AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF
LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS
ABBEY OAKS
WHEREAS, Pat Cronin Construction Inc., as the beneficiary of
State Bank of Countryside Trust No. 92 -1216 and Worth Bank and
Trust Company Trust No. 4868, is the owner of a 73 -acre parcel
(formerly the St. Vincent Seminary), hereinafter referred to as
"the subject property ", located on the north side of 127th Street
west of Archer Avenue in Lemont, Illinois and legally described as
follows:
PARCEL 1: THE SOUTH 1600 FEET OF THE WEST 1/2 OF THE
SOUTHEAST 1/4 AND THE SOUTH 1600 FEET OF THE WEST 1/2 OF THE
EAST 1/2 OF THE SOUTHEAST 1/4 OF SECTION 28, TOWNSHIP 37

WHEREAS, the Owner /Petitioner made application under the
provisions of the Lemont Zoning Ordinance for a residential Planned
Unit Development to be known as ABBEY OAKS; and
WHEREAS, the Planning Commission of the Village of Lemont,
Illinois (the "Village ") did heretofore commence and conduct a
Public Hearing on January 5, 1993, for approval of a Planned Unit
Development known as ABBEY OAKS; and
WHEREAS, a notice of the aforesaid Public Hearing was made in
the manner provided by law and was published in the Lemont
Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Lemont Planning Commission has recommended the
adoption of a Planned Unit Development Ordinance by the Board of
Trustees of the Village; and
WHEREAS, the President and Board of Trustees of the Village
have determined that the best interests of the Village will be
served by the adoption of the Planning Commission recommendations
specified below regarding the subject property; and
WHEREAS, the President and Board of Trustees of the Village
approve the development of the subject property as a Planned Unit
Development pursuant to Ill.Rev.Stat.Ch.24, 11- 13 -1.1.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Planned Unit Development Approval. That a Planned
Unit Development be and is hereby approved and granted to allow the
Owner or successors or assigns, (collectively referred to as the
"Owner ") to construct a Planned Unit Development upon the subject
property legally described above pursuant to Owner's Preliminary
Plans attached hereto as Exhibit A and subject to the following
Planning Stipulations:

1. That the property be rezoned from R -1 Single- family
Residence District to PUD with underlying zoning of R -4
Single- family Residence District on approximately 53
acres and R -1 Single- family Residence District on
approximately 20 acres, as indicated by the Owner's
Preliminary Plan (Exhibit A).
2. That any development, redevelopment, demolition or
occupancy of the 20.1 -acre "school site," zoned R -1,
shall not be permitted until a planned unit development
plan for that parcel has been reviewed and approved by
the Village. Such a plan shall meet all requirements for
a planned unit development plan under the Lemont Zoning
Ordinance.
3. That a tree preservation /replacement plan, to consist of
a conservation easement and tree -care provisions in the
development plans and specifications, shall be submitted
for Village review and approval prior to final plat.
Such a plan shall protect all trees greater than 8 -inch
caliper within the conservation easement and shall
require the protection or replacement of all such trees
within the non - buildable areas of lots and public rights-
of-way.
4. That the fence and entrance gate on 127th Street shall be
of a unified design and construction materials, and no
additional rear -yard fences shall be permitted for lots
1 and 84 through 91, inclusive. The fence shall be
constructed by the Owner, or successors or assigns, as
part of Phase I. tom^

described above be and the same is hereby rezoned from its present ti
