O-789-93 05/24/93VILLAGE OF LEMONT ORDINANCE NO. lee, AN ORDINANCE AMENDING SECTIONS OF ORDINANCE NO. 456, AS AMENDED, PERTAINING TO TREE PRESERVATION AND REPLACEMENT ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT This ER 1f day of Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Counties of Cook !ill, and DuPage, Illinois, this dayof __Y� , 1993 1993 VILLAGE OF LEMONT ORDINANCE NO. 71 DATE OF APPROVAL 5--.P."/`-'93 AN ORDINANCE AMENDING SECTIONS OF ORDINANCE NO. 456, AS AMENDED, PERTAINING TO TREE PRESERVATION AND REPLACEMENT WHEREAS, The Village of Lemont has the authority to regulate matters affecting the health, safety and welfare of the community; and WHEREAS, Ordinance Number 456, the Lemont Subdivision Regulations, provides for the orderly and harmonious development of the Village and its planning area; and WHEREAS, trees are an important natural resource with significant benefits to the public, including beautification, wildlife habitat, inhibition of stormwater runoff and soil erosion, protection from extremes of weather, reduction of pollution, and enhancement of property values; and WHEREAS, the Village President and the Board of Trustees of the Village of Lemont have determined that it is in the best interest of the Village to protect and preserve the remaining stands of mature trees by discouraging unnecessary disturbance of trees during the development of land. NOW, THEREFORE, BE IT ORDAINED by the President and the Board of Trustees of the Village of Lemont that Ordinance No. 456 known as the Lemont Subdivision Regulations is hereby amended to provide the following: SECTION 1. That a new Section IV -B -9 is hereby adopted and inserted as follows: 9. A tree survey illustrating the location, species, and caliper (diameter) of all trees of eight inches caliper or greater, and which trees are to be removed. SECTION 2. That a new Section IV -C -12 is hereby adopted and inserted as follows: 12. If a tree survey is required, proposed method of tree preservation and replacement shall be described. SECTION 3. That the existing Section XI -G is hereby changed to Section XI -H and a new Section XI -G is hereby adopted and inserted as follows: 2 G. TREES 1. All trees greater than eight inches caliper (measured one foot above the ground) and located within existing or proposed public lands, required front or rear yards, or common open space areas shall be preserved, or replaced in accordance with this Section, unless: a. The tree is a hazard; b. Removal of the tree is required to provide ingress and egress; c. The tree is diseased or weakened; d. Removal of the tree is recommended by good arborcultural practice to help achieve a healthier wooded area; e. Removal of the tree is necessary to achieve an essential grade change or positive drainage. 2. During construction, all trees to be preserved shall be protected by one or more of the the following methods, as appropriate: a. Placement of a snow fence or other barrier at a radius from the trunk equal to or greater than the dripline of the tree, which shall indicate the zone to be protected from construction equipment, grading, excavating, and the stockpiling of fill or other materials. b. Augering instead of trenching where where utilities are installed within the area enclosed by the dripline. c. Transplantation, when possible and when using good arborcultural practices. 3. If trees to be preserved are removed or damaged during construction, such trees shall be replaced according to the following schedule: a. Two (2) 2.5 -inch trees, or equivalent, for each tree measuring 8 -12 inches in caliper. b. Three (3) 2.5 -inch trees, or equivalent, for each tree measuring 13 -18 inches in caliper. c. Four (4) 2.5 -inch trees, or equivalent, for each tree measuring 19 -24 inches in caliper. 3 d. Five (5) 2.5 -inch trees, or equivalent, for each tree measuring 25 -30 inches in caliper. 4. Where tree replacement on -site is impractical, the Village may allow planting of replacment trees at a suitable location off -site. 5. Street trees, as required by Section XI- D -2 -h, shall not be considered replacement trees for purposes of this Section. SECTION 4. This ordinance shall be in full force and effect ten (10) days from and after its passage, approval and publication, which shall be in pamphlet form. 4 PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DuPAGE, ILLINOIS, on this day of , 1993.
