WHEREAS, an Application has been fled by KEYSON RECYCLING
CORPORATION in connection with a Special Use Permit within the M -3 zoning district
of the Village of' Lemont; and
WHEREAS, the Applicant has requested said Special Use Permit for the purpose
of crushing concrete and asphalt for use on the premises as well as transporting off
premises; and
WHEREAS, the Village of Lemont Zoning Board of Appeals granted the Applicant
the temporary Special Use Permit which has been extended by the Village Board from time
to time subject to certain conditions; and
WHEREAS, the Applicant has requested a final extension of the Special Use Permit
for the period ending December 31, 1995.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND
DUPAGE, STATE OF ILLINOIS, and KEYSON RECYCLING CORPORATION be granted
a temporary Special Use Permit for the property commonly known as 1702 Main Street,
Lemont, Illinois containing approximately 5 acres, and legally described as follows:

to be used for the purpose of crushing concrete and asphalt on premises as well as
transporting off premises subject to the following terms and conditions:

dated July 16, 1993,
A Letter of Credit in the amount of 125% of the public improvements as estimated
by the Village Engineer shall be deposited with the Village of Lemont within 60 days from
the date of the granting of this Special 'Use.

SECTION IV
The Applicant agrees to provide soil and boring samples 30 days prior to
termination of the Special Use Permit certifying that all deposited material complies with
Illinois Environmental Protection Agency's standards governing hazardous or toxic waste,
the cost of which sampling and engineering expenses shall be borne by the Applicant.

In the event the Applicant deviates from the terms and conditions of this Special
Use including but not limited to complying with all Village Ordinances, there shall be an
immediate revocation and termination of this Special Use without farther notice.
SECTION V
The Applicant shall be responsible for paying any and all engineering fees, attorneys
fees and court costs in connection with the enforcement of the terns of this Special Use
Permit.
That this Ordinance shall be in fuII force and effect from and after this passage,
approval, and publication in pamphlet form as provided by law.
All Ordinances or parts of Ordinances in conflict herewith shall be and the same
are hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.

Dear Mr. Tulley:
Pursuant to our meeting on July 12 and subsequent receipt of your Staff
Comments, we are resubmitting our request for the Special Use Permit. Our
response to the staff comments are as follows:
1 & 2. We have added perimeter and top of pile field grades collected on
4- 28 -93. It should be noted that the dynamic nature of the crushing
operation causes a shifting landscape from day to day on the site.
Consequently, other than the perimeter grades and the location /elevation
of the weigh scale - all other elevations are transparent as to place -in-
time value. The final grades with respect to the perimeter grades are what
should be deemed important.
3. The final grading plan does show the proposed top of floor of the
building to be 15' above the last grades shot in 1990 (not 1988).
The perimeter grades to the east of this property, as well as Main St.
grades to the south, would easily allow the proposed building floor elevation.
The reason for the retaining wall is to allow for on -site disposal of the
clean screenings from the crushing operation, which cannot be used as saleable
aggregate material, but are a by- product of the operation and are substantial
in volume.
4. A scheduling and structural plan, prepared by aregistered structural
engineer will be submitted for the retaining wall as part of the permit
application. At this point in the process it seems obvious that a gravity
type retaining wall, as proposed, will be adequate, and most amenable to staged
filling. To engage a structural engineer at this point, however, would simply
be a waste of money if the concept plan were not approved.
5. The property has been filled since 1990 with nothing but clean fill, either as
refusal material from the concrete crushing, or with crushed material itself.
Attached is a soil report from June 8, 1990, which had previously been
submitted to the Village to establish the fill quality at that time. It
would appear that clean fill, not requiring EPA approval, has been added to
the site.
6. A cost estimate for the proposed improvements is attached.
7. We have added soil erosion control measures and details to our plans.

