate in excess of the maximum permitted by law nor prevent the reduction of any tax rate. 869.1. Counties of more than 3.000,000 — Levies prior to January 1, 1982— Inclusion of debt service lev- ies in aggregate levy § 9.1. If any taxing district lying wholly within a coun- ty having more than 3,000,000 inhabitants, by including debt service levies as a part of its aggregate levy pursuant to the estimating procedure set out in Section 4 of this Act,' had a levy prior to January 1, 1982 which was more than 105% of the amount of ad valorem property tax, exclusive of election costs and debt service levies, extend- ed or estimated to be extended upon the levy of the preceding year, such levy shall not be deemed invalid due to noncompliance with the provisions of this Act. Nothing contained in this Act shall serve to extend or authorize any tax rate in excess of the maximum permitted by law nor prevent the reduction of any tax rate. 869.1. Counties of more than 3,000,000 — Levies prior to January 1, 1982 — Inclusion of debt service lev- ies in aggregate levy § 9.1. If any taxing district lying wholly within a coun- ty having more than 3,000,000 inhabitants, by including debt service levies as a part of its aggregate levy pursuant to the estimating procedure set out in Section 4 of this Act,' had a levy prior to January 1, 1982 which was more than 105% of the amount of ad valorem property tax, exclusive of election costs and debt service levies, extend- ed or estimated to be extended upon the levy of the preceding year, such levy shall not be deemed invalid due to noncompliance with the provisions of this Act. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VH,LAGE OF LEMONT, IN THE COUNTIES OF COOK, WILL AND DU PAGE, ILLINOIS, SECTION 1: That the amounts hereinafter set forth or so much thereof as may be authorized by law as may be needed, be and the same are hereby assessed and levied for the General Corporate Fund, Street & Bridge Fund, Unemployment Insurance Fund, Police Protection Fund, Crossing Guard Fund, Liability Insurance Fund, Worker's Compensation Fund, Audit Fund, Social Security Fund, Police Pension Fund, Garbage Fund, Civil Defense Fund, Street Lighting Fund, Illinois Municipal Retirement Fund, and such other purposes as are hereinafter specifically described for the Fiscal Year of the VILLAGE OF LEMONT, ILLINOIS, beginning May 1, 1992, and ending April 30, 1993. SECTION 2: That the amount levied for each object and purpose appears in EXHIBIT "A" in the column after the words "TO BE RAISED BY TAX LEVY" that portion of each levy to be raised by taxation and there is indicated under the column headed "ESTIMATED RECEIPTS FROM SOURCES OTHER THAN TAX LEVY' those portions of each item levied for which no 1992 levy is made. SECTION 3: That any sum of money heretofore appropriated and not heretofore expended and now in the Treasury of the Village of Lemont is hereby appropriated by this Ordinance. SECTION 4: That any unexpended balance in any one of the foregoing appropriations may be used and applied toward the payment of any lawful corporate debt or charge of the Village of Lemont. SECTION 5: If any section, subdivision, sentence or clause of this Ordinance is for any reason held invalid or to be unconstitutional, such decision shall not affect the validity of the remaining portion of the Ordinance. SECTION 6: This Ordinance shall be in full force and effect from and after its passage, approval and recording as required by law.
