Parcel No. 22 -27- 401 -008 VILLAGE OF LEMONT 418 Main Steet Lemont, Minds CO '7::" ORDINANCE NO. /744> AN ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT AND APPROVING A REZONING FROM R -1 TO PLANNED UNIT DEVELOPMENT WITH UNDERLYING R -4 ZONING FOR A 5 ACRE PARCEL SOUTH OF McMCARTHY ROAD (RUFFLED FEATHERS MAINTENANCE FACILITY) WHEREAS, Robert C. Ranquist and Co., Inc., hereinafter referred to as "the Petitioner ", is the owner of a 5 -acre parcel, hereinafter referred to as "the subject property ", located on the south side of McCarthy Road and north of the eastern portion of the Ruffled Feathers Golf Community in Lemont, Illinois and legally described as follows: THE NORTHWEST 1/4 OF THE SOUTHEAST 1/4 (EXCEPT THE WEST 1165 FEET THEREOF, MEASURED ON THE NORTH AND SOUTH LINES THEREOF) OF SECTION 27, TOWNSHIP 37 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. ALSO, ALL THAT PART OF McCARTHY ROAD LYING NORTH OF AND ADJACENT TO SAID PROPERTY. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a map amendment to rezone the subject property from R -1 to PUD R -4 in order to join the property to the existing Ruffled Feathers Planned Unit Development; and WHEREAS, the Plan Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on August 5, 1991, for consideration of the above - referenced request; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Metropolitan, a newspaper of general circulation within the Village; and WHEREAS, the Village Staff recommended approval of the petition to rezone the property for incorporation into the Ruffled Feathers Planned Development; and WHEREAS, the findings of the Lemont Plan Commission, upon due consideration, were that the proposed classification was an appropriate one and that approval of said petition would be consistent with Village policy; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of the Plan Commission recommendations; and WHEREAS, the President and Board of Trustees of the Village approve the rezoning and development of the subject property as a Planned Unit Development pursuant to I11.Rev.Stat.Ch.24, 11- 13 -1.1. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: Zoning District Change. The subject property described above be and the same is hereby rezoned from its present R -1 District Zoning Classification to PUD with an underlying zoning of R -4 Residential to allow the incorporation of the property into the Ruffled Feathers PUD and the construction of a maintenance facility in accordance with Village Ordinances. The zoning map of the Village of Lemont be and the same is hereby amended in accordance with the provisions of this Ordinance. SECTION 2: Permits. That the Building and Zoning Administrator of the Village is hereby authorized to issue, upon proper application and engineering a building permit as required for development of the property in accordance with site plan attached as Exhibit "A." THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW.