8. The improvement agreement with IDOT & Ni-Gas in the R.O.W. and
easement of Main St. will contain language insuring protection
of landscaping /screening. The final draft of the agreement shall
first be approved by the Village prior to execution & recording.
9. The site surfacing of the property at the completion of the
SpeciaL Use shall be completely done with crushed concrete. The
cementation quality of the crushed aggregate will provide a congealed
surface upon first wetting, and will exhibit qualities similar to a
concrete surface.Should a building permit be applied for prior to
completion of the Special Use, then the permit site plan would
supercede the presently proposed grading and surfacing plan.
10. See Note 5. Continuous monitoring of fill operations is not necessary.
Soil borings or open test pits can be sampled at the completion of
crushing operations. For the most part, the majority of the fill
on the site has already been accomplished, anyway.
11. A legal description of the property is attached.
12. No comment.
Ten sets of revised drawings are also attached - 4 sets are sealed.

On June 1, 1990, a representative of O'Brien & Associates, Inc.
observed the performance of six (6) test pits at the above
site. The results of the test pits, along with a location
diagram, are included with this report.
It is our understanding that the existing site has had
miscellaneous clay, topsoil and concrete rubble placed on the
site. The fill varies in thickness from depths on the order of
4' to 30'. The site is proposed to be used as an industrial
park development and site development will include some
additional grading. The purpose of this report is to describe
the soil conditions encountered in the test pits, to analyze
and evaluate the data obtained, and to submit recommendations
regarding the proposed development at the site.
During the excavation of the test pits, representative samples
of the soils were obtained in the field and returned to our
laboratory. Water content and calibrated penetrometer tests
were performed on the samples and the results of the testing
are included with this report.
Specific soil conditions encountered at each test pit are
indicated on the Summary of Test Pits. As indicated on the
summary, a silty clay and topsoil fill mixed with concrete
rubble was encountered at the ground surface and extended to a
depth of 4.0' to greater than 18.0'. In test pits 2, 2A and 3,
the fill was underlain by topsoil and peat with a thickness of
2.0' to 4.0'. A soft, gray silty clay was encountered below
the topsoil in test pit no. 3. Bedrock was encountered below
the topsoil and peat in test pit no. 2A. The fill materials
contained smaller percentages of wood, plastic, steel and wire.
Water was observed in test pit no. 1 at a depth of 4.0'. No
water was observed in any of the remaining test pits performed

at the site. The water observed in test pit no. 1 appears to
be a perched water condition trapped within more permeable fill
materials.
Regarding site development, it may be feasible to support the
proposed buildings on footing foundations. However, because of
the percentage of topsoil encountered in the fill materials and
the high moisture content of the topsoil and peat encountered
below the fill, some settlement may occur as a result of
consolidation or desiccation of the fill and organic materials.
Information obtained from the test pits indicates that the
settlement may be relatively minor and uniform. If the
settlement will be relatively minor and uniform, footing
foundations can be employed for support of the structure. To .
evaluate the potential for settlement, it is recommended that
settlement plates be installed and a monitoring program
established. The number of settlement plates should be
determined based on the final grading and proposed site
development plans.
For footing foundations, it is recommended that the upper 4' of
fill consist of an inorganic silty clay. By employing an
inorganic silty clay in the upper 4', the concrete rubble will
not be encountered for normal footing depth excavations. This
clay fill should be placed in lifts not exceeding 9" in loose
thickness and compacted to a recommended minimum 95% ASTM
Specification D -1557 density.
If the settlement information indicates that the total or
differential settlement will be unacceptable for the proposed
development, the buildings can be supported on a deep
foundation system extending to the underlying During
installation of a deep foundation system, some problems should
be anticipated because of the concrete rubble present at the
site.
For support of the floor slab and paved areas, some settlement
may occur as a result of consolidation or desiccation of the
fill and organic materials. The magnitude of the settlement
can be established based on the results of the settlement
plates. If the settlement is not excessive, the floor slab can
be supported at grade.
The analysis and recommendation submitted in this report have
been based upon available information. Because of the
possibility of a variation in the soil conditions occurring
between the test pit locations, it is recommended that the
settlement plate installation be supervised by an experienced
soil engineer. If you wish, we would welcome the opportunity
to provide this recommended service for you to determine if the
foundations can be situated upon the fill materials. In
addition, we suggest that we be given the opportunity to

provide you with additional engineering services by reviewing
the plans and specifications after they have been prepared for
the project so that we might have an opportunity of commenting
upon the effect of the soil conditions upon the design and
specifications.
This report has been based upon our understanding of the scope
of work of the project. Any changes in the design or location
should be brought to our attention so that we might determine
if these changes affect our recommendations.

STAFF COMMENTS
KEYSON EXCAVATING SPECIAL USE PERMIT
The following is an outline of staff comments after reviewing
the letter and plans submitted by Keyson Excavating:
1. The topographic survey submitted is not current. The
information furnished has a date of 6/21/90.
2. The stock piles of material and other features should be
delineated. The plans show both Raw Concrete and Raw
Bituminous Concrete. These piles should be dimensioned on the
plan along with elevations. All site features should be
located with elevations in relation to the property line.
3. The final grading plan submitted indicates the property will
be filled in the range of fifteen (15) feet above existing
contours. Existing contours are based on a 1988 survey. The
latest plan submitted indicates the proposed finished floor of
the building to be constructed at an elevation of 107.5. The
previous plan submitted by Haefferle- Butler Engineering
indicates a finished floor at an elevation of 89.5, an
eighteen (18) foot difference.
4. Plans submitted show a retaining wall to be constructed
concurrent with the filling operation. Retaining wall details
should be provided and certified by a structural engineer.
5. An I.E.P.A. permit may be required depending on the type of
fill which is to be used to grade this property. A detail of
the proposed fill has not been provided. At this point we
would caution against allowing further fill of the property
until the I.E.P.A. have examined the site and determined
whether the filling operation requires a permit.
6. A new Special Use Ordinance should be drafted including all
pertinent points. An estimate should be provided by Keyson's
engineer to determine the cost of the improvements. A letter
of credit should then be obtained for the filling operation
and any remedial measure which might be required.
7. New plans should address erosion control on the site. The
developer should submit an erosion control plan along with
grading information. These plans should be signed and sealed
by a registered professional engineer.
8. A screening of trees is proposed. These trees are proposed to
be planted in the Ni -Gas easement. Steps should be taken to
ensure that these trees are not destroyed or caused to be
removed in case of some utility work.
9. Questions were raised on the final surface of the interior -
what material will it consist of; i.e., blacktop, gravel, seed
or grass? This should be specifically noted on the Phase IV
operation.
10. Should occasional soil borings be taken to determine what is
being applied?
11. A legal description of the land should be obtained showing the
land description and delineating the property corners.
12. Proposed interim improvements consist of the following:
a. Installation of sanitary sewer along Main Street.
b. Completion of Final engineering plans.
c. Planting of trees within Northern Illinois Gas easements.
d. Construction of retaining wall.
e. Filling of the site with unspecified material.

Temporary Special Use Permit Application
Dear Mr. Tulley:
This application for a temporary special use permit for
concrete crushing for reuse as aggregate fill material includes
10 sets of preliminary site improvement drawings (sheets C -1
thru C -3). The drawings show the current conditions, an
interim improvements phase, and a final site plan.
The site plan shows a completed 5 acre parcel, with grading,
drainage and a building. The final size and location of the
building may be modified. The grading, however, will remain
essentially as shown.
The bases for this application are as follows:
1. The temporary special use permits which have been previously
issued.
2. The establishment of semi - permanent facilities (weigh
scale) based on the previously established merits of
the operation.
3. The benign nature of the operation. There have been no
complaints registered in the nearly three years of
operation.
4. The existing stockpiles of raw and processed materials
on site, which must eventually be dealt with.
5. The expressed desire by major road building contractors,
among others, to continue to use the facility.
The phases of work proposed as part of the permit are as follows:
PHASE I - To Be Completed By March 31, 1994
A. Complete final engineering plans for site improvements.
Apply for permits within 45 days of issuance of special
use permit.
B. Install sanitary sewer extension across south of property.
Include the installation of a sewer service.
